Dear Mr. Terry:
On August 20, 1959, as agent for Angelos and Evelyn Kalimtgis
I filed petition #64 for a change of zone pertaining to plot
located on the westerly line of Bay Avenue, East ~arion, N. Y.
At the same time I tendered my check in the amount of $25.00
representing fee for change of zone and received your receipt
~643.
Subsequently, I received your letter dated December 9~ 1959,
wherein it w~s stated that the description of the lot as it
appeared in the petition was incorrect. Further, on the tele-
phone the Town Attorney contended that a new petition would
have to be filed and that the owner and purchaser of the plot
were required to join in the petition.
The owner has refused to comply and has now decided not to pro-
ceed with the sale.
Under the circumstauces and in accordance with our recent dis-
cussion will you please close your file on this matter. I shall
appreciate a refund in m~ name of the fee pai~ in consideration
of withdrawal of the petition.
Thank you for your cooperation in disposing of this matter.

and it was th~ determ~.nmtion of the Town Attorney that
an amended application shoulu be made using corrected
description ~f +~ lot and indicating whether Mr.
F. alimtgis actually owns the lot or has it under con=
tract.
I regret the n~c~!ty of having to reflle this
application but it is t~e opinion of the Town Attorney
it mUst be done ~is '~,y. Euc]_o~ed are a set of
application forms together with the desoription supplied
by Otto Van Tuyl and Son Novemb~.r 12~ 1959 which you
left at this office to apply to the a~plieation on
file.
The Town Board will meet again on December 30th
and if the application is received by then it will
be reprocessed at that time.

taken by the Southold Town Planning Board at its meeting on
October 6, 1959:
In the matter of the petition of Angelos Kalimtgis
and Evelyn Kalimtgis, 88010 139th Street, Jamaica~ L.I.~ New
York, for a change of zone from "A" Residential and Agricultral
District to "M" Multiple Residence Districi on certain real
property situated at Bay Avenue, East Marion, New York, and
more particularly bounded and described as follows: Begin-
ning at a point on the southwesterly line of Bay Avenue about
950 feet southeasterly from the Main or State Road and extending
thence along lands now or formerly of W. Brown S.58o15~20"W.
150.15; thence alone lands of W. W. Washburn, et al S. 3Wo12'
~O"E. 112.5 feet; thence along lands now or formerly of Frost

Our investigating team has surveyed this vicinity
and find that there are many motels~ cabins~ tourist houses~
duplexes, and in general two ou~ of every three dwellings on
this road are used for summer rental to tourists and the like.
