Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true,and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of a the neighborhood or detriment to nearby properties. The house is part of an or development that makes up the Shingle Hill neighborhood, dating back to 1895. All of the surrounding properties have had various upgrades and changes over the years,but all are in keeping with the neighborhood character. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible. for the applicant to pursue,other than an area variance. The house is an existing non-conforming residence on an existing non-conforming property with frontage on two streets, thereby giving it two front yards, and no side yard. The existing house has a setback of 35.3 feet along Upper Shingle Hill.Road, and an existing rear yard setback of 19.7 ft. I Town Law§267-b(3)(0(3). The variance(s) granted herein are not mathematically substantial, the front-yard setback of 32. 8 feet representing 1.1%o relief from the code. The side yard setbacks, the largest being;20 feet, represents 5.7 % relief from the code. However,the existing residence is closer to the side yard setback at 19.71' None of these variance requests are substantial in nature. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Part of the application called for adding a new second floor over a small, one-story wing of the.existing house (224 sq. ft. — 16' x 14'). This small wing falls almost completely within the legal buildable area, except for 8 sq. ft. that encroaches into the front yard. This small wing would also be incorporated into a larger first floor addition. Once construction began and we were able to more fully inspect the existing foundation of the one-story wing, it was determined that the foundation needed significant repairs, and it was not structurally sound enough to take the load of a new second floor. The decision was made, to replace a portion-of--the- . foundation of this small existing wing. This impacted only two sides of the existing wing. Please see the enclosed drawings for abetter description of this work. The portion of foundation was replaced and is the.exact shape, size and position as the 'existing foundation. A survey was done of the completed foundation and it exactly matches the setbacks as, approved in the zoning variance. New framing on top of the foundation matches the exact footprint of the existing. We would like to bring this change to the board's attention, and ask that it be considered a de minimis action, given that it impacts a very small portion of the overall house, nothing has changed zoning-wise, and it exactly matches what was approved.
