Krupski from "A" Residential and Agricultural District to "B-I" General Business District. The Legal Notice of Hearing on Proposals to Amend Zoning Ordinance was read by Councilman Rich. Pursuant to Section 265 of the Town Law and Requirements of the Building Zone Ordinance of the Town of Southold, Suffolk County, New York, public hearing will be held by the Southold Town Board in the office of the Super- visor, 16 South Street, Greenport, New York, in said Town on the 22nd day of January 1074, on the following proposal to amend the Building Zone Ordinance (including the Building Zone Maps) of the Town of Southold, Suffolk County, New York. 7:30 p.m. (D.S.T.) by changing from "A" Residential and Agricultural District to "B-i" General Business District, the property of Isadore P. Krupski, situated at North Side Middle Road, County Road #27, Cutchogue, New York, and more particularly bounded and described as follows: BEGINNING at a point at the northwesterly side of Cox Lane running thence from said point or place of beginning along land now or formerly of Mattituck Gun Club, Inc., north 51° 53' 00" east 756. Krupski, relative to change of zone from "A" Residential-Agricultural to "B-i" Heavy Business on certain property situated at Cutchogue~ New York. IT WAS RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board denial of the change of zone from "A" Residential and Agricultural District to "B-I" Heavy Business for the reason that this change would not conform to the Development Plan. The Planning Board will not approve business development on County Road 27 in this area. /s/ John Wickham, Chairman November 5, 1973 To: Southold Town Planning Board Dear Mr. Wickham: Pursuant to the requirements of Sections 1323 to 1332 of the Suffolk County Charter, the Suffolk County Planning Commission on December 5, 1973 reviewed the above captioned zoning action and after due study and deliber- ation disapproved this change of zone because of the following: 1. It is inconsistent with the Town Master Plan which designates this area for residential development and wherein it states that "Commercial ribbon development should be . absolutely prohibited along County Rte.27"; 2. It is lnconslstent with the pattern of zon ing in the locale and therefore must be considered as "spot zoning"; 3. It would tend to establish a precedent for the further perpetuation of undesired strip commercial development along the county roadway, adversely affecting the safety and traffic carrying capacity of said facility; 4. Public Hearing -4- January 22, lU74 Supervisor: Is there anyone else who wishes to speak in favor of granting the change? Is there anyone who wishes to speak in opposxtion? Is there anyone who wishes to speak either way? Has everyone had the opportunity to speak znto the minutes of this meeting? The following letter was read from the League of Women Voters of Riverhead. January 22, 1974 To: Southold Town Board Generally speaking the League of Women Voters believes that spot-zoning should be avoided by the Town of Southold. With regard to the piece of property for which a zoning change from AR to B-I is requested, it is interesting to note that the map showing Proposed Zoning Regulations for the entire area north, north-east and north-west of Cutchogue indicates an AR zone. The Development Plan Map shows the block occupied in part by the Town Disposal Ares as industrial. Both maps were prepared by Raymond and May. We do not at this time recommend changing this piece of property from fiR to B-1 for the following reasons: Business development should occur as near as possible %o present community business centers There is other B-1 property available at the present time There seems to be some confusion as to what the Town's Development Plan actually proposed Further depletion of or inroads on farming areas should be discouraged /s/ Jean H. Txedke V.P. for Community Affairs Mr. Krupski: I don't understand when people come up with spot-zoning. I don't consider this spot-zoning. I can see if I was trying to change on 27 in Peconic. In this situation I really think it is a hardship. There zs industrial around it, sand pits, labor camps and gun club. I don't see how they can label that spot-zoning. Supervisor: North of it, east of it and south of it is all AR. Mr. Krupski: The gun club is AR? Supervisor: Yes. Does anyone have anything further to add? I call the hearing to a close. The Board will review the comments and make a determination in the near future.
