A memorandum offering to limit development of the property to single family residences on one (1) acre lots did accompany the referral from the Town Clerk's office. It is therefore apparent that the determination of the Suffolk County Planning Commission was supportive of single family residences on two (2) acre lots in accordance with existing zoning. MANDEL For a Change of Zone Pursuant to the Southold Town Code section 100-150 MEMORANDUM IN SUPPORT OF PETITION FOR A CHANGE OF ZONE This memorandum is made in support of and is hereby incorporated by reference for the petition for a change of zone to amend the zoning maps on certain property located on Boisseau Avenue, Southold from the present zoning designation of "A Agricultural - Residential" to "M Light Multiple Residence District." The property is more particularly described in Schedule A attached to the petition and is depicted on the survey made a part of this petition. M LIGHT RESIDENCE DESIGNATION IS APPROPRIATE FOR THIS PROPERTY Surrounding Properties are Small Lots The properties in the immediate vicinity of the subject property range in size from approximately 14,000 to 22,000 square feet (See Suffolk County tax map of subject parcel attached hereto and made a part hereof as Exhibit A.) The proposed zoning designation "M Light" requires a minimum lot size of 40,000 square feet. Development of this property as one-acre parcels would not adversely affect the existing properties which are smaller lots. The proposed Master Plan presently under consideration designates the surrounding properties along both Boisseau Avenue and Yennecott Drive as "R-40" requiring lots to bs one acre (40,000 square feet). The purpose of the Low Density Residential R-40 District is to provide areas for residential development where existing neighborhood characteristics, water supply and environmental conditions permit the full development densities of approximately one dwelling per acre and where open space and agricultural preservation are not predominate objectives. Proposed Zoning Regulations of the Town of $outhold Article III-A section 100-30A. This petition for an "M Light" zoning designation is in keeping with the proposed uses and requirements for the surrounding property. The property is served by the Greenport Water District thereby making the increased density feasible. Additionally, a more than adequate supply of water is available on the property itself. The subject property is appropriate for one-acre density in view of the surrounding land uses, the property's proximity to the hamlet of Southold and the availability of water. Property is Within the Hamlet of Southold An "M Light" designation is appropriate for this property because the property is located within one-half (1/2) mile of the Southold hamlet. The proposed Master Plan includes a "Hamlet Density Residential (HD) District, the purpose of which is to permit a mix of housing types and level of residential density appropriate to the areas in and around the major hamlet centers and to promote the provision of lower cost housing in these hamlet and village areas, where provision of utilities exists or may be possible and desirable and where public facilities and commercial activities are available. Proposed Zoning Regulations Town of Southold Article IV section 100-40. While the proposed HD district does not exist, the existing M Light densities and uses are similar and seek the same objectives as the HD district. In fact the proposed zoning ordinance states the HD district is comparable to the existing M District. The property's proximity to the Southold hamlet make the M Light designation appropriate. Properties in the Area Have Been Similarly Developed Properties near the hamlet areas have been developed with similar increased density. In the immediate vicinity of the subject property both Colonial Village and Founder's Village have been developed successfully with increased density, such property uses are in accordance with the proposition that increased densities are appropriate for the hamlet areas thereby leaving other, more appropriate, areas free from development. CONCLUSION For the reasons set forth, it is respectfully requested that the Town Board of The Town of Southold grant the requested change of zone from A-Agricultural-Residential to M Light Multiple Residence on the Petitioner's property.
