Box 1179 Eric Sepenoski J Southold, New York 11971 Liz Gillooly Telephone(631) 765-1892 Elizabeth Peeples • a® Fax(631) 765-6641 c®UNT`1,� BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD May 30, 2025 Kathryn Sommo Roux Associates 209 Shaffer Street Islandia, NY 11749 RE: SHM GREENPORT LLC, BREWER YACHT YARD @ GPT., INC. 300 ROBINSON ROAD, GREENPORT SCTM# 1000-34-5-7 Dear Ms. Sommo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, May 14, 2025 regarding the above matter: WHEREAS, Roux Associates on behalf of SHM GREENPORT LLC, BREWER YACHT_ YARD @ GPT., INC. applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated December 17, 2024; and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations; and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards;, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 14, 2025, at which time all interested persons were given an opportunity to be heard; and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area; and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application; and, 2 WHEREAS, the proposal of SHM GREENPORT LLC, BREWER YACHT YARD @ GPT., INC. seeks to remove 156 linear feet of existing wooden bulkhead and replace with new vinyl sheeting bulkhead and raised 18" above existing bulkhead height to match adjacent bulkhead; three existing floating finger docks (460sq.ft. total), and seven (7) existing timber pilings to be removed and will not be replaced; install 253sq.ft. (547sq.ft. within Village of Greenport, total 800sq.ft.) of one new 8' wide floating dock; within Town jurisdiction install 200sq.ft. of two (2) 20'x5' new gangways; and to install 14 new timber pilings in new locations to secure the new floating dockage; and, WHEREAS, the property was granted a pre-existing non-conforming use by Certificate of Occupancy #Z-17514 with attached plans depicting existing structures on the property. WHEREAS, per Southold Town Code Chapter 280-121 (A) Non-Conforming Uses: Except as provided hereinafter, nonconforming use of buildings or open land existing on the effective date of this chapter or authorized by a building permit issued prior thereto, regardless of change of title, possession or occupancy or right thereof, may be continued indefinitely, except that such building or use: A. Shall not be enlarged, altered, extended, reconstructed or restored or placed on a different portion of the lot or parcel of land occupied by such use on the effective date of this chapter, nor shall any external evidence of such use be increased by any means whatsoever. WHEREAS, the property is in an R-40 zone, and as per Southold Town Code Chapter 280-17 Use Regulations: In an R-40 District, no building or premises shall be used and no building or part of a building shall be erected or altered which is arranged, intended or designed to be used, in whole or in part, for any uses except the following: A. Permitted uses: M Same as § 280-13A of the Agricultural-Conservation District, except that wineries are excluded. Per Southold Town Code Chapter 280-13A, the project proposed is not a permitted use in this zone. WHEREAS, per Southold Town Code Chapter 275-11-C-(2)-[1]: Docks. Standards for residential and commercial docks; general rules. It shall be the policy of the Town of Southold that all docks shall be designed, constructed and located so as to reduce a dock's potential adverse impacts to navigation, public safety, waterway congestion, access to public trust lands and water, and natural resources and habitats. 3 The following standards will serve as a basis for granting, denying, or limiting permits for the construction of docks. u No dock shall be constructed, altered or removed without a permit issued by the Southold Town Trustees. In determining whether to approve such application, the Trustees shall consider the factors contained in § 275-11C(2)(d) below and all other provisions of this chapter; and, WHEREAS, per Southold Town Code Chapter 275-11-C-(2)-(b)-[1]: Dock locations and lengths. No dock shall be erected or extended if, in the opinion of the Trustees, such structure would adversely affect navigation, fisheries, shell fisheries, scenic quality, habitats or wetland areas; and, WHEREAS, per Southold Town Code Chapter 275-11-C-(2) — (d): Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: I1 Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; 2L Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities; I1 Whether the dock will unduly interfere with transit by the public along the public beaches or foreshore; ML Whether the dock will significantly impair the use or value of waterfront property adjacent to or near the dock; I1 Whether the dock will cause degradation of surface water quality and natural resources; LE Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; EL Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass (Zostera marina) and widgeon grass (Ruppia maritima) or shellfish; L Whether the dock will unduly restrict tidal flow or water circulation; ILL Whether the dock will be safe when constructed; M01 Whether the dock will adversely affect views, viewsheds and vistas important to the community; I��L 4 Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and I1 Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service; and, WHEREAS, the proposed project is not a permitted use under Chapter 280 of the Southold Town Code; and, NOW THEREFORE BE IT RESOLVED, that the Board of Trustees DENIES the application of SHIM GREENPORT LLC, BREWER YACHT YARD @ GPT., INC. to remove 156 linear feet of existing wooden bulkhead and replace with new vinyl sheeting bulkhead and raised 18" above existing bulkhead height to match adjacent bulkhead; three existing floating finger docks (460sq.ft. total), and seven (7) existing timber pilings to be removed and will not be replaced; install 253sq.ft. (Roux) is providing this application for the Town of Southold Wetland Permit on behalf of SHM Greenport, LLC for the bulkhead replacement and dockage modifications for Safe Harbor Marina—Stirling, located at 1410 Manhasset Avenue,Village of Greenport, Town of Southold, Suffolk County, New York, as shown on Figure 1. The goal of the proposed dock replacement is to rearrange the docks to accommodate a larger range of boat sizes, and to improve the functionality and aesthetic look of the marina. The proposed bulkhead replacement is being completed as part of marina typical operation and maintenance to provide protection of upland resources from erosion and flooding. The work is proposed to begin in November 2025 through December 2028. The proposed marina work.includes the removal of 1,830 square feet(SF)of floating dock for installation of 900 SF of new floating dock, and installation of 100 SF of gangways. In addition, a total of 127 linear feet of wooden bulkhead will be replaced with new vinyl sheeting bulkhead, and a proposed addition of 10 linear feet of retaining wall. General Construction Approach The on-Site crane currently used for boat removal and maintenance will be used to lift floating docks into and out of the water to be loaded for transport, or installed per the proposed design plan. The bulkhead replacement will be completed in-place of the removed bulkhead. Silt booms/turbidity curtains will be installed prior to the initiation of bulkhead demolition work. Excavators or equivalent heavy machinery will be used to remove and replace soil around bulkheads in preparation for bulkhead replacement. During bulkhead installation, a 2-foot buffer zone will be excavated from the bulkhead walls, extending approximately five feet deep, this material will be replaced to the excavation upon construction completion. Backfill to increase the height of the bulkhead will be taken from wateiward recovery of spilled material and elsewhere along the top of bulkhead. No imported materials will be used as backfill during construction. A barge-mounted pile driver will be used to remove and install timber pilings. A support barge.will be used to install floating dock components.
