THIS INDENTURE, made as of the 1111 day of March, 2025,
BETWEEN EMILY JEAN OLINKIEWICZ, residing at 28A South Menantic Road,
Shelter Island, New York 11964, as Executrix of the Estate of Kathleen
M. Reeve a/k/a Kathleen Mary Reeve, late of Mattituck, County of
Suffolk, New York, deceased, who died on the 8th day of September, 2024,
party of the first part, and,
JOHN T. REEVE, residing at 1055 Bennetts Pond Lane, Mattituck, New York
11952, as to an undivided 50% interest,
party of the second part,
WITNESSETH, that whereas letters testamentary were issued to the Executrix by the
Surrogate's Court, Suffolk County, New York, on December 4, 2024, Pale No. 2024-3602/A, and
by virtue of the power and authority given in and by said last will and testament, and/or
by Article 11 of the Estates, Powers and Trusts Law, and in consideration of No Dollars,
paid by the party of the second part, does hereby grant and release unto the party of the
second part, the distributees or successors and assigns of the party of the second part
forever, in and to
ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being at Mattituck, Town of Southold, County of
Suffolk, and State of New York known and designated as Lot No. 6, on "Map of Bennett's
Pond, at Mattituck, Town of Southold, Suffolk County, New York", filed in the Suffolk
County Clerk's Office on June 12, 1970 as Map No. 5483.
TOGETHER with an undivided one-tenth (1/10th) interest in two strips of land shown and
designated as "Park" on the "Map of Bennett's Pond" filed in the Suffolk County Clerk's
Office on June 12, 1970 as Map No, 5483. SUBJECT to a maintenance charge not to exceed
$10.00 in any one calendar year for the upkeep of said park areas.
TOGETHER with a right of way in common with others for ingress and egress over the roads as
shown on the "Map of Bennett's Pond" filed in the Suffolk Clerk's Office on June 12, 1973
as Map No. 5483, to the nearest public highway.
SUBJECT to covenants and restrictions of record affecting the premises.
BEING and intended to be the same premises as conveyed to party of the first part by Deed
dated December 21, 1987 and recorded in the Suffolk County Clerk's Office on December 28,
1987 in Liber 10503 at Page 330.
Following this conveyance, John T. Reeve will be the owner of a 100% interest in the
property.
TOGETHER with all right, title and interest, if any, of the party of the first part in and
to any streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and also all the estate which the said decedent had at the
time of decedent's death in said premises, and also the estate therein, which the party of
the first part has or has power to convey or dispose of, whether individually, or by virtue
of said will, or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party
of the second part, the distributees or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever,
except as aforesaid.
Subject to the trust fund provisions of Section 13 of the Lien Law.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
