the Supervisor's Office, 16 South Street,Greenport, New York.

NOTICE OF HEARING ON PROPOSAL TO AMEND THE ZONING ORDINANCE.
PURSUANT TO SECTION 265 of the Town Law amd requirements of
the Building Zone Ordinance of the Town of Southold, Suffolk
County, New Yor, public hearing will be held by the Southold Town
Board in the office of the Supervisor, 16 South Street, Greenport,
New York, in said Town on the 12th day of April, 1977, on the
following proposal to amend the Building Zone Ordinance (including
the Building Zone Maps) of the Town of Southold, Suffolk County,
New York.
7:45 p.m. by changing from "A" Residential and Agricultural
District to "B-I" General Business District the property of Jotmu
J. Hurter situated at Southold, New York, and more particularly
bounded and described as follows: BEGINNING at a point on the
westerly side of Town Harbor Lane, which point lies S. 31° 31' 10"
E. a distance of 252.86 feet from the intersection formed by said
westerly side of Town Harbor Lane and the southerly side of Main
Road; running thence from said point of beginning along the land
of Mattessich and the land of Schelin, S. 63° 13' 10" W., a

The following action was taken by the Southold Town Planning
Board at a regular meeting held February 7, 1977.
RESOLVED to recommend to the Town Board denial of the
petition of John J. Hurter requesting a change of zone from "A"
Residential and Agricultural District to "B-l" General Business
District on certain property at Southold, New York, based on the
fact that it would not conform with the established depth of
business-zoned property in the Town of Southold.

Supervisor: You have heard the reading of the notice of the
application, the proof of publication in the official paper of
Southold Town and one additional paper, notice that it was posted
on the Town Clerk's Bulletin Board, the Suffolk County Planning
Board's recommendations for leaving it to local determination with
no comments, the Southold TownPlanning Board recommending denial.
The hearing is now open to the applicant or his representative
that wishes to speak.
Edward Boyd, Esq., Southold: Good evening, gentlemen, Edward Boyd,
Southold, for the applicant. As you gentlemen can see, you have a
map of this property before you, it is a most unusual situation.
The line which divides the residential and the business property
cuts in two the property of the applicant. As it presently stands,
the applicant has a small business which is directly on the
dividing line between the "B" Business zone and the "A-l" Residential
zone. What we are attempting to do through this application for a
change of zone, is to put all of the rear area of applicant's
property within the "B-l" Business zone. The amount of property
that actually would be affected by this is not terribly large.
Although the application states that it is 12,000 plus square feet,
with the additional 30 feet of "B-l" Business zone given pursuant
to Section 100-22d of the Southold Town Code, we are really talking
about only an additional 6,000 square feet that we are asking to
have reclassified as "B" Business zone as opposed to "A-l". I
