Clear invasive vegetation from the pond edge, replace invasive species with native species. Establish a non-disturbance buffer landward of the edge of wetlands as depicted on the attached diagram. Any invasive species in the non-disturbance buffer will also be replaced with native species. Diagram shows a non- disturbance buffer running approximately 40' along the north side of pond where land contours are steep and wooded, and reducing buffer to 10'from edge of wetlands on south side of pond where land contours are flat. Within the 100' wetland zone, a buffer zone will be established around the wetland, defined in Appendix I, where the invasive plants will be removed and native plants restored; landward of the buffer zone will be farmland where flowers will be planted that do not require a lot of tilling, plowing, etc. but need mowing, pruning, irrigation, and harvesting that consists, over the entire farm, of +/- 3 acres of peonies; 1 to 2 acres planted with varying crops such as annual cut-flowers, herbs, vegetables, etc. with soil preparation required each year; 0.5 acres of fruit trees to be planted; and 0.5 acres of raspberries. Appendix II describes the invasives that will be eliminated and the natives that we are considering for the buffer zone. The pond will not be used for irrigation without.prior Trustee's approval; Appendix III provides more information on this topic. Thus, we are asking the trustees for the following: 1. Wetland permit to create a buffer zone between the wetland, 15' to 40' landward and farm the land outside the buffer as described in Appendix I. 2. Appendix II - Invasive Species to be Eliminated and Native Species Being Considered Since the majority of plants in the proposed wetlands buffer zone are invasives, Cole Environmental and the Soil Conservation district recommend clearing out the invasives and restoring the wetlands with native species. They recommend, and we agree, doing this in a slow and steady approach to maximize the opportunity for native plants to flourish. The following invasive species will be removed: • Autumn/Russian Olive (At the edge of the pond) • Porcelain Berry (Blanketing the edge of the pond on top of the Olives) • Mugwort • Privet 9 English Ivy • Multiflora Rose • Black Locust • Miscanthus • Tree of heaven (Ailanthus altissima) Plants under consideration in the buffer zone around the wetlands will be: In the pond: • Cattails • Bulrush • Royal Fern • Water Lily At Pond's edge • Sweet Pepperbush • Highbush Blueberry • Arrowwood Viburnum • Buttonbush 9 Red Maple • Silver Maple • Tupelo FJUN2nF20 Southold Town Board of Trustees Appendix III - Additional Information on irrigating from pond Jason Mulford, CPESC, Principal Environmental Analyst, at New York State Department of Agriculture and Markets, conducted an analysis of the pond and his expert opinion is that pond recharge is fairly quick through means of sub-surface flow and ample reserve of static water." His email is included in this application. He also points out that NY state law allows farmers to make reasonable use of water resources for agricultural purposes and,, given the pond should be able to handle that without compromising its health, it seems only fair to retain that as an option for the future. He also says that once the farm is enrolled in the State Certified Agricultural District (to be done once we buy it) it would have Agricultural District law that would be extended to this parcel. There is also ample historical evidence that the pond can provide plenty of water. It was used for over a century as a 56 acre dairy farm which is a water intensive farming activity. We know that this was the only source of water on the property from the extensive reports/analyses submitted to the township during the construction of the Rock Cove subdivision. For the pond to meet the dairy farm's needs 365 days a year without the family drilling a well shows their confidence in the reliability of the pond as a water source and supports Jason Mulford's conclusion there is an ample reserve of water. They also clearly had the means to drill a well given they built a 40 foot concrete silo for the farm, which still stands. Supplying a 56 acre dairy farm's water needs is much more.significant than supplying a 5 acre flower farm's water needs. The recharge basin just north of the pond,was built during the construction of the Rock Cove subdivision to ensure that all the run-off north of the farm (drainage from over 40 acres of subdivision) was directed into the water table that fed the pond. This supports Jason Mulford's conclusion that there are ample reserves of static water. Also of note is that peonies are a hardy plant that do not have intensive water needs. They require on average 52" of water a year (about an inch a week). NOAA weather data from Orient.Point show that average rainfall there is about 49" a year. The simple math suggests that in most years the peonies will only need about 3" of water from irrigation, about 3-4 weeks a year. This means that the pond should easily handle the needs of the peonies and have time to recharge in the other 11 months of the year. I have identified 1300 Homestead Way Greenport, ny to be Suffolk County parcel 33.-3-19.19. If I am incorrect, please correct me. This parcel does not appear to be located in the county adopted, State certified Agricultural District. Therefore, Agricultural District law would not be extended to this parcel until enrolled. I do find a freshwater wetland/pond on the property. More specifically Freshwater wetland GP-14 N.Y. Comp. Codes R. & Regs.Tit. 6§663.4-Regulatory procedures— See subsection(d)activities chart which explains- Conducting an agricultural activity is exempt in the fresh water wetland and wetland adjacent Areas, as defined in the act or section 663.2 of this Part. I would assume that the water exists due to the shallow water table. Also considering the well-drained nature of the soil, it can be assumed that the pond recharge is fairly quick through means of sub-surface flow and ample reserve of static water. I understand that surrounding homes are not on wells (but Municipal water)and I can be assumed that stormwater only recharges the ground water. If concerns remain, I would encourage a test to see how the pond elevation reacts. Hope this is helpful. Thus, we are asking the trustees for the following simplified "Project Description": Wetlands permit to clear vegetation within 100' of a pond without a change to the topography for use as a Bonafide agricultural operation. Establish and maintain a buffer between the wetlands and the farming activities. The width of the buffer will run along the natural topography for a width of 5' to 25' (scallop shape) as shown on the attached site plan dated 5-15-25 prepared by John Hughes (Appendix I). Within the buffer and wetlands, invasives may be removed and buffers restored with native plants as described in Appendix II. Due to the fact that the pond is hydrologically connected to groundwater,it is highly recommended that the use of pesticides and fertilizers be minimized and that best management practices be utilized if indeed chemicals are needed. Best management involves applying the proper amount of chemicals at the correct time,using split application of nutrients and various other techniques;crop specific recommendations are available from this office. Additionally, it is recommended to establish a grass buffer immediately around the periphery of the pond with a minimum width of 50 feet. This parcel is a 7.5-acre fallow farm currently under the ownership of Douglas Schmieder. An evaluation of the farm pond was requested in order to aid in the decision making process of purchasing the above mentioned property. Observations: At the time of the site visit, the field surrounding the pond was severely overgrown with various weed species;these include black locust,milkweed,goldenrod,multiflora rose,knapweed and pokeweed,among others. A thin layer of algae covered the pond surface. No aquatic plants or weeds were visible. Although the pond depth was not measured, it was estimated to be approximately 2-3 feet. Also of note, is a new residential development that was recently constructed north of the pond extending to the Long Island Sound. The following maps were utilized for this site evaluation and are enclosed for your reference: US Department of Agriculture Soil Survey of Suffolk County, Suffolk County Department of Public Works Topographic map, Suffolk County Department of Health Services Water Table Contours, 2004 Aerial Photography and the National Wetlands Inventory. Additionally,photos of the site are enclosed. Assessment: Upon evaluation of the above-mentioned maps it was determined that the surface elevation of the pond is4.5 feet(1974 data). The groundwater elevation is within the range of 0-3 feet(2002 data). Therefore,the depth to groundwater(from the pond surface)is anywhere from 1.5 ft to 4.5 ft. Based upon this data,it is assumed that the pond is either entirely or partially fed by groundwater. However,updated data is needed to make a more accurate determination;a hydrogeologist or wetland scientist should be contacted to confirm that the pond is groundwater fed. Surface topography indicates that the major portion of the watershed, or the area draining into the pond, extends north to the sound. The pond is fed by this surface runoff flow as well as groundwater, as stated above. Within the past year a new development was constructed in the watershed. As a result surface runoff,which once flowed into the pond,is now diverted into a recharge basin. Therefore,the pond level will likely decrease if it has not done so already. Declining groundwater levels will also cause a decrease in the pond depth. The depth of the pond is inadequate to be self-sustaining. Shallow ponds tend to be eutrophic and slowly over time, through suscession, become bogs and wet woods. Eutrophication is a natural process through which ponds or lakes gradually age and fill in: Optimal depth for a pond is 6-7 feet with a minimum surface area of'/4 acre. From the aerial photo the surface area of this pond is estimated to be 1/10'` of an acre. The overabundance of algae is indicative of excess nutrients and the beginning stages of eutrophication. A possible source of nutrients is residential septic systems and the recharge basin;this pollution is carried by groundwater to the pond. An additional source of nutrients is the groundwater itself; the upper glacial aquifer on the North Fork has high levels of nitrogen. Recommendations: In order to maintain the pond as a pond, it needs to be deeper (6-7 feet deep) and preferably larger(1/4 acre in surface area). To do this,the pond needs to be dug out with a drag line. However, since the pond is listed on the National Wetland Inventory,permits are needed from the Army Corp of Engineers and possibly the Town of Southold and NYS Department of Environmental Conservation. The other option is to leave the pond in its current form and control the algae. Varying success has been achieved using straw barley to control algae growth. The exact mechanisms are not known but as barley decomposes in the water column, it inhibits the growth of algae. Algae placed.in the pond in early spring will provide summer control as it takes several months to break down. Apply barley at a rate of 0.8 ounces per 10 fl of pond surface area. In order to be effective, the straw must be unbundled and placed loosely in a mesh bag with a float. The bag must then be anchored with a brick or some sort of weight. If the straw is allowed to sink to the bottom it will be ineffective. It is also suggested to use an aerator during this process as decompostion of the straw will require oxygen. The land is a -7.5 acre parcel of which about 5.6 acres are preserved farmland, 1.9.acres,can be developed,.and.it has a freshwater wetland of 0.09 acres in the middle of the preserved farmland. The property used to be a dairy farm and in the Planning Board.Subdivision.C&R's it is Agricultural Open Space intended to be farmed. The property has been fallow and we.love the challenge of turning it back into:an operating farm,so we.can become.part.of that community in the North.Fork. We:.have.had a house in Southold for..the.past.12 years and want to_become further involved in.the community:' Caroline has been part of the North Fork:community for the.past 30+ years and :has friends out here and-introduced John to the community in 20'10. ,John's parents have a 92-acne farm.and his father,was an ag teacher.:. J.ohn's family on.both sides were farmers and he has spent time helping on family dairy, agricultural,.and livestock farms in his life. . His nephew;'who has an-agricultural degree,.has a 3007acre farm and family friends have a 15 acre blueberry farm.. We will describe the site plan for farming:activities below. before describing why we need to do these things. A visual depicting this is in Appendix I. Our farm plan-focuses on crops that do not require a lot of tilling, plowing, etc. but are more focused on plant maintenance such as mowing, pruning, and harvesting. The land will be allocated in the following way: 1. Peonies will be planted on about 3 acres because these plants are long lived, require low maintenance, generally need no pesticides, and have a short harvesting season in the spring. 2. Annual cut-flowers will be planted on about 1 acre and these will be changed each year and will require soil preparation each year. Harvest time.will vary depending on the crop. 3. Fruit trees will be espaliered on about 0.5 acre because these are long-term crops that can be managed in a small space and are harvested in the fall. 4. Raspberries will be trellised on about 0.5 acre because these are long-term crops that can be managed in a small space and are harvested in the fall. 5. About 0.75 acre for several hoop greenhouses to be used for starting and growing vegetables or other plants. To do-the above, we will need to do the following essential farming activities on the 5.6 acres of farmland-, including:within the 100' wetlands boundary, which has been flagged-and mapped. If needed, we intend to use Organic options like compost, bone meal, and greens; given that research-shows they work well The cut,flowers planted in this zone will also.be selected using the same criteria: hardy and low=maintenance, generally pesticide free, and responsive to organic fertilizers We will apply compost/fertilizers/sprays under the guidance of the Soil Conservation District in Riverhead, only if necessary. We intend to join the Northeast Organic Farming Association of New York and get certified as an organic farm as part of our farm plan. Since many plants in the 10' buffer are invasives, Cole Environmental and the Soil Conservation district recommend clearing out the invasives and restoring the wetlands with native species. They recommend, and we agree, doing this in a slow and steady approach to maximize the opportunity for native plants to flourish. We hope that the Trustees will agree this is acceptable within the broader context of how we want to preserve agriculture in the North Fork. We will plant peonies and cut flowers to within 10' of the freshwater wetland's boundary. Having spoken with a freshwater wetlands expert at the NY DEC, they say that no permit is needed from them to conduct agricultural activities within the 100' of wetlands such as mowing and planting. If there are peonies and cut-flowers planted and it is clearly a farming activity then it is okay for us to mow, plant, and maintain the plants. What they want is for the space to "not become a lawn" which .is consistent with what we want. The trustees granted, in about 2005, permission to the owner, Thomas Rattler to mow the land within the 100'jurisdiction. The permission included the right to manage the weeds and brambles. In Appendix II there are pictures taken last month of the area around the wetland and some descriptions of the area. These show the extent to which the area is almost entirely weeds and brambles. 2. Pre-submission to.replace the invasives with native plants within 10' of the edge of the wetlands.. This would follow advice from Cole Environmental and the Soil Conservation District to get rid of the invasives and plant native plants at the edges of the wetlands. 3. Pre-submission to mow the area around the pond so planting and restoration can begin this spring. We would like pre-submission to mow within the 10' so-we can have the ground prepared for planting which will occur in March/April. The pond edge would be cleared in a slow and steady approach doing small segments at a time over a multi-year period. The_land is a —7.5 acre parcel of which about 5.6 acres are preserved farmland, 1.9 acres can be developed, and it has a freshwater wetland of 0.09 acres in the middle of the preserved farmland. The property used to be a dairy farm and in the Planning Board Subdivision C&R's it is Agricultural Open Space intended to be farmed. The property has been fallow and we,love the challenge of turning:it back into an operating farm so we can become part of that community in the North Fork. We have had a house in. Southold for the past 12 years and want to become further involved in the community. Caroline has been ,part of the North Fork community for the past 30+ years and has friends out here and introduced John to the community in 2010. John's parents have a 92-acre farm and his father was an ag teacher. John's.family on.both sides were farmers and he has spent time helping on family dairy, agricultural, and.livestock farms in his life.- His nephew,.who has an agricultural degree, has a 3007acre farm and family friends have a 15 acre blueberry farm. We will describe the site plan for farming activities below.before describing why we need to do these:things. A visual depicting this is in Appendix I. Our farm plan focuses on crops that do not require a lot of tilling, plowing, etc. but are more focused on plant maintenance such as mowing, pruning, and harvesting. The land will be allocated in the following way: 1. Peonies will be planted on about 3 acres because these plants are long lived, require low maintenance, generally need no pesticides, and have a short harvesting season in the spring. 2. Annual cut-flowers will be planted on about 1 acre and these will be changed each year and will require soil preparation each year. Harvest time will vary depending on the crop. 3. Fruit trees will be espaliered on about 0.5 acre because these are long-term crops that can be managed in a small space and are harvested in the fall. 4. Raspberries will be trellised on about 0.5 acre because these are long-term crops that can be managed in a small space and are harvested in the fall. 5. About 0.75 acre for'several hoop greenhouses to be used for starting and growing vegetables or other plants. To do the above, we will need to do the following essential farming activities on the 5.6 acres of farmland, including within the 100' wetlands boundary, which has been flagged and mapped. The Suffolk County Department of Soil and Water and Cole Environmental recommend a 10' vegetative buffer around the wetland. The 10'vegetative buffer would not only be adequate and beneficial but will in fact help to restore the wetland's edges because the edges are loaded with invasive species, including: • Autumn/Russian Olive (At the edge of the pond) • Porcelain Berry (Blanketing the edge of the pond on top of the Olives) • Mugwort • Privet •.. English Ivy Multiflora Rose • Black Locust • Miscanthus • Tree of heaven (Ailanthus altissima) Landward of the 10' buffer we will be doing the following: Converting the land from fallow to farmable land (e.g., mowing, tilling, soil. amendment) . Preparing the farmable land for planting (e.g., digging, plowing, trellising etc.) The crops to be planted within 100' of the edge of freshwater wetlands (exclusive of the 10'vegetative buffer) will only be peonies and cut flowers (no fruit trees, berries; or vegetables) Peonies were.chosen because they do not generally require fertilizer or pesticides and are relatively low-maintenance plants with,natural resilience. If needed, we intend to use Organic options like compost, bone meal, and greens, given that research shows they work well The cut flowers planted in this zone will also be selected using the same criteria: hardy and low-maintenance, generally pesticide free, and responsive _ to organic fertilizers We will apply compost/fertilizers/sprays under the guidance of the Soil Conservation District in Riverhead, only if necessary. We intend to join the Northeast Organic Farming Association of New York and get certified as an organic farm as part of our farm plan. Since many plants in the 10' buffer are invasives, Cole Environmental and the Soil Conservation district recommend clearing out the invasives and restoring the wetlands with native species. They recommend, and we agree, doing this in a slow and steady approach to maximize the opportunity for native plants to flourish. We hope that the Trustees will agree this is acceptable within the broader context of how we want to preserve agriculture in the North Fork. We will plant peonies and cut flowers to within 10' of the freshwater wetland's boundary. Having spoken with a freshwater wetlands expert at the NY DEC, they say that no permit is needed from them to conduct agricultural.activities within the 100' of wetlands such as mowing and planting. If there are peonies and cut-flowers planted and it is clearly a farming activity then it is okay for us to mow, plant, and maintain . the.plants. What they want is for the space to "not become a lawn" which is consistent with what we want. The trustees granted, in about 2005, permission to the owner, Thomas Rattler to mow_the land within the 100'jurisdiction. The permission included the right to manage the-weeds and brambles. In Appendix II there are pictures taken last month of the area around the wetland and some descriptions of the area.. These show the extent to which the area is almost entirely weeds and brambles. 2. Pre-submission to replace the invasives with native plants within 10' of the edge of the wetlands. This would follow advice from Cole Environmental and the Soil Conservation District to get rid of the invasives and plant native plants at the edges of the wetlands. 3. Pre-submission to mow the area around the pond so planting and restoration can begin this spring. We would like pre-submission to mow within the 10' so we can have the ground prepared for planting which will occur in March/April. The pond edge would be cleared in a slow and steady approach doing small segments at a time over a multi-year period. The surveyor has advised us that he cannot complete the survey unless the perimeter of the lot is made accessible. I am attaching the 2003 survey prepared for a prior owner. I highlighted it in yellow where neighbors appear to have cleared and installed fences. The parcel was cleared previously but is now heavily overgrown. In accordance with our meeting with yourself and our contractor, Gerard Orientale, Soundside Landscaping Inc., we advised you that we need to clear the underbrush around the perimeter of the property to prepare a survey. No trees will be cut down. You requested a letter with a copy to the Planning department, the Trustee's and Town Attorney's office (code enforcement). Mr. Orientale found that clearing the property line for the purposes of surveying will require in some areas heavy-duty brush cutting equipment. He also found that neighbors installed property line fences and dumped yard waste behind their fence and piled the yard waste onto the subject property. The dumping has continued for many years and now would require a small bulldozer to remove or push away from the property line the yard waste which has piled up behind the fence and along the property line. The equipment capable of clearing the brush will clear an area from 5 feet (width of the equipment) to 15 feet (connected vines & shrubs), depending on the degree of dumping and vegetation. This step is for surveying purposes only. This parcel has a "pond" depression which according to previous soil and water surveys is fed by groundwater. We had Cole Environmental inspect and flag the area they could access by land and with drones. The wetlands are, at the closest point, more than 160' to any property line. Therefore, any activity along the property line for the purpose of preparing a survey is not in the Trustee's jurisdiction. I met with the Trustees and the Trustees acknowledged that their involvement is not required for this purpose. Please note that once the survey is prepared, we will return to the Trustees and Planning Board to address the farm use and prepare the land for cultivation and planting. In anticipation of calls from the neighbors inquiring as to any activity on the property, we are notifying your office as well as the Planning Department, the Trustees and Town Attorney's office. Romeine CLERK OF S If f iLWAHTY L D000112:06 F 157.5 Caroline Fish &John Hughes 29 Palisade Ave Piscataway, NJ 08854 July 30, 2024 To President Goldsmith and Southold Town Trustees: We are in the process of buying the land at 67925 County Road 48, Greenport Town of Southold, NY, also referred to as Lot 19 Rockcove Estates. The land is a —7.5 acre parcel of which about 5.6 acres are preserved farmland, 1.9 acres can be developed, and it has a freshwater wetland of 0.09 acres in the middle of the preserved farmland. The property used to be a dairy farm and in the Planning Board C&R was given the rights to continue farming. The property has been fallow and we love the challenge of turning it back into an operating farm so we can become part of that community in the North Fork. We have had a house in Southold for the past 11 years and want to become further involved in the community. Caroline has been part of the North Fork community for the past 30+ years and has friends out here and introduced John to the community in 2010. John's parents have a 92 acre farm and his father was an ag teacher. John's family on both sides were farmers and he has spent time helping on family dairy, agricultural, and livestock farms in his life. His nephew, who has an agricultural degree, has a 300 acre farm and family friends have a 15 acre blueberry farm. We are asking the trustees for permission of the following activities that need to be undertaken for the farm to operate successfully: 1. Wetland permit to conduct agricultural activities within the 100' of the pond. 2. To mow the area around the pond so planting can begin. 3.. To have a barn, greenhouses, a gate, fencing, and needed equipment to be stored on the preserved farmland. Which are likely greater than 100' from the edge of the pond. We will describe the site plan for farming activities below before describing why we need to do these things. A visual depicting this is in Appendix I. Our farm plan focuses on crops that do not require a lot of tilling, plowing, etc. but more focused on plant maintenance such as mowing, pruning, and harvesting. The land will be allocated in the following way: y' 1. Peonies will be planted on about 3 acres because these plants are long lived, generally require low, maintenance, and have a short harvesting season in the spring. 2. Annual cut-flowers will be planted on about 1 acre and these will be changed each year and will require soil preparation each year. These may also be rotated with other annual crops such as vegetables, herbs, etc. Harvest time will vary depending on the crop. 3. Fruit trees will be espaliered on about 0.5 acre because these are long-term crops that can be managed in a small space and are harvested in the fall. 4. Raspberries will be trellised on about 0.5 acre because these are long-term crops that can be managed in a small space and are harvested in the fall. 5. About 0.75 acre for several hoop greenhouses to be used for starting and growing . vegetables or other plants. To accomplish these agricultural activities and turn the land into a working farm we will need to do the following: - mow and plant near the pond, - maintain the crops near the pond, - have a barn for equipment, - have several greenhouses, and - add a gate to the Homestead Way entrance to protect equipment. Thus, we are asking the trustees for the following: 1. Wetland permit to conduct agricultural activities within1OO' of the pond. Our request is compatible with the Trustee requirements and the NY DEC requirements. It is allowed for existing farms and we hope that the Trustees will agree this is acceptable within the broader context of how we want to preserve agriculture in the North Fork. The trustees granted, in about 2005, the permission to mow the land within the 100' of the pond to manage the weeds and brambles. In Appendix II there are pictures taken last month of the area around the wetland and some descriptions of the area. These show.the extent to which most of the area is almost entirely weeds and brambles. Having spoken with a freshwater wetlands department at the NY DEC, they say that no permit is needed from them to conduct.agricultural activities within the 100' of the freshwater pond such as mowing and planting. If there are peonies, cut-flowers, or fruit trees planted and it is clearly a farming activity then it is okay for us to mow and plant. What they want is for the space to "not become a lawn" which is consistent with what we want. 2. A permit to mow the area around the pond so planting can begin this fall. Peonies and raspberry canes need to be planted in the fall so we would like a permit to mow within the 100' so we can have the ground prepared for planting which will occur in October. 3. A permit, if necessary, to have a barn, greenhouses, and a gate at the property. Equipment will be needed for mowing and planting and it needs to be kept secure so we are asking for this to ensure we will be able to plant this fall.
