DESCRIPTION
ALL that certain plot, piece or parcel of land, situate, lying
and being at Southold, in the Town of Southold, County of Suffolk and
State of New York, more particularly bounded and described as follows:
BEGINNING at a point on the southerly side of Terry Court, said Doint
also referred to as the most southwesterly corner of Glover Street,
from said point of beginning:
RUNNING THENCE along the southerly side of Terry Court the following
courses and distances: (a) South 21° 54' 00" West 17.12 feet; (b)
South 61° 13' 20" East 143.57 feet; (c) South 71° 34' 50" East 285.68

My client, Russell E. Mann has elected to withdraw the application
made for a change of zone from Agricultural Conservation to Hamlet
Density. You will recall that at the time the application was
submitted, a filing fee of $500.00 was paid.
Would you please advise whether Mr. Mann will receive a refund of
part of the application fee.

1:00 A.M. - Charles Cuddy, Esq. met with the Board to discuss the proposal of his
lient, Russell Mann, to amend his change of zone petition by requesting the Town
oard to consider the petition as either an R-~0 or Hamlet Density change while
ddressing the SEQR review. Prior to the time of a public hearing a decision can be
ade as to which zone they will ask to be considered. The Town Attorney's office
this request under advisement.
:55 A.M. - Venetia McKeighan, Southold Town's Director of Senior Services, met
with the Board update them on her programs. She said the main thing she has been
doing lately is giving advice on planning for long term health care. Southold Town
is considered a role model for the programs offered. In light of the numerous
programs, Mrs. McKeighan said that is imperative that a determination be made as to
whether the Baxter building in Mattituck is suitable for occupancy and use for those
programs. Supervisor Harris will arrange for Engineering Inspector Richter to inspect
the building. If it is suitable, the Town Board must then make a decision on whether
they should enter into a long term lease or purchase the property.
12:45 P.M. - Recess for lunch.

2:15 P.M. - On motion of Supervisor Harris, seconded by Councilwoman Oliva, it was
Resolved that the Town .Board enter into Executive Session. Vote of the Board:
Ayes: Supervisor Harris, Justice Edwards, Councilman Penny, Councilwoman Oliva,
Councilwoman Latson, Councilman Wickham. Also present: Town Attorney Arnoff,
Assistant Town Attorney Kiernan, Town Clerk Terry.
John Halsey and Andrew Johnsen of the Peconic Land Trust, met with the Board to
present their proposed concepts for the Cove Beach Estates project.4--Following this
discussion the Board set 2:00 P.M., Thursday, November 8,. 1990 for a hearing on
a PBA grievance, and discussed matters that are currently in litigation.
5:00 P.M. - The Town Board audited bills.
5:30 P.M. - Work Session adjourned.

Dear Ms. Terry:
I am in receipt of your letter of October 2, 1990. I appreciate the
Town's prompt handling of Mr. Mann's application. However, since he
also wishes to pursue an application for an R-40 Zoning Use
District, I would ask that the Town Board not further proceed with
the SEQRA EAF Review on the petition for a change to hamlet density.
We would prefer that both proposals be considered together. By
holding this process in abeyance, at the applicant's request, the
Town does not suffer any prejudice.
I do not know now the Town Board arrived at its decision refusing to
consider a petition for change of zone in the alternative. It is
not uncommon to request alternative relief and I do not understand
what harm befalls the Town, as a legislative entity, by permitting
an applicant who owns one parcel to request the Town Board consider
more than one use district where the facts may show either is
appropriate.
Mr. Mann's 10 acre parcel at the Main Road in Southold presently is
in three zoning use districts, this resulted from a single
legislative action. It escapes logical explanation to permit an
applicant to file petitions concurrently providing for alternative
relief but then not allowing the same applicant to file a petition
seek~nG alternative relief. I would appreciate the opportunity to
further discuss this question with the Town Board.

to file a second petition for a different zone, or withdraw your current
petition and file a new one for a specific zone {each would require a new
filing fee and environment review fee, etc.).
Please be advised that prior to receiving your letter of September 11th
I was prepared to present to the Town Board the recommendation of our
environmental consultants with respect to the SEQRA EAF Review on the
Mann petition. I do not feel I can hold this in abeyance any further and
will be presenting it to the Town Board on October 9th.

By this letter I request that the application be amended to

The Planning Board has reviewed Russell Mann's petition to
change the zone of his property on the south side of Terry

The Board decided to hold off preparing a recommendation to

Dear Mr. Orlowski:
I am in receipt of a copy of your memorandum to the Town Clerk
with reference to the change of zone petition of Russell E.
Mann. Certainly I cannot fault the Planning Board for its
expeditious handling of our application; however, I do note that
the application was submitted on June 28, 1990 and that in the
interim the Town Board has requested that an environmental
assessment be completed by its consulting firm, Cramer, Voorhis &
Associates.
Since an environmental assessment had not yet been completed, I
was somewhat surprised that the Planning Board had completed its
review of the application. In addition, since the applicant has
been significantly affected by a recent change of zone on the
ajoining property, I was hopeful that the Board, both as a matter
of procedure and as a matter of courtesy, would permit the
applicant and his attorney to appear to further elaborate upon
the need for a change of zone for the subject parcel.
As you are aware, the applicant lives a stone's throw from the
Town Hall. Yet neither he nor I recelved any notice that this
matter was being considered by the Planning Board. We would both
appreciate the opportunity to appear before your Board to at
least discuss the grounds for the petltion and to have the
opportunity to respond to the Board's concerns.

The Planning Board has reviewed this request and has
determined that the petition should be denied. The reasons for
this recommendation are as follows:
There is no demonstrated need for additional hamlet
density housing in this area.
The additional traffic that would be generated by
this increase in density would have a significant
impact on the intersection of Tucker Lane and State
Route 25.

Dear Mr. Cuddy:
In response to your letter of July 11, 1990 with respect to the Russell
Mann change of zone petition environmental review, I presented the letter
to the Town Board at their July 17th work session.
The Town Board unanimously agreed that they wish to go forward with
the SEORA review of the Long Environmental Assessment Form submitted
by Mr. Mann with his petition, as explained in my letter of July 9, 1990.
Upon receipt of the requested $500.00 for the cost of the review, the
Long EAF will be immediately submitted to Cramer, Voorhis & Associates
who have been engaged to conduct the review on behalf of the Town Board.

Dear Mrs. Terry:
I am in receipt of your letter of July 9, 1990, with respect to
environmental review of the petition for a change of zone
submitted on behalf of Russell E. Mann. Your records will reflect
that the subject parcel is eight (8) acres and located contiguous
to a parcel for which the designation of affordable housing was
approved by the Town Board in May 1990.
The Mann parcel is a level parcel, which within the past few years
has been the subject of a subdivision application. In addition,
the contiguous parcel was the subject of a considerable and
lengthy review by the Town and undoubtedly this included a full
environmental review. With the foregoing in mind I am at a loss
to understand the need to forward the environmental assessment
form for review to any outside agency.
I note that Chapter 44, Environmental Quality Review, of the Town
Code does not require an environmental feasibility review but
merely permits the same at the Town Board's discretion. Under the
circumstances I would ask that this matter again be considered by
the Town Board and that "in house" review be completed based upon
the previous environmental assessments completed for this and the
contiguous parcel.

In accordance with Chapter 44, Environmental Review, of the Code
of the Town of Southold, the Town Board has engaged the services of
Cramer, Voorhis & Associates to review the Long Environmental Assessment
Form submitted by you on behalf of Russell E. Mann with respect to his
petition for a change of zone. The cost of this review is $500.00, and must
be paid prior to the consultant commencing their work.
Please send a check in the amount of $500.00, payable to the Southold

FULL ENVIRONMENTAL ASSESSMENT FORM'
SEQP.
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically e)~pert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow intro~ction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site, By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3t
