[d] Pilings shall not project more than three feet above the surface of a dock or catwalk,unless a need for greater height is demonstrated. [e] All excess fill from installation of pilings must be removed from tidal or freshwater wetland area on the same day as installation and disposed of in an approved upland disposal area. [f] Tie-off poles associated with residential docks will only be permitted to secure one vessel.If the dock utilizes a float,the poles shall not project farther seaward than the outer edge of the float.If a float is not used,the pole(s)can be situated seaward of the end of the dock sufficient to secure the vessel. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous location on the worksite and adequately protected from the weather. 4. No Construction Debris in Wetland or Adjacent Area Any debris or excess material fi•om construction of this project shall be completely removed from the adjacent area(upland)and removed to an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas. 5. Materials Disposed at Upland Site Any demolition debris, excess construction materials,and/or excess excavated materials shall be immediately and completely disposed of in an authorized solid; waste management facility.These materials shall be suitably stabilized as not to re-enter any water body,wetland or wetland adjacent area. G. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activities. 7. Storage of Equipment,Materials The storage of construction equipment and materials shall be confined to the upland area landward of the bulkhead or on a barge. 8. Barge Access Barge shall be used only during periods of high tide.The barge may not test on grade or disturb benthic sediment. 9. Dock,Catvalk Size Dock or catwalk shall not exceed 4 feet in width and shall be a minimum of 4 feet above grade(as measured from ground to bottom of dock/catwalk decking)over tidal wetland areas. 10. Wood Preservatives a. Pressure treated wood used for construction of in-water structures must have undergone a treatment process approved (stamped or otherwise marked as certified)by the American Wood Preservative Association. b. Wood treated with Pentachlorophenol (PCP)must not be used in marine or brackish waters. Wood treated with PCP must be aged in the open air for at least three months prior to in-water use. c. The use of creosote treated wood is prohibited both in the water and upland areas. d. Chromated Copper Arsenate(CCA)pressure treated wood must be clean and free of CCA surface deposits. Wood with surface deposits must be washed for at least 5 minutes under running water prior to use.The washing must occur greater than 100 feet landward of any regulated wetland and/or water body. (Note "E." below for handling wash water.) c. Any wood debris such as sawdust or wash water must not enter any water body, including wetlands or protected buffer areas. 11. Catwalk Decking-60% Open Space The catwalk decking shall be constructed of fiberglass grating with a minimum of 60%open space to reduce shading impacts. 12. No Prop Dredging Prop dredging, or the act of utilizing and/or dimeting the propeller or propulsion system of a motorized vessel and/or the water-borne forces created by said propeller or propulsion system, to excavate or displace existing bottom sediment and benthic habitat for the direct or indirect purpose of establishing or increasing water depth, is a regulated activity and is not authorized by this permit. Prop dredging is strictly prohibited Without further written authorization (permit, modification or amendment) from the department. 14. No Dredging or Excavation No dredging,excavating or other alteration of shoreline or underwater areas is authorized by this permit, nor shall issuance of this permit be construed to suggest that the Department will issue a permit for such activities in the future. 15. No Permanent Structures on Dock No permanent structures shall be installed on dock/catwalk/float without first obtaining written Department approval (permit, modification, or amendment). 16. Incidental Disturbance to Vegetation It is the responsibility of the applicant to remedy any incidental disturbances resulting in damage or removal of wetland vegetation. Upon completion of construction activities,any disturbed areas shall be planted with the appropriate marsh vegetation. Maintain Erosion Controls All erosion control devices shall be maintained in good and functional condition until the project has been completed and the area has been stabilized. 22. State May Order Removal or Alteration of Work If future operations by the State of New York require an alteration in the position of the structure or work herein authorized,or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work,obstructions,or hazards caused thereby without expense to the State,and if, upon the expiration or revocation of this permit, the structure, fill, excavation,or other modification of the watercourse hereby authorized shall not be completed,the owners,shall, without expense to the State,and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 23. State May Require Site Restoration If upon the expiration or revocation of this permit, the project hereby authorized has not been completed,the applicant shall,without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may lawfully require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 24. No Interference With Navigation There shall be no unreasonable interference with navigation by the work herein authorized. 25. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids,sediments, fuels, solvents, lubricants,epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 26. State Not Liable for Damage The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. WATER QUALITY CERTIFICATION SPECIFIC CONDITIONS I. Both walkway and pier deck are to be 60%minimum open grate to allow light penetration; install electric to the pier. Located: 1295 Island View Lane, Greenport. SCTM# 1000-57-2-16 Conklin Point Creek is a shallow body of water that is somewhat unique because the water is over privately owned land. There are 7 close neighbors with existing docks/piers in the same part of the creek. At the heart of the considerations are the relatively shallow water depths. To minimize the adverse impact, the previous 02/17/21 proposal was for a float with dredging to maintain the boat and float 30"min. above the marine bottom. The current revised proposal, as approved by DEC, is for a fixed pier with boat lift or cradle to maintain the boat 30" min. above the marine bottom. Objective: Due to physical disabilities, access to our boat, which we have kept in front of our bulkhead for over 26 years, has become increasing difficult and dangerous for us to accomplish. Our goal is to make our boat accessible so we can safely continue using it. At the February 17, 2021 Trustee hearing, our proposal for a floating dock was heard.* Per the notes from that hearing the Trustees found the proposed floating dock with dredging to be of negative environmental significance: "...that all potentially significant environmental concerns have been addressed as noted herein:... " Scope: the proposed dock is comparable to docks on neighboringproperties in an area where docks historically are used,for commercial and recreational purposes. Scope in relation to the riparian rights of shell fishers: The plan allows a standard fixed catwalk to float design that will not impede access for those seeking shellfish and crustacean in season. Environmental upkeep: The dock design projects a usual lifespan of 30 years with limited pile replacement so as to minimize disturbance of the bottom..." Per Trustee Krupski at the hearing: "...your client has made a pretty good effort to try to figure out how to put a dock in this location that would fit within our code, this seem to be an application I would think would be most appropriate to be heard by the DEC first, and upon submission of a DEC permit, the Trustees would move from there, I mean at the face of it we don't see a tremendous issue but it would make sense I think to go through DEC approval first' DEC did not approve dredging, or therefore a float. For over 26 months we worked with DEC and Jennifer Aspell, (Marine Biologist, Marine Habitat Protection)in particular, to find a plan that would both afford us safe accessible access to our boat and minimize the adverse impact to the wetlands. In those regards,DEC has approved the plans submitted herewith for a fixed pier with boatlift or cradle. Essentially the footprint of this proposal is very,similar to that of the one referenced at the 2/17121 Trustees' hearing. The pier length remains at 20' but its width was reduced from 6' to 5',the minimum needed for accessibility. The access walkway was extended from 20' to 24', in order to reach slightly deeper water, and its width increased to 4' for safer wheelchair/walker access. And,the boatlift or cradle at the end of the fixed pier was added to maintain the boat 30" minimum above the marine bottom.
