Singer PROPERTY LOCATION: 20575 Soundview Ave,(Adj.to Long Island Sound)Southold,NY i SCTM# 1000-51-4-11. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued!its reply dated 3/17/22 stating that this application is.considered a matter for local determination as there appears,to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfi•ont Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 25, 2022. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is- CONSISTENT with the LWRP for the pool's non-conforming bluff setback because the swimming pool is landward of the existing residence. The proposed garage's non-conforming side yard setback and its proposed additional use as a bedroom loft are EXEMPT from Coastal Consistency Review. However, there is ample area on the property to build a.code conforming garage and a code conforming swimming pool. PROPERTY FACTS/DESCRIPTION: The parcel is a non-conforming 27,578 square foot waterfront parcel. The parcel has 115.67 feet of bluff frontage along the Long Island Sound. The parcel runs 135.12 feet along Sound View Avenue. The parcel runs 231.76 feet on the West side and 210.33 feet on the East side. The parcel is improved with a 2-story frame house that is located partially within the coastal erosion hazard line, a frame garage, and a landing with wood steps going down the bluff to a wood bulkhead. All is shown on a survey by John T.Metzger L L.S, last revised September 27, 2019 BASIS OF APPLICATION: Request for Variances from Sections 280-124 and the building inspector's February 7, 2022, Amended April 2,5, 2022 and June 22, 2022 Notice of Disapproval based on an application for a permit to construct an accessory in ground swimming pool and accessory garage with a non-permitted bedroom loft on the second floor; at 1)the swimming pool is located less than 100 feet from the top of the bluff;2)accessory garage is located less than the code required minimum side yard setback of 20 feet; and 3) Request to overturn the-building inspector's June 22,2022 Notice of Disapproval for the non-permitted use of a second floor finished bedroom loft to be constructed in the Accessory Garage; located at 20575 Soundview Ave(Adj.to the Long Island Sound)Southold, NY. SCTM# 1000-51-4-11. Page 2,August 18,2022 #7661,Singer SCTM No. I 000-51-4-11 RELIEF REQUESTED: The applicant requests variances to 1)construct a swimming pool 71 feet from the top of the bluff where code requires a 100 foot minimum bluff setback;2) Construct a new accessory garage with a side yard setback of 15 feet,9 inches where town code requires a minimum side yard setback of 20 feet, and to permit the construction of a bedroom and full bathroom with shower in the second floor loft of the proposed garage where town code does not permit bedrooms or full bathroom in accessory structures unless the homeowner applies for a,special exception to establish a legal accessory apartment that is approved by the Board of Appeals based upon documentation verifying compliance with the code requirements for such use. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code.`The applicant on August 11,2022 submitted a plan that is dated January 2021 that shows a-pioposed I/A septic system, pool equipment, pool backwash leaching pool, and adds an outdoor shower to the proposed;garage. The revised plan does not bring the plan into more conforming with the code. ADDITIONAL INFORMATION: The applicant has submitted multiple proposals for the scope of work'on this project. The Architectural plans by Charles W.Kuehn show the scope of work being to add an accessory garage and in ground swimming pool. During the hearing the applicant stated that the/owner is not working on the frame dwelling at this time and is only, applying for the proposed work in the accessory garage and in-ground swimming pool at this time. The proposed habitable space in the garage is to be used when the dwelling cannot be occuoied during improvements. The Board members advised the applicant that if the dwelling is demolished, in accordance with Town Law(50%or more of value),that an application to the ZBA would be required if the applicant proposed the reconstruction of the dwelling less than the permitted 100 feet from top of bluff. In response, the applicant stated that demolition has not been considered. The applicant has a Coastal Erosion Management Permit from the Southold Town Board Trustees dated March 23, 2021 which allowed the installation of additional 150 ton,of 1-to-3-ton rock as armoring at base the base of the eastern section of the bulkhead, among other improvements to the subject property shown on'the site plan prepared by Costello Marine Contracting stamped approved on March 18, 2021. The New York State Department of Environmental Conservation (NYSDEC) issued permit #1-4738-01561/00007 dated August 9, 2021. The permit identifies an area of severe erosion and it permits the applicant to reset and install armoring at the base of the;eastern section of the bulkhead;reset any existing dispersed rock at the western section of the bulkhead(rock armoring not to exceed 2.5 ton per linear foot), vegetate the top of the bluff and any disturbed areas along bluff face with native plantings; all as depicted on the site plan by Costello Marine Contracting Corp., stamped approved on March 18, 2021. In support of the application, the applicant submitted ZBA Appeal#5427 dated December 4,2003. In this decision, the ZBA granted approval for an as-built deck setback 10 feet from the top of the bank. This decision occurred prior to the hurricane event known as Superstorm Sandy on October 22, 2012, which did substantial damage along Soundview Drive. The Board of Trustees and the NYSDEC now identifies this parcel and neighboring parcels as areas experiencing severe bluff erosion. Accessory`uses in accessory structures: Article III. Section 280-13(C) does not list bedrooms or full bathrooms as an accessory use which is permitted in accessory structures;nor is a bedroom a customary use in an accessory garage structure. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 4,2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: • Page 3,August 18,2022 #7661,Singer SCTM No. 1000-51-4-11 1. Town Law 4267-b(3)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of waterfront properties developed with single family homes. Site inspection and Suffolk'County GIS ariel photos show that many of the residences in the neighborhood are less than the code conforming 100 feet from the top of the bluff. However, these-residences are older residences and the parcels have faced substantial coastal damage from storms over the years. Accessory structures with non-conforming bluff setbacks and non-conforming side yard setbacks are not characteristic of this neighborhood. The proposed garage loft bedroom is not a permitted use in an accessory structure pursuant to the Southold Town Code. ` 2. Town Law 4267-b(3)6)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The Architectural drawings show that the applicant has a code conforming building envelope to build an accessory garage and in-ground swimming pool. The applicant could build an accessory garage with a code conforming side yard setback and without a nonconforming habitable use. 3. Town Law §267-b(3)(b)(3). The variances denied herein for the in-ground swimming pool bluff setback is mathematically substantial, representing 29%relief from the code. The variance for the non-conforming accessory garage side yard setback is mathematically substantial representing 2 1% relief from the code. The variance denial of overturning the notice of disapproval for the non-conforming bedroom in an accessory structure is a request for a use variance and represents a request for 100%relief from the code 4. Town Law_267-b(3)(b)(4). Evidence relating to permits from the New York State Department of Environmental Conservation and Southold Town Board of Trustees files suggest that a variance to construct an accessory structure closer than 100 feet from the top of the bluff in this residential community may have an adverse impact on the physical or environmental conditions in the neighborhood,as well as evidence accumulated by these agencies;relating to Superstorm Sandy and other storm occurrences. 5. Town Law U67-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law$267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a garage and swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Dantes, seconded by Member Lehnert, and duly carried,to or DENY as applied for, Vote of the Board: Ayes: Members Weisman(Chairperson)Dantes,Acampora, and Lehnert. This Resolution was duly adopted(4-0)(Member Planamento Recused) Leslie Kanes Weisman,Chairperson Approved for filing / /2022 Cantrell, Elizabeth From: Cantrell, Elizabeth Sent: Friday, October 29, 2021 3:50 PM To: 'cwkarchitect@gmail.com' Subject: Joel Singer, SCTM# 1000-51-4-11 Mr. Kuehn, The office of the Board of Trustees is in receipt of the Wetland Permit application noted above. After an initial review it was determined that the proposed projects require a variance for the Town's Zoning Board of Appeals(additions/new structures within 100'from top of bluff). The process in Southold Town is that if you need a variance, you need to apply to the Zoning Board and receive a determination prior to this office moving forward with your application. At this time, this office is postponing your application until a determination has been rendered by the ZBA. When a determination has been made by the ZBA if they modified your current plan, you must submit a revised project description and four revised sets of plans to this office in order for us to proceed. I also reviewed your written project description and I am requesting a little more information which you can send via email. Could you please give me the total square footage (footprint) of the total dwelling(with additions). Please submit the approximate length of the proposed retaining walls along the pool/pergola. The site plan last dated January 2021 does not show a pool backwash drywell or gutters to leaders to drywells for the dwelling/garage. Please update your site plan to show these items as they are a requirement. Will the sanitary system be upgraded? If you have plans for this, please submit four sets of sanitary upgrading plans and add that notation to the written project description. If you have any questions regarding this email please feel free to contact me.
