Prior to the time of a public hearing a decision can be ade as to which zone they will ask to be considered. The Town Attorney's office this request under advisement. :55 A.M. - Venetia McKeighan, Southold Town's Director of Senior Services, met with the Board update them on her programs. She said the main thing she has been doing lately is giving advice on planning for long term health care. Southold Town is considered a role model for the programs offered. In light of the numerous programs, Mrs. McKeighan said that is imperative that a determination be made as to whether the Baxter building in Mattituck is suitable for occupancy and use for those programs. Supervisor Harris will arrange for Engineering Inspector Richter to inspect the building. If it is suitable, the Town Board must then make a decision on whether they should enter into a long term lease or purchase the property. 12:45 P.M. - Recess for lunch. EXECUTIVE SESSION 2:15 P.M. - On motion of Supervisor Harris, seconded by Councilwoman Oliva, it was Resolved that the Town .Board enter into Executive Session. Vote of the Board: Ayes: Supervisor Harris, Justice Edwards, Councilman Penny, Councilwoman Oliva, Councilwoman Latson, Councilman Wickham. Also present: Town Attorney Arnoff, Assistant Town Attorney Kiernan, Town Clerk Terry. John Halsey and Andrew Johnsen of the Peconic Land Trust, met with the Board to present their proposed concepts for the Cove Beach Estates project.4--Following this discussion the Board set 2:00 P.M., Thursday, November 8,. 1990 for a hearing on a PBA grievance, and discussed matters that are currently in litigation. 5:00 P.M. - The Town Board audited bills. 5:30 P.M. - Work Session adjourned. Mann for Change of Zone Dear Ms. Terry: I am in receipt of your letter of October 2, 1990. I appreciate the Town's prompt handling of Mr. Mann's application. However, since he also wishes to pursue an application for an R-40 Zoning Use District, I would ask that the Town Board not further proceed with the SEQRA EAF Review on the petition for a change to hamlet density. We would prefer that both proposals be considered together. By holding this process in abeyance, at the applicant's request, the Town does not suffer any prejudice. I do not know now the Town Board arrived at its decision refusing to consider a petition for change of zone in the alternative. It is not uncommon to request alternative relief and I do not understand what harm befalls the Town, as a legislative entity, by permitting an applicant who owns one parcel to request the Town Board consider more than one use district where the facts may show either is appropriate. Mr. Mann's 10 acre parcel at the Main Road in Southold presently is in three zoning use districts, this resulted from a single legislative action. It escapes logical explanation to permit an applicant to file petitions concurrently providing for alternative relief but then not allowing the same applicant to file a petition seek~nG alternative relief. Mann Dear Mr. Orlowski: I am in receipt of a copy of your memorandum to the Town Clerk with reference to the change of zone petition of Russell E. Mann. Certainly I cannot fault the Planning Board for its expeditious handling of our application; however, I do note that the application was submitted on June 28, 1990 and that in the interim the Town Board has requested that an environmental assessment be completed by its consulting firm, Cramer, Voorhis & Associates. Since an environmental assessment had not yet been completed, I was somewhat surprised that the Planning Board had completed its review of the application. In addition, since the applicant has been significantly affected by a recent change of zone on the ajoining property, I was hopeful that the Board, both as a matter of procedure and as a matter of courtesy, would permit the applicant and his attorney to appear to further elaborate upon the need for a change of zone for the subject parcel. As you are aware, the applicant lives a stone's throw from the Town Hall. Yet neither he nor I recelved any notice that this matter was being considered by the Planning Board. We would both appreciate the opportunity to appear before your Board to at least discuss the grounds for the petltion and to have the opportunity to respond to the Board's concerns. Mann. Your records will reflect that the subject parcel is eight (8) acres and located contiguous to a parcel for which the designation of affordable housing was approved by the Town Board in May 1990. The Mann parcel is a level parcel, which within the past few years has been the subject of a subdivision application. In addition, the contiguous parcel was the subject of a considerable and lengthy review by the Town and undoubtedly this included a full environmental review. With the foregoing in mind I am at a loss to understand the need to forward the environmental assessment form for review to any outside agency. I note that Chapter 44, Environmental Quality Review, of the Town Code does not require an environmental feasibility review but merely permits the same at the Town Board's discretion. Under the circumstances I would ask that this matter again be considered by the Town Board and that "in house" review be completed based upon the previous environmental assessments completed for this and the contiguous parcel.
