Dear Ms. Neville-
Please be advised, in furtherance of my last
correspondence to you in this matter, that the applicant is
amending Paragraph 2 of his rezoning petition to the
following:
Existing Zone- "R-80" - Residential Low Density
Proposed Zone- "B" - General Business, with the
simultaneous filing of a covenant restricting the property
to only such uses as would be permitted in and regulated by-
(a) Section 100-3IA(I) through (3), (B), and (C) of the
Agricultural-Conservation Zone; and
(b) Section 100-10iA(4) and of the General Business
Zone.
Please deem our petition and the accompanying documents
amended accordingly.
The purpose of this amendment is to limit the extent of
the downzoning to purposes desired by the applicant which
would not detract from the character of the area without
opening use of the property to any use permitted in the B
zone, while still maintaining the ability to use the
property in accordance with R-80 permitted uses. It is
believed that the proposed restrictions will minimize any
adverse impact on the surrounding area.

Town Board
Attached is a petition signed by 21 people residing in the town
of Southold who oppose the zoning of residential property to
business zone. The property is owned by C. Terry & Marion G.
Lathams located on County Road 48 Peconic. The Lathams
application list the reason for a change of zone Residential
"R-80" to" LB" Limited business. That the applicant is
unable to obtain a reasonable return on his investment. The
Lathams purchased the properties June 1996 and were fully aware
this property is zoned Residential" R-80".
The property on the east side of Lathams zoned "LB'Limited
business has been business since 1968. Property to the west
is zoned "R-80" Residential.
This request is for spot zoning and should be denied.

Dear Mr.Forrester
Once again I request you to enforce the Town
Zoning Code regarding the Latham,s property in Peconic on County
Road 48.( using R 80 residential property for business use)
Sound Shore Excavating Ce.is utilizing (LB) business property
for storage of heavy earth moving equipment and displaying large
signs with no permits in a business zone that does not allow
such use.( Rte 48 and Ackerly Pond Road Southold.
In my last meeting with you on the morning of July 27, you
insisted that the Town of Southold has a policy that once a
notice is given to anyone who is in violation of the zoning
code makes an attempt to rectify the matter by filing for a
zone change. The Town does nothing to enforce the code while
the application is being processed The Town informs me there
is no such policy.
Please remember owning a home in a nice neighborhood is a part
of what this country is about. The storage of heavy earth moving
equipment and construction material drastically changes the
characteristics of the neighborhood.

3. Such request is made for the following reasons:
1. The premises is sandwiched between a high-speed highway and the railroad track
making it unsuitable and undesirable for low density residential use.
2. In addition, the property is bounded on the entire eastern boundary by property
zoned Limited Business, next to which is located the Public Works Facility of the
Suffolk County Department of Highways. The property is bounded on the West by a
landscaping business and storage facility which will not be adversely affected by
the proposed change in zone.
3. The applicant is unable to obtain a reasonable return on his investment given the
current zoning classification.
4. The proposed use will not significantly change from the prior use of the property
or that of surrounding properties.

State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT FORM
SEQR
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically ~xpert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full E^F is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It p~'ovides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

1. The premises is sandwiched between a high-speed highway and the railroad track
making it unsuitable and undesirable for low density residential use.
2. In addition, the property is bounded on the entire eas£ern boundary by property
zoned Limited Business, next to which is located the Public Works Facility of the
Suffolk County Department of Highways. The property is bounded on the West by a
landscaping business and storage facility which will not be adversely affected by
the proposed change in zone.
3. The applicant is unable to obtain a reasonable return on his investment given the

Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine

3. Such request is made for the following reasons:
1. The premises is sandwiched between a high-speed highway and the railroad track
making it unsuitable and undesirable for low density residential use.
2. In addition, the property is bounded on the entire eastern boundary by property
zoned Limited Business, next to which is located the Public Works Facility of the
Suffolk County Department of. Highways. The property is bounded on the West by a
landscaping business and storage facility which will not be adversely affected by
the proposed change in zone.
3. The applicant is unable to obtain a reasonable return on his investment given the
current zoning classification.
4. The proposed use will not significantly change from the prior use of the property
or that of surrounding properties.

Sutfolk County Department of Highways. The property is bounded on the West by a
landscaping business and storage facility which will not be adversely affected by
the proposed change in zone.
3. The applicant is unable to obtain a reasonable return on his investment given the

or action may be significant The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureabJe. It is also understood that those who determine
