It is our 2nd annual event,and with your support we will again have an event that supports safety on our waters! We have made a concerted effort to increase the opportunities for residents,and non-residents,alike,who enjoy our waters either by boat or other related activities and to comply with"Brianna's Law". We look forward to our expanded plans to have on-site demonstrations for various water-related activities, and hands-on teaching,to make a fun and informative event for all ages. Whereas Southold USCG Auxiliary, Flotilla 014-1808 will emphasize to the public: Be Safe! Take the use of safety equipment seriously. Stay alert for unexpected changes in weather conditions. Be prepared when boating after dusk with proper lights. Know the effects of alcohol consumption while out on the water. Education! Take a Boating Safety Course in compliance with"Brianna's Law", which is now in effect. Completion results in the issuance of a card which must be onboard while out on the water. Vessel Safety! As a free service of the USCG Auxiliary,Vessel Safety Checks are offered for boaters to ensure their vessel is up-to-date and in compliance with USCG regulations. As you all are aware,water-related rescues impact our volunteers from our fire departments, EMT's,and Officers in the Police Department. At times, helicopters are required to assist, and hospital care is needed following rescues. We deeply care about our residents and visitors who only want to enjoy their outings with family and friends. Yet,we truly see the need for community awareness regarding their safety. (It will be situated well behind the flagpole). The main tents will be for the distribution of flyers, pamphlets and booklets for the many faceted educational information the Coast Guard and Auxiliary have to offer. Dockage for Coast Guard vessel(s) and private boats for VSC will be coordinated with the Harbor Master. • The Opening Ceremony will take place in front of the USCG Auxiliary tents. • There will be 4 portable tables set up on either side of Auxiliary tents for purposes of teaching skills, registering for BSC, and joining the USCGAUX. • A tent and folding chairs for musicians • On the grassy area, activities for all ages, demonstrating lifesaving, VHF radio, Watch Standing, kayak/paddleboard safety. Visitors will receive "if found" stickers for their watercraft. • Trailered boat(s) /jet ski will be located, as approved, to the rear of the Aux tents, near the stony area. Supervision supplied by Aux and/or Greenport FD. • Set-up from 6:30 am-8:45 am. Breakdown and removal of all equipment, all areas completely cleaned, to commence at 4pm and be completely clear by 5:30 pm. Please see attached arial view of Mitchell Park. The Town Board of the Town of Southold hereby finds and determines that Southold Town's aquifer system is not infinite and is the only water source available to meet the needs of the Town's population. This Board further determines that approximately 70% of the water pumped is used for outdoor purposes including landscape irrigation.As much as 50% of this water is wasted due to overwatering caused by irrigation methods and system inefficiencies. The Board also finds that smart devices such as irrigation controllers and rain sensors can significantly reduce the water needed to irrigate turf and prevent overwatering.As such, the Board has determined that installing water-efficient irrigation systems also reduces overwatering and soil runoff, which is essential to maintaining and extending our Town's water supply, especially during peak use. Therefore, this law establishes requirements for all residential and commercial lawn/turf and garden irrigation systems to preserve, conserve, and manage our groundwater resources. Section 2. Definitions. As used in this law, the following terms shall have the meaning indicated: AUTOMATIC IRRIGATION SYSTEM -An automatic underground, aboveground, or grade- level system that allows or provides a means to apply controlled,amounts of water to land for irrigation. BACKFLOW PREVENTION DEVICE—A safety device used to prevent pollution or contamination of the water supply due to the reverse flow of water from the irrigation system. BEST MANAGEMENT PRACTICE (BMP)—A design or practice employed with the primary objective of minimizing adverse water quality impacts, preserving beneficial features onsite, avoiding downstream erosion and habitat loss, maintaining natural base flows and groundwater recharge, preventing downstream flooding, providing multiple uses of drainage and stormwater drainage facilities, and/or provide for the economical, safe and aesthetically pleasing drainage system for development. CONTRACTOR-Any;person, business, firm, partnership, corporation, or any other entity of its agents or employees who install, program, and maintain, including installing a system or repairing an irrigation system. DROUGHT-TOLERANT PLANTING—A planting that can survive on minimal'water from natural rainwater. (See Cornell University Integrative Plant Species Guidance Documents.) EVAPOTRANSPIRATION-BASED ("ET") CONTROLLER—A controller calculates soil moisture from known weather and related inputs.An ET-based controller: a. receives and monitors weather data or onsite environmental conditions including, but not limited to, solar radiation, wind speed, temperatures, relative humidity, rainfall, and soil moisture; and b. calculates or determines the amount of moisture input to and moisture lost from the soil and plant; and c. automatically creates or adjusts the irrigation schedule to apply only the amount of water necessary to maintain adequate soil moisture. HIGH-WATER USING PLANT—A plant requiring regular irrigation for adequate appearance, growth, and disease resistance. LOW-VOLUME IRRIGATION—The application of irrigation water at low pressure through a system of tubing or lateral lines and low-volume emitters, which may include but are not limited to drip, driplines, micro-sprayers, and bubblers and which target small volumes of water at or near the root zone of plants. LOW-WATER-USING PLANT—A plant that can survive throughout the year with little irrigation and is semi-drought-tolerant. RAIN SENSOR or RAIN SENSING SHUTOFF DEVICE—A wired or wireless communication device with an automatic controller that shuts off the irrigation system when it rains. RUNOFF AND OVERSPRAY The irrigation system shall deliver water at a rate compatible with the site's soil types and infiltration rates.All irrigation systems shall be designed to avoid runoff, low head drainage, overspray, or other similar conditions where water flows onto adjacent property, nonirrigated areas, walks, roadways, or structures. Proper irrigation equipment and schedules, including features such as repeat cycles,shall be used to match maximum application rates to infiltration rates closely. INVASIVE SPECIES —Non-native (or alien)to the ecosystem under consideration and whose introduction causes or is likely to cause economic or environmental harm or harm to human health. RAIN SENSOR DEVICE—A low-voltage electrical or mechanical component placed in the circuitry of an automatic landscape irrigation system designed to restrict the sprinkler controller's operation in the event of precipitation. SOIL MOISTURE DEVICE—A soil-based device that assesses the available plant soil moisture to minimize the unnecessary use of water and optimize the effectiveness of an irrigation system. SOLE SOURCE AQUIFER-An aquifer designated by the United States Environmental Protection Agency ("EPA") as the sole or principal source of drinking water for the area above the aquifer and including those lands where the population served by the aquifer live; that is, an aquifer which is needed to supply 50% or more of the drinking water for that area and for which there are no reasonably available alternative sources should the aquifer become polluted. SUSTAINABLE LANDSCAPING—Quality landscapes that conserve water and protect the environment, are adaptable to local conditions and are drought-tolerant. The principles of xeriscape include planning and design, appropriate choice of plants, soil analysis, which may include the use of solid waste compost, efficient irrigation, practical use of turf, appropriate use of mulches, and proper maintenance. US EPA"WaterSense"-A voluntary partnership program sponsored by the United States Environmental Protection Agency ("EPA") for both labeling water-efficient products and providing a resource for assisting in water conservation efforts to encourage water efficiency through the use of special "WaterSense" labeled appliances and plumbing fixtures. WEATHER-BASED IRRIGATION CONTROLLER-An onsite weather station, a rain sensor device, soil moisture device, or an Evapotranspiration-Based ("ET") controller as defined herein, certified by the United States Environmental Protection Agency ("EPA") as a "WaterSense" irrigation controller. Section 3. General Requirements. A.All automatic irrigation systems installed after the effective date of this chapter shall be equipped with an ET controller with a minimum of one rain sensor device, soil moisture device, or an onsite weather station.Any device installed pursuant to this section must be properly installed, maintained, and operated in accordance with manufacturer specifications. B.After the effective of this chapter, a contractor or property owner who activates, installs, repairs, or conducts routine maintenance on automatic landscape irrigation systems shall not activate such system unless that system is equipped with a minimum of one rain sensor device, soil moisture device, or an onsite weather station. C.All contractors who install or activate automatic landscape irrigation systems shall provide written documentation to the system's owner stating that the system is in compliance with this chapter. D. The use of water for irrigation purposes for lawns, shrubs, trees, plants, and vegetation of any type is permitted only under the following rules and regulations: 1.Application must be made to the Town, and approval must be granted before installing any new equipment required by these rules and regulations. 2.All existing underground irrigation systems, whether automatically or manually time controlled, and any new underground irrigation system installed after the adoption of these rules and regulations must comply with the following: (a)An adjustable pressure regulating valve and pressure gauge shall be installed on the irrigation system's water pipe. The valve shall be set to maintain inlet water pressure at a level not to exceed five (5) pounds per square inch above the manufacturer's rated pressure for the lowest pressure-rated sprinkler head in use in the irrigation system. (b) Sprinkler heads shall be placed so that the overlap areas under irrigation from adjacent sprinkler heads shall be minimal. Special sprinkler heads shall preclude water application on paved areas or areas not requiring irrigation. E.Automated systems. (1) Premises with automatic ON-OFF time-controlled underground irrigation systems or other systems controlled by automatic ON-OFF time-controlled devices may irrigate for a maximum of two (2) hours between 12:00 midnight and 5:00 a.m. on even-numbered days for those with even-numbered street addresses and on odd-numbered days for those with odd-numbered street addresses. (2) Said automatic systems shall be equipped, with rain sensing devices and/or soil moisture devices that automatically shut down the irrigation system after or during rainfall or when the soil moisture conditions indicate that further irrigation is not required. F. Manual systems. (1) Premises without automatic ON-OFF time-controlled underground irrigation systems and all manually controlled systems may irrigate for a maximum of two (2) hours between 5:00 p.m. and 11:00 p.m. on even-numbered days for those with even-numbered street addresses and on odd-numbered days for those with odd-numbered street addresses. (2) Irrigation water shall not be applied during periods when it is raining or when the soil moisture content is adequate for plant growth without further water addition. G. Premises where irrigation is manually controlled and nonautomatic and is accomplished by the use of manually held garden hoses or using hose-fed aboveground sprinkler units that are placed and/or moved by hand or water pressure shall comply with Subsections E(1) and F and shall not apply irrigation water to paved areas or other areas that do not require irrigation. H. Those with no street address shall be considered evenly numbered according to these rules and regulations. Section 4. Site improvements and development projects are subject to water conservation landscape requirements. A. This article shall apply to all of the following development applications/projects: (1) Application for a building permit for the new development of a single-family, two- family, or multifamily residential structure or an addition, renovation, alteration, or improvement of an existing single-family, two-family, or multifamily residential structure, increasing square footage by 25% or that increases the existing lot area coverage by 25% or greater; and (2) Application for a subdivision, that includes the development of a residential lot and all landscaped areas; and (3) Application for site plan and special permits, including applications for expansion of existing commercial and industrial sites. B. The following development applications/projects are exempt from the requirements of this article: (1) Agricultural and horticultural commerce (for example, commercial activities, such as farming of grains, wine grapes, vegetables, fruit and nut trees and other agricultural crop production; greenhouses; nurseries; and floriculture facilities); and (2) Plant collections, as part of botanical gardens and arboretums, open to the public; and (3) Ecological restoration projects and (4) Community gardens open to the public. Section 5 -Water conservation landscape requirements. A. All applicants seeking a permit or approval of a site improvement or development project identified herein shall provide a landscape design to include and be installed meeting the following criteria: (1) All landscape designs shall employ best management practices and include a minimum of 15% of the total landscaped area xeriscape or drought-tolerant or low-water-using plantings of the total landscaped areas and (2) All landscape designs that include the installation of irrigation system(s), be it at the time of issuance of the building permit or at any and all times after issuance of building permit, shall adhere to the following requirements: (a) Low-volume irrigation shall be used in all landscaped areas less than eight feet in width in any direction; mulched areas; areas within 24 inches of a nonpermeable surface unless no runoff occurs or the adjacent nonpermeable surface drains entirely to permeable surfaces capable of admitting and retaining the irrigation runoff; and, on slopes greater than 25% (where "25%" means one foot of vertical elevation change for every four feet of horizontal length), unless an alternative design having the effect of low-volume irrigation (e.g., micro-sprayers) and which will avoid runoff and erosion is approved by the Director of the Planning and Building Department, Planning Board or Town Board; and (b) Smart irrigation controllers shall be required for all irrigation systems and must be able to accommodate all aspects of the design. Individual controllers irrigating an area of 10,000 or more square feet shall be installed with a rain sensor(s), which shall be installed appropriately (e.g., in a location suitable for detecting rain without interference from structures and irrigation spray) and (c) Irrigation systems shall not be planned, installed, or operated to permit water to spray on public sidewalks, paved areas, or neighboring parcels. No underground piping shall be laid within the Town highway right-of-way; and (d) Nothing in this section shall be construed to limit, restrict or prohibit irrigation of any sort which is accomplished by obtaining water by means that would not deprive or otherwise retard recharge of the US EPA designated sole source aquifer system under the Safe Water Drinking Act. B. The landscape design package referenced in this section shall be prepared by an architect, landscape architect, or certified nursery professional licensed by New York State in good standing, containing and satisfying the conditions and elements above, and submitted with the building permit application, site plan application, special permit application or subdivision application. Notwithstanding the above, applicants seeking a building permit for an addition, renovation, alteration, or improvement of an existing single-family, two-family, or multifamily residential structure increasing square footage by 25% or increasing the existing lot area coverage by 25% or greater shall not be required to retain an architect or landscape architect and instead the applicant may prepare and submit a landscape plot plan, depicting the location of planting and identification of plant/tree species. C. The Director of Planning may require a site plan, special permit, or subdivision applicant to submit a copy of the water budget calculations needed for the project as part of the landscape design plan. D. Upon approval of the landscape design plan, the applicant shall be required to file a covenant agreeing to maintain it in conformance with generally acceptable landscaping practices and standards. The applicant shall authorize periodic inspections upon reasonable notice. This covenant shall run with the land in perpetuity and shall be binding upon any successors in interest. Section 6. Exemptions. The provisions of this chapter shall not apply to land used in agricultural production and agricultural operations, for nurseries and garden centers, or at golf course tees, greens, and fairways. Section 7. Enforcement. The Building Inspector, Code Enforcement Officer and/or Ordinance Inspector shall all be responsible for the enforcement of this chapter. Section 8. Penalties for offenses. A.A violation of the provisions of this chapter shall be issued only after notice of noncompliance and warning to cease illegal operations has been properly served and an opportunity to cure, not to exceed thirty days, has been provided. B.Any contractor or property owner violating the requirements of this chapter shall, upon conviction thereof, be subject to a fine not exceeding $1,000 for each violation. In such circumstances,the county or local municipality shall also have the right to disconnect the service line from the irrigation system pending compliance. C.Any contractor or property owner violating the requirements of this chapter shall, upon the second or subsequent conviction within five years of the first conviction, be subject to a fine not exceeding $2,500 for each subsequent violation. In such circumstances,the county or local municipality shall also have the right to disconnect the service line from the irrigation system pending compliance. Section 9. Severability. If any clause, sentence,paragraph, subdivision, section,or part of this law or the application thereof to any person, individual, corporation, tinn,°partnership, entity„ or circumstance shall be adjudged by any court of competent jurisdiction o be invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the re winder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section, or part of this law, or in its application to the person, individual, corporation, firm, p rttt rship, entity, or circumstance directly involved in the controversy in which such order or judgment shall be rendered.
