Rich III, Chairman (L Members of the Planning Board Date: May 7, 2025 Re:: Request for Exemption from The Interim Development Law for New Construction of Resorts, Hotels, Motels in the Town of Southold. SCTM# 1000-122.-6-22.1 & 28 The Planning Board has reviewed this request for a waiver from the moratorium and recommends disapproving the exemption request. In April of 2024,the Southold Town Board adopted a Local Law entitled"A Local Law to Impose or Temporary Suspension on the Review, Approval and/or Issuance of all Permits for or Relating to New Development of Resorts, Hotels or Motels" (Appendix A). The intent of the local law was to levy a moratorium to conduct a study to review and consider amendments to the Southold Town Code pertaining to the zoning classification and comprehensive planning for motels and hotels. A study analyzing and making recommendations on hotels, motels, and inns is in draft form. The goals of this study include: 1. Identify the current definitions and zoning districts pertaining to motels and hotels. 2. Conduct an analysis on the number of existing motel and hotels. 3. Conduct an analysis on the number of existing Bed and Breakfast uses. 4. Identify and discuss environmental impacts from hotels. Southold Town Planning Board Page 2 May 6,2025 5. Identify and discuss community character impacts from hotels, constraints. 6. Identify the appropriate zoning classifications for hotels, including recommending new use types that will mitigate impacts from hotels. 7. Recommend hospitality formats and opportunities more consistent with the Southold Town Comprehensive Plan goals and objectives. The Development of Hotels. Motels and Inns and the Consistency with the Southold Town Comprehensive Plan. The Southold Town Comprehensive Plan is the official public document used to guide the development of the community and provides the basis for zoning and other land use regulations found in the Town Code. The current zones where a motel or hotel is permitted and bulk schedule do not fully align with the comprehensive plan goals outlined in Chapter 3 Land Use &Zoning; Chapter 4 Transportation& Infrastructure; Chapter 5 Community Character; Chapter 6 Natural Resources & Environment; Chapter 7 Economic Development; Chapter 8 Housing; Chapter 9 Agriculture and Chapter 12 Natural Hazards for various reasons however, one of the most poignant is the threat to community character. Further, there are many new challenges to remodeling and constructing motel/hotel buildings in town and on the waterfront. Location and physical threats are the most limiting, such as flooding, high seasonal groundwater, wetlands, groundwater source supply, presence or absence of protected species and cultural resources, and limited infrastructure and transportation networks. Other issues are created by past building construction and the ability to gain adequate access and meet changing firematic protection and zoning regulations. It is recommended that the Town Board address the existing and developing threats to motel/hotel build-outs by amending the Southold Town Code to implement the goals of the Southold Town Comprehensive Plan prior to proceeding with applications.
