FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF APRIL 17, 2025 ZBA FILE No.: 8002 NAME OF APPLICANT: Peter and Donna Ruttura PROPERTY LOCATION: 900 Sound Drive, Greenport,NY SCTM No. 1000-33-4-4 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated February 11, 2025, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. The agency further comments that erosion and sediment control measures should be required during and immediately after construction to ensure that stormwater runoff will not carry eroded and other deleterious materials into the Long Island Sound. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP.Coordinator issued a recommendation dated March 27, 2025. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the-LWRP. PROPERTY FACTS/DESCRIPTION: The subject parcel is a somewhat trapezoidal nonconforming 36,203 sq. ft. lot with 21,073 sq. ft. buildable land located landward of the Coastal Erosion Hazard Line, in the Residential R-40 Zoning District. The southerly property line runs 100 feet along Sound Drive to the westerly property line, which runs 376 feet north-north-west, adjacent to the neighboring parcel to the west,to the northerly property line, which runs 104.06 feet east along the Long Island Sound to the easterly property line, which runs, adjacent to the neighboring parcel to the east,south-south-east 360 feet to Sound Drive. The parcel is currently vacant as shown on the survey prepared by David H. Fox, L.S.P.C.,Fox Land Surveying, dated May 23, 2023. BASIS OF APPLICATION: Request for a Variance from Article XXII, Section 280-116A(1) and the Building Inspector's January 21, 2025 Notice of Disapproval based on an application for a permit to construct an accessory in-ground swimming pool; at 1)located less than the code required 100 feet from the top of the bluff; located at: 900 Sound Drive, (adj to Long Island Sound)Greenport,NY. SCTM No. 1000-33-4-4. Page 2,April 17,2025 #8002,Peter and Donna Ruttura SCTM No. 1000-33-4-4 RELIEF REQUESTED: The applicant requests a variance to construct an accessory in-ground swimming pool setback 92.5 feet from the top of the bluff, where the code requires a minimum 100-foot setback from the top of the bluff, as shown in the site plan prepared by Frederick R. Weber, Architect, titled "Ruttura Residence," drawing number SW 1, dated November 14,2024 and last revised January 29, 2025. ADDITIONAL INFORMATION: The applicant provided: • Drawings titled"Swimming Pool/Patio Plan"and"Swimming Pool/Patio Foundation"prepared by Frederick R. Weber,Architect, stamped Received February 3,2025 Zoning Board of Appeals. • The applicant provided examples of three dwellings in the neighborhood on Sound Drive that were granted variances; #3296 dated February 11, 1985, 96500, dated September 15, 2011 and #7733, dated February 16, 2023 for swimming pool setbacks less than 100 feet from the top of the bluff. Listed in the attachment is a property located at 700 Sound Drive with an enclosed porch 51.3 feet from the top of the bluff(a Certificate of Occupancy was issued in 1985). • A copy of Building Permit#51299 dated October 21,2024 to construct a new two-story single-family dwelling at 900 Sound Drive, Greenport,NY which is currently under construction without the need for variance relief. • A letter from the Board of Trustees indicating that the construction of the two-story dwelling with detached two- car garage is outside of the 100-foot Wetland jurisdictional area under Chapters 274 and I I I of the Town Code. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 3,2025 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Several dwellings in the neighborhood include accessory in- ground swimming pools with smaller setbacks from the top of the bluff. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The new dwelling is located with its east and west sides parallel to the easterly and westerly side yard property lines and the proposed in-ground pool is parallel to the dwelling's northerly side, while the distance from the bluff to the proposed pool decreases from west to east, with the result that the west side of the pool conforms to the minimum bluff setback while the east side of the pool has a reduced,nonconforming setback for a small triangular portion. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 7.5%relief from the code at the point of maximum nonconformance. However, the bluff setback increases from the pool's east side to its west side, where the setback is conforming, and larger bluff setback variances have been granted for accessory pools on other parcels in the neighborhood. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code,Chapter 275 of the Town's Wetlands and Shoreline Code, and Chapter I I I of the Town's Coastal Erosion Hazard Area Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Further,the Page 3,April 17,2025 #8002,Peter and Donna Ruttura SCTM No. 1000-33-4-4 applicant began with an undeveloped parcel and chose to maximize the gross floor area of the dwelling to the fullest extent allowable within the Town's Zoning Code thereby limiting the lot area available for siting the accessory in- ground pool. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory in-ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Steinbugler,seconded by Member Weisman(Chairperson), and duly carried,to GRANT the variance as applied for and shown on the shown in the site plan prepared by Frederick R. Weber, Architect,titled"Ruttura Residence,"drawing number SW1, last revised January 29,2025. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall install or maintain a six(6)foot high solid wood or vinyl fence and/or evergreen screening to be continuously maintained along the east and west property lines for privacy from adjacent neighbors' properties. 2. Pool pump equipment/mechanicals must be located a minimum of 20 feet from any property line or be contained in a shed type enclosure with a lot line set back that is in conformance with the bulk schedule for accessory structures. 3. Drywell for pool de-watering shall be installed. 4. The northerly section of the proposed pool fence shall be relocated entirely landward of the Coastal Erosion Hazard Area(CEHA)and all the naturally occurring vegetation seaward of the pool fence shall remain undisturbed. 5. The applicant must obtain a Wetland Permit from the Board of Trustees for all proposed construction within their jurisdiction. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity, provided de minimis relief is requested within one year of the date of this decision. Any time after one year, the Board may require a new application.
