SUPERVISOR KLIPP: The next parcel we will consider
is the petition of Veronica Frohne. The petition reads as
follows:

In the Matter of the Petition of Veronica Frohne for a
change, modification or amendment of the Building Zone
Ordinance of the Town of Southold, Suffolk County, New York.
TO THE TOWN BOARD OF THE TOWN OF SOUTHOLD:
I, Mrs. Veronica Grohne, residing at Silvermere Road,
Greenport, N. Y., Suffolk County, the undersigned, am the
owner of certain real property situated at SllvermemRoad,
Greenport, and more particularly bounded and described as
follows:
Beginning at a pipe set at the northeast corner of
this property at Sllvermere Road a distance of 350' to a
bay on the east, a distance of 80 ft. on the bay to the
west line, a distance of 320 ft. on the west line and a
distance of 88 ft. on an angle to Silvermere Road, then a
distance of 18'6" to point of beginning.
I do hereby petition the Town Board of the Town of
Southold to change, modify and amend the Building Zone
Ordinance of the Town of Southold, Suffolk County, New York,
including the Building Zone Maps heretofore made a pa~t thereof,
as follows: Change this property from "A" Residential and
Agricultural to "B" Business District.
Such request is made for the following reasons: We wish
to install multiple dwelling units on this location.
We have owned this property for thirteen years, and
have hsd s few rental units which we have operated for twelve
years. We wish to improve and expand these existing units.

SUPERVISOR KLIPP: This petition was referred to the
Planning Board for their investigation and recommendations
and at this time I will read you the report of the Planning
Board:
This is to certify that the following action was taken by
the Southold Town Plsnning Board on December 3, 1957:
Petition of Mrs. Veronica Grohne of Silvermere Road,
Greenport, N. Y., for s change of zone from "A" Residential
and Agricultural to "B" Business District that property
described as follows:
Beginning at a pipe set at the northeast corner of this
property at Silvermere Road a distance of 350' to the Bay on
the esst, a distance of 80, on the Bay to the west line,
a distance of 320' on the west line and a distance of 88'
on an angle to Silvermere Road, then a distance of 18.6" to
point of beginning.
Request is made in order to install multiple dwelling units

and to improve and expand these existing units.
It was the determination of the Planning Board that they
recommend to the Town Board mpproval of this change of zone.
This is signed by John Wickham, Chairman, Southold Town
Planning Board.
SUPERVISOR KLIPP: At this time are there any persons
present who wish to be heard in favor of this change in zone.

SUPERVISOR KLIPP: Are there any persons who wish to
be heard in opposition to?
AUGUST SEIGER (2 West 14th Street, Huntington Station):
I bought this property about 1947. It is adjacent to Mrs.
Frohne's property. And I bought this property here Just for
the purpose of relaxing and for a summer home. I have a
here
seasonal homeAright now I permanently reside in Huntington
Station. However, I bought this home, as I said before, for
relaxation, and now when I hear this man wants to open this
for business I think it is infringing on my rights. I think
it is against my purposes that I originally bought this house
for, and I don't think that -- I mean the Zoning Board
established this as Residential and that is the way I would
like to keep it, ms m residential piece of property. That
is all I have to say about it.
DONAI~ ROACH (Greenport~ NY): I would like to find out
one or two things. By zoning this piece of property as

Business you have no subdivisions in your building or business
zoning? In other words, any type business can go in there in
the future?
SUPERVISOR KLIPP: Any type provided for in the ordinance,
yes.
MR. ROACH: I am not too familiar with the zoning.
SUPERVISOR KLIPP: Not shy type of business.
MR. ROACH: In other words, a fishing station or restsur-
ant~ or anything like that could go in there?
SUPERVISOR KLIPP: One or two family dwellings could go
in there. Hotel, motel, boat houses, similar establishments,
undertaking establishments, etc.
MR. ROACH: I own the property on the west side of Mrs.
Frohne'So Originally we bought that property with the ides
of developing it with small summer bungalows, some of which we
intended to rent, which I do. Originally it was my Dad's
and then he passed on and I have taken over. Now, I don't
know, I am afraid with ell this business, if it were just
Mrs. Frohne that was going to expand there, but there are
other people that will find it out. And we don't know what
is going to happen in the future. Although I have no objection
to what Mrs. Frohne has there now you people know that Mr.
Geraslno has started to construct a motel. That was before
the zoning took effect, so there is nothing we could do
about it. I feel myself that we are getting away from what

that property was originally bought for, and by zoning that
business we would be changing the character of that property
down in the whole area.
I will say this, that if the Board decides on granting
this application to change the zone I will immediately apply
to have all my property changed, while my own personal
feeling is that the character of the area has been changed.
I will apply to have it zoned business, but as it stands
right now, I would rather not take the chance. I would like
it to remain as it is.
MR. SEIGER: At this moment I think that it is a little
unfair to the adjacent owners of the property that they are
not notified of any of these variances that come up. Where
I come from in Huntington, each person is notified by mail
within a 200 ft. radius of any property that is under dis-
cussion, and I would like to go on record, I would like to
suggest to the Board that they notify each person by mail.
It was Just by coincidence that a neighbor of mine told my
wife about this thing. We have no way of knowing about it
but by subscribing to our local papers, which we don't, because
we are seasonal residents. I would like to go on record that
the Board should make some amendment or adjustment to let
everybody know about these variances.
SUPERVISOR KLIPP: I might point it out that it is a
fine gesture to notify people by postal cards, but as far

as the law is concerned, we are only required to advertise
in the official paper of the Town. I am not in any way
connected with the newspaper business. I think where we
have active zoning, which many of the people wanted, and
any of the people, I am not referring to you, that are
interested in the affairs of the Town should subscribe to
the local paper and keep tract of these things. I am not
advertising the local papers.
MR. SEIGER: There is no object for any of us to
subscribe to the local papers.
SUPERVISOR KLIPP: I think your local interest ia in
your home.
MR. SEIGER: That I will grmnt, but if these folks were
notified by mail of any impending variance it would be better
for everyone concerned.
SUPERVISOR KLIPP: I think that you have a splendid thought
and I had the idea myself.
MR. SEIGER: I had no idea at all until some neighbor
told me about it. That is the only indication I had.
SUPERVISOR KLIPP: When you get into the post card
business it is like sending out invitations, you miss somebody.
MR. PRELLWITZ: If the point is pertinent, I worked for
six years on the Zoning Board at Warwick. They had a standard
procedure of mailing post cards to property owners within 200'
of the property in question and also putting a legal notice in

the papers as you do, but this gentlemen is quite right;
very few people dig into the legal notices. They should but
they don't.
MR. SEIGER: These are public hearings. It does not
concern people within 1OO and 200 feet. We have come from
miles around to put on a campaign.
SUPERVISOR KLIPP: That's right. The ones most vitally
concerned are adjacent property owners.
M}{. SEIGER: I Just don't want you to overlook something.
MRS, SEIGER: When we bought that piece of property
we were told that it was private residence and that there
would not be anything around there. Now, Mrs. Frohne comes
along and has five living quarters and has only 80 ft. of
beach. In the summer time it is Jammed with these people.
We have a problem with the sewers. What are we gr'[nj to do
if she puts more motels there?
SUPERVISOR KLIPP: May I ask when you bought the property?
MRS. SEIGER: 1947.
SUPERVISOR KLIPP: And you were told at that time that
it was residential?
MRS. SEIGER: Yes, sir.
SUPERVISOR KLIPP: Well, then that must have been deed
restricted. In 1947 you had no zoning. Now, at the time you
you
bought the property whoever sold it to you told^it was
restricted residential property?

MR. SEIGER: No, there was no restriction at all, but
we had the understanding that it was a private piece of
property; Just a summer place for people to relax.
SUPERVISOR KLIPP: That is nice to tell someone, but
in 1947 you would not have been given an opportunity, with
no zoning, to be heard if he built a mo~d or anything else
in there, unless you had a restriction in your deeds.
MRS. SEIGER: Still he has five houses there now with
80' of beach. I tell you, it is Just Jammed. What are they
going to do? Are they going to come over on our 80'?
When we come there two days our lawn is covered with beer
cans and everything.
SUPERVISOR KLIPP: As I say,there is nothing the matter
wi~h the world, it is the people that are in it.
MRS. SEIGER: That is just as you state it, it is there.
That is what we are afraid of.
MR. ROACH: Is there any possibility in the future that
we could have this subdivided, the Business zone we could
get a division so as to let us have a summer resort motel
and a summer cottage for rental?

MR. ROACH: I think the main reason is that they are
changing the character of this neighborhood there and I am in
opposition to that.
SUPERVISOR KLIPP: Any other person wish to speak?

MR. SEIGER: Has the Board taken into the consideration
the parklng facilities that he has to provide?
SUPERVISOR~KLIPP: He would ha~ to provide parking
facilities.
MR. SEIGER: It would have to be offstreet?
SUPERVISOR KLIPP: Oh, sure, it would have to be offstreet.
MR. SEIGER: I can't see how he could have e motel
there and provide parking.
SUPERVISOR KLIPP: If there is no other person appearing
in favor of or in opposition to, we will close the public
hearing.
