And I 11 see in today ' s printed manual , 294 is a 12 different agenda, a resolution item. 13 The one this morning stated that the 14 festival was on May 4th, Saturday . So we can start . 15 (Whereupon, the meeting continued 16 on to the Resolutions at this time . ) 17 * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * 18 BESS MORATORIUM 19 TOWN CLERK DENIS NONCARROW : This 20 public hearing considers an introductory 21 Local Law Number 4 of 2025 to enact a 22 12-month extension of a temporary 23 moratorium on the issuance of approvals 24 and/or permits for battery energy 25 storage system facilities . Legal APRIL 15, 2025 REGULAR MEETING 6 1 notices for this public hearing are 2 published no less than 10 days prior to 3 the public hearing in an eligible legal 4 town newspaper . The Town Clerk ' s Office 5 has received the signed affidavit of 6 service from this newspaper, indicating 7 that the notice was properly published . 8 The application requires notice to the 9 Suffolk County Planning Commission . The 10 Town Clerk file includes the response of 11 that Planning Commission dated April 8 , 12 2025 , conditionally approving the 13 proposed local law, but requiring the 14 Town to return every three months to 15 report on the status of the updates to 16 code provisions and to request an 17 additional three month extension of that 18 moratorium . The proposed action was 19 referred to the Planning Department for 20 a secret determination . And the action 21 was considered a Type II Action under 22 SEQRA, not requiring a further review 23 and exempt from LWRP Review pursuant two 24 Chapter 268 . The Town Clerk file also 25 includes an Affidavit of Posting of the APRIL 15, 2025 REGULAR MEETING 7 1 public notice on the Town Clerk ' s 2 bulletin board at Town Hall . Finally, 3 letters in support of the proposed Local 4 Law have been received from the group 5 for the East End, dated March 26, 2025 , 6 and from the Southold Town Planning 7 Board dated April 11 , 2025 . Both of 8 which have been made part of the record . 9 TOWN ATTORNEY PAUL DECHANCE : And 10 Mr . Supervisor, the notice documents are 11 in order . 12 SUPERVISOR AL KRUPSKI JR . : Thank 13 you . All right, everything ' s in order . 14 We can begin the hearing . Would anyone 15 like to comment on this public hearing? 16 LUCIA YU : Good evening, Supervisor 17 Krupski and members of the board . My 18 name is Lucia Yu and I ' m a project 19 developer at Key Capture Energy . KCE is 20 a New York based developer, owner and 21 operator of utility scale battery 22 storage systems with the first 23 operational project in New York as well 24 as the largest . Respectfully, we 25 believe that the proposed moratorium APRIL 15, 2025 REGULAR MEETING 8 1 extension significantly hinders the 2 Town ' s goals of promoting sustainability 3 and transitioning towards clean energy . 4 KCE urges the Town to limit the 5 moratorium extension to three months , 6 which is similar to the recommendation 7 provided by the Suffolk County Planning 8 Commission . Battery energy storage is 9 critical to ensuring that Long Island 10 residents and businesses have a reliable 11 and stable electric grid . BESS will not 12 only ensure that locally generated 13 renewable energy is consumed locally, 14 but will also benefit ratepayers by 15 keeping energy costs low . There are a 16 number of technical reports showing the 17 value of energy storage . The Long 18 Island fossil peaker replacement study 19 completed in 2020 examined Long Island ' s 20 aging power plants and found that it is 21 feasible and cost effective to replace 22 more than 2 , 300 of the 4 , 300 megawatts 23 of peaker plants with energy storage by 24 2030 . Based on historic emissions data 25 from 2016 to 2018 , Long Island ' s peaker APRIL 15, 2025 REGULAR MEETING 9 1 supply produces 2 . 65 megatons of carbon 2 dioxide . 2 , 000 tons of nitrogen oxides , 3 and 600 tons of sulfur dioxide annually . 4 The Southold peaker plant, located just 5 five minutes down the road, was found to 6 produce almost 2 , 000 tons of carbon 7 dioxide every year . This is equivalent 8 to emissions from 4 . 8 million miles 9 driven by an average gasoline powered 10 car . Replacing these peaker facilities 11 with green energy will have tangible 12 health benefits for this community . 13 Over the next decade, fossil fuel peaker 14 replacements could also save LIPA 15 customers as much as $ 393 million . 16 Regarding the fire code updates with the 17 State, the State ' s Interagency Fire 18 Safety Working Group issued draft fire 19 code recommendations in July of 2024 . 20 The code is in the process of being 21 finalized and will be implemented 22 statewide . All proposed BESS projects 23 on Long Island are being designed to 24 incorporate these new codes and KCE is 25 ready and willing to meet any final APRIL 15, 2025 REGULAR MEETING 10 1 standards that are required . We 2 appreciate the town for recognizing the 3 benefits that a standalone battery 4 storage law will provide residents and 5 developers . We urge that the moratorium 6 be limited to three months and that the 7 Town Board stay engaged with pursuing 8 the law during this time . I ' d like to 9 note that the Town of Riverhead was in a 10 similar position where they planned to 11 postpone the BESS Law due to ongoing 12 zoning code updates and updates to their 13 comprehensive plan . Amidst public 14 pushback, they finalized their BESS code 15 prior to the zoning code changes , and 16 there ' s no reason that the same cannot 17 be done here . Thank you for your time 18 and consideration . 19 SUPERVISOR AL KRUPSKI JR . : Thank 20 you . Would anyone else like to speak? 21 Alix O ' Mara? Welcome . 22 ALIX O ' MARA: Good evening . My 23 name is Alix O ' Mara and I ' m a member of 24 Friends of Oregon Road . We strongly 25 support extending the moratorium. As APRIL 15, 2025 REGULAR MEETING 11 1 you ' ll recall , approximately 1 , 300 2 people joined to oppose the BESS on 3 Oregon Road prior to the enactment of 4 the moratorium. And Since then, we ' ve 5 only learned more about the dangers of 6 these developments . It would make no 7 sense to end the moratorium prior to the 8 Town finalizing a new zoning code that 9 protects Oregon Road . But just as 10 significant is the fact that the draft 11 code prepared by the Town ' s Task Force 12 is woefully deficient, and therefore 13 does a disservice to the Town Board and 14 to the residents of Southold . The Task 15 Force did not adequately researched the 16 dangers of these projects . 17 Specifically, of the 12 purported 18 experts that the Task Force interviewed, 19 8 were paid by the best industry . The 20 ninth, a former fire chief who 21 supposedly was unbiased, states on his 22 LinkedIn profile that he ' s paid by 23 Suffolk County to promote pilot 24 projects . And the remaining three 25 people had no expertise in the sector . APRIL 15, 2025 REGULAR MEETING 12 1 It didn ' t even occur to the Task Force 2 to meet with East Hampton officials just 3 down the road following the fire there 4 two Summers ago . Our community deserves 5 better . The January BESS fire at Moss 6 Landing in California, which then 7 reignited a month later, serves as just 8 the latest warning to our community of 9 the extreme environmental dangers these 10 supposedly green projects pose . 11 Specifically, 1 , 200 residents were 12 evacuated, and thousands of residents 13 were sickened following the fire . 14 Researchers at UC Santa Cruz announced 15 in March, three months after the fire , 16 the dangerous levels of nickel , cobalt, 17 and manganese were detected in dust 18 samples from the surrounding area . 19 According to the National Institute of 20 Health, manganese and cobalt are 21 neurotoxins . And nickel is a 22 carcinogen . Residents near the BESS are 23 advised to wear masks as they dust their 24 homes and to not disturb the soil in 25 their yards . The cleanup is likely to APRIL 15, 2025 REGULAR MEETING 13 1 take years . The proposed BESS is 2 adjacent to prime agricultural land . A 3 fire such as the one at Moss Landing 4 would render that land unsafe for 5 farming . These chilling facts are 6 enough to prove that our community 7 should be protected from these 8 developments that don ' t have enough 9 potential benefit to justify exposing us 10 to the environmental hazards . Since the 11 moratorium was first enacted, towns 12 across the country, including in New 13 York State , have voted to ban these 14 developments entirely because they pose 15 a threat to public health, safety, and 16 welfare of the residents and their 17 property . Let us learn from the 18 environmental catastrophes caused by 19 BESS ' , and let us learn from what other 20 towns are doing . These projects if they 21 belong anywhere, should be sighted far 22 away from homes schools hospitals and 23 environmentally sensitive areas . We 24 urge the Town to continue the 25 moratorium . My name 9 is Anne Murray . I ' m representing the 10 North Fork Environmental Council , and 11 we ' d like to say that we support 12 extending this moratorium and we think 13 it ' s wise and prudent of the Town Board 14 to wait on this whole BESS issue until 15 the zoning code is updated . Just a note to the public that 4 we have not yet received any feedback on 5 that proposed process or on the draft 6 recommendations that we submitted . That 14 was , I think, a well-run Task Force, and 15 the Town was very appreciative of your 16 efforts . And take the draft 17 recommendations very seriously . I just wanted to follow 25 on to Alix ' s comments . She actually APRIL 15, 2025 REGULAR MEETING 16 1 took all the wind out of my sail . 2 Because I was going to mention Morse 3 Creek Landing . So but in addition to 4 what she said, I understand that there ' s 5 water contamination that the plumes of 6 toxic smoke have dispersed toxic 7 particles throughout the surrounding 8 area, which in addition to poisoning the 9 land is also affecting the water quality 10 in the area . And I also believe that 11 one of our neighboring Towns up in 12 Nassau, the town of Oyster Bay, I 13 believe they also have a BESS moratorium 14 in play right now . Because they ' re -- 15 like we are studying the situation . And 16 I know that in Glenwood Landing next to 17 Sea Cliff, they want to put a BESS 18 facility right in the heart and the 19 smack of a very dense suburban 20 neighborhood, abutting Hempstead Harbor . 21 So we ' re not the only ones dealing with 22 studying all of the facts . And like 23 Anne Murray said, I think we should wait 24 until the new zoning code is 25 implemented . So I support the APRIL 15, 2025 REGULAR MEETING 17 1 moratorium . This is personal , 2 obviously . 3 SUPERVISOR AL KRUPSKI JR . : Thank 4 you . Thank you very much . I ' ll go back 5 to the Zoom platform. 6 MARTIN SODA: Yes . I just wanted 7 to make a comment that I generally 8 support everything in Alix O ' Mara has 9 stated, and I think the other point is 10 that there is a lot of changes that are 11 going on in technology in the area . So allow 23 him for two weeks before the Board takes 24 action . And the first one, did we 25 resolve to direct DPW to secure the APRIL 15, 2025 REGULAR MEETING 21 1 house and clean the property? 2 TOWN ATTORNEY PAUL DECHANCE : On 3 the first one , I believe the Board moved 4 to close subject to written comment from 5 the Chief of Deputy Building Inspector, 6 and then the Board will have everything 7 before it to consider . 8 SUPERVISOR AL KRUPSKI JR . : All 9 right . Mike 19 Domino . I and along with my wife, Joy, 20 own 73795 , 74195 , 74365 Main Road, 21 Greenport, in what you ' re now calling 22 the CB or Greenport Corridor District . 23 And when I was last here, last month, I 24 believe I asked the members of the 25 community to read the proposed and get APRIL 15, 2025 REGULAR MEETING 22 1 back with feedback . So I ' m here to say 2 that I did my homework, and I have a few 3 comments I ' d like to share with you . 4 When I first looked at the report, what 5 I do is -- I usually look at the mission 6 statement or the goals , and then I look 7 at the definitions to see where the 8 effort really is . I ' m not going to go 9 through each and every one of these, but 10 I ' ll save them for some other time . But 11 when first the program began, the 12 Comprehensive Plan laid out 13 goals . 13 Goal Number 7 was to facilitate the 14 growth of existing and encourage new 15 business . And Goal 12 , was to prepare 16 the Town for natural disasters as the 17 Town is subject to hurricanes , flooding, 18 and sea level rise . Reading the draft 19 and the terms and the definitions , I 20 don ' t see a great effort to achieve 21 either of those goals . Furthermore, the 22 same update, Project Summary, that was 23 prepared by ZoneCo, states that it 24 respects the past while shaping the 25 future . I can tell you that the APRIL 15, 2025 REGULAR MEETING 23 1 Greenport Corridor business owners , 2 every one of them I ' ve spoken to, some 3 of them in operation in Greenport for 4 145 years . Don ' t feel very comfortable . 5 On ( inaudible ) of a mild term. And why 6 would that be ? It ' s because on Page 24 7 of this 208 page report, there ' s one 8 line that introduces the purpose of the 9 CB District . That ' s going to replace 10 the Business District . The Business 11 District allows retail . And all of us 12 work very hard to conform to the code . 13 But this one sentence says , it ' s just to 14 provide non-retail commercial 15 development outside the Hamlet Center, 16 generally along the major roadways being 17 Route 25 , Route 48 . I believe I 18 understand the purpose of that, but the 19 unsettling part to us is that on the 280 20 Section 2 , A7 , this proposed draft says 21 that it advocates the general 22 elimination of any non-conforming 23 property . So the point being that 24 you ' re making my property 25 non-conforming, then you ' re telling me APRIL 15, 2025 REGULAR MEETING 24 1 that you ' re going to eliminate 2 non-conforming . That got my attention . 3 I spent 45 years in that location . I 4 put a lot of time and energy and money 5 and forgiving being passionate about it . 6 But a lot of blood, sweat and tears . So 7 you got my attention, along with the 8 other business people . And I want to 9 skip something to something else at this 10 point . May seem at first to not be 11 relevant . I ' m going to introduce this . 12 Can I approach? 13 SUPERVISOR AL KRUPSKI JR . : Yeah, 14 please . 15 MIKE DOMINO : This is a copy of the 16 business from a gentleman -- It ' s JRH 17 Engineering . JR Bob Holtzmacher is a 18 professional engineer . He was hired by 19 the Village of Greenport to do a sewer 20 study on August of 2024 . Bob, as he 21 likes to be called, found a 22 significant -- these are his words , 23 significant flooding on First and Third 24 Streets during each high tide event that 25 is accompanied by an easterly wind . So APRIL 15, 2025 REGULAR MEETING 25 1 flooding is quite common here . He also 2 found, and these are his numbers , that 3 during the same easterly wind and high 4 tide combination, 600 , 000 gallons of 5 seawater intrudes into the Village sewer 6 system. The exact source is unknown, 7 but it ' s assumed to be through cracks in 8 the system itself . So, now, as I speak, 9 there were pumps working in buildings on 10 Front Street and Main Street . In the 11 basement, pumping seawater out, which 12 you can understand that goes into the 13 sewer system. So the point being that 14 he ' s trying to save the Hamlet Center of 15 Greenport, but Greenport has a serious 16 problem . A serious problem that I don ' t 17 think is being addressed by this draft . 18 Furthermore, if you remove retail from 19 my property or Mr . Ratsy ' s properties or 20 William Mills , the bus company, you ' re 21 doing the Town a disservice because we 22 have -- and I have a copy of the 23 topographic map here, we have some of 24 the highest land in Greenport, land 25 being south of 48 . In fact, the APRIL 15, 2025 REGULAR MEETING 26 1 benchmark is located in the northwest 2 corner of my property, 13 feet above sea 3 level . On their own, it slopes down, 4 obviously, towards the harbor . So the 5 point being, if the First and Third 6 Street -- if sea level arrives 7 continues , and it ' s projected -- again, 8 not my numbers , but NOAA, to rise half a 9 meter in the next 20 years . 20 years 10 sounds like a long time when you ' re a 11 young kid . When you get to my age , it 12 goes pretty quickly . In fact, this 13 draft report ' s been about 16 years in a 14 making . It goes pretty quickly . A half 15 a meter rise in Greenport, you ' re not 16 going to be concerned with pedestrian 17 traffic or actually vehicular traffic, 18 you ' re going to be worried about kayaks . 19 It ' s a real issue there . And if you ' re 20 going to relocate the businesses , you 21 can ' t relocate them to areas that you ' ve 22 already said can ' t be retail anymore . 23 So we ' re going to cross purposes there . 24 Again, I have a lot more to say on this 25 and I will share it another time . But I APRIL 15, 2025 REGULAR MEETING 27 1 think you started out well intended and 2 incorporated a lot of good feedback from 3 Civic Associations and other members of 4 the community, but not so much from the 5 people in the CB corridor, what you ' re 6 calling a CB corridor . So I urge you to 7 have a focus group . The businessmen are 8 organizing right now, and they would 9 like to talk to you . And I hope that 10 you incorporate their suggestions or 11 some of their suggestions in it . 12 Specifically, remove that prohibition on 13 retail in that zone .
