Please be advised that Verizon Wireless'Application is governed by Section 6409(a)of the Middle Class Tax Relief and Job Creation Act of 2012 (the "Spectrum Act"), codified at 47 U.S.C. § 1455(a), which provides, in relevant part, that a: State or local government may not deny, and shall approve, any eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station. (Emphasis added). An"eligible facilities request"is defined as"any request for modification of an existing wireless tower or base station that involves—(A)collocation of new transmission equipment; (B)removal of transmission equipment; or (C) replacement of transmission equipment." See 47 U.S.C. § 1455(a)(2)(A)-(C)(emphasis added). The Federal Communications Commission (the "FCC") Report and Order No. 14-153, 29 FCC Rcd. 12865,' adopted on October 17, 2014 (the "FCC Order"), codified at 47 C.F.R. § 1.6100, provides clarification of the Spectrum Act, and sets forth a 60-day time period for review and approval of applications covered under the same. Verizon Wireless respectfully submits that the Spectrum Act and the FCC Order directly apply to this Application, and require the Town to approve the same as proposed, without the need for a protracted zoning process or public hearing(s). Verizon Wireless currently operates the Communication Facility at the existing monopole located on the Property, which constitutes an existing "wireless tower" within the meaning of the Spectrum Act and FCC Order. As depicted on the construction drawings, and discussed above,Verizon Wireless proposes to modify its Communication Facility by removing and replacing antennas and equipment on the monopole and by removing, replacing and adding equipment on the equipment platform at the base of the wireless tower. As such, Verizon Wireless' Application involves requests for removal, replacement, and collocation'of transmission equipment at the Communication Facility. Further, Verizon Wireless' proposed modifications to the Communication Facility would not substantially change'the dimensions thereof. The top height of the proposed new antennas would be consistent with the top height of the existing antennas, and no portion of the modified Communication Facility will protrude from the edge of the wireless tower by more than twenty feet. Further, the 1 The FCC Order defines"collocation"as"the mounting or installation of transmission equipment on an eligible support structure for the purpose of transmitting and/or receiving radio frequency signals for communications purposes." See FCC Order§ 178. 2 The FCC Order provides an objective standard to determine when a modification will "substantially change the physical dimensions"of an existing"tower," including when:"(1) ... it increases the height of the tower... by more than 10%,or by the height of one additional antenna array with separation from the nearest existing antenna not to exceed twenty feet, whichever is greater... ;(2) ... it protrudes from the edge of the tower more than twenty feet,or more than the width of the tower structure at the level of the appurtenance, whichever is greater ... ; (3) it involves installation of more than the standard number of new equipment cabinets for the technology involved, but not to exceed four cabinets;(4)it entails any excavation or deployment outside the current site of the tower... ;(5)it would defeat the existing concealment elements of the tower... ;or(6)it does not comply with conditions associated with the prior approval of construction or modification of the tower... unless the non-compliance is due to an increase in height, increase in width, addition of cabinets, or new excavation that does not exceed the corresponding "substantial change"thresholds identified above." See FCC Order§ 188;see also FCC Report and Order No.20-153,2020 WL 6501650(FCC October 27,2020). (A modifications to the Communication Facility would not require any excavation or deployment beyond the area of the existing equipment compound. Finally, the proposed modifications would not affect any concealment elements of the existing Communication Facility.' Thus, based upon the foregoing,Verizon Wireless' proposed removal and replacement would"not substantially change the physical dimensions" of the existing Communication Facility, as defined in the Spectrum Act, and as clarified in the FCC Order. Accordingly, the Application constitutes an "eligible facilities request" for a modification to an existing tower, which the Town "may not deny, and shall approve"within 60 days. See,47 C.F.R. Sec 1.600(c)(2). Since approval of the Application is not discretionary under the Spectrum Act, any submission requirements beyond those that establish that the Application pertains to an eligible facilities request are preempted. See,47 C.F.R. Sec 1.6100(c)(1). If everything is in order, kindly issue the building permit for the proposed upgrade to the Communication Facility at your earliest convenience. SUITE 204 1 METUCHEN,NJ 08840 1 732.317.1511 .xw Based upon the following, it is respectfully requested that the Town administratively approve Verizon Wireless' Application without delay. 12865, adopted on October 17, 2014 (the "FCC Order"), codified at 47 C.F.R. Further, the 1 The FCC Order defines"collocation"as"the mounting or installation of transmission equipment on an eligible support structure for the purpose of transmitting and/or receiving radio frequency signals for communications purposes." See FCC Order§ 178. 2 The FCC Order provides an objective standard to determine when a modification will "substantially change the physical dimensions"of an existing"tower,"including when:"(1) ... it increases the height of the tower... by more than 10%,or by the height of one additional antenna array with separation from the nearest existing antenna not to exceed twenty feet, whichever is greater... ;(2)... it protrudes from the edge of the tower more than twenty feet,or more than the width of the tower structure at the level of the appurtenance, whichever is greater ... ; (3) it involves installation of more than the standard number of new equipment cabinets for the technology involved, but not to exceed four cabinets;(4)it entails any excavation or deployment outside the current site of the tower... ;(5)it would defeat the existing concealment elements of the tower... ;or(6)it does not comply with conditions associated with the prior approval of construction or modification of the tower...unless the non-compliance is due to an increase in height, increase in width, addition of cabinets, or new excavation that does not exceed the corresponding "substantial change"thresholds identified above." See FCC Order§ 188;see also FCC Report and Order No.20-153,-2020 WL 6501650(FCC October 27,2020). modifications to the Communication Facility would not require any excavation or deployment beyond the area of the existing equipment compound. The following standard conditions are a general overview of key issues regarding the work product supplied. ' 2. If the existing conditions are not as represented in this structural report or attached sketches, I should be contacted to evaluate the significance of the deviation and revise the structural assessment accordingly. 3. The structural analysis has been performed assuming that the structure is in "like new" condition. No allowance was made for excessive corrosion, damaged or missing structural members, loose bolts, etc. If there are any known deficiencies in the structure that potentially compromise structural integrity, I should be made aware of the deficiencies. If I am aware of a deficiency that exists in a structure at the time of my analysis, a general explanation of the structural concern due to the deficiency will be included in the structural report, but the deficiency will not be reflected in capacity calculations. 4. The structural analysis provided is an assessment of the primary load carrying capacity of the structure. I provide a limited scope of service in that I have not verified the capacity of every weld, plate, connection detail, etc. In most cases, structural fabrication details are unknown at the time of my analysis, and the detailed field measurement of this information is beyond the scope of my services. In instances where I have not performed connection capacity calculations, it is assumed that existing manufactured connections develop the full capacity of the primary members being connected. S. The structural integrity of the existing foundation system can only be verified if exact foundation sizes and soils conditions are known. I will not accept any responsibility for the adequacy of the existing foundations unless this site-specific data is supplied. 6. Miscellaneous items such as antenna mounts, coax supports, etc. have not been designed, detailed, or specified as part of my work. It is assumed that material of adequate size and strength will be purchased from a reputable component manufacturer. The attached report and sketches are schematic in nature and should not be used to fabricate or purchase hardware and accessories to be attached to the structure. I recommend field measurement of the structure before fabricating or purchasing new hardware and accessories. I am not responsible for proper fit and clearance of hardware and accessory items in the field. 7. The structural analysis has been performed considering minimum code requirements or recommendations. If alternate wind, ice, or deflection criteria are to be considered, then I shall be made aware of the alternate criteria. Michael F.
