EASEMENT AGREEMENT
THIS EASEMENT AGREEMENT made this 94 day of February, 2025, by
CHRISTINE A. MORTON, with an address at 1220 Old Farm Road, Orient, New York, 1 1957
(hereinafter"Grantor") to KEITH MORTON and CHRISTINE MORTON,with an address at
1220 Old Farm Road, Orient,New York, 11957 (hereinafter"Grantees").
WHEREAS, Grantor is the owner of certain real property situate in the Town of
Southold, Suffolk County, New York, with a street address of 680 Orchard Street, Orient, New
York, and described on the Suffolk County Tax Map as 1000-025.00-04.00-01 1.009, and
Grantees are the owners of certain real property situate in the Town of Southold, Suffolk County,
New York, with a street address of 1220 Old Farm Road, Orient,New York, and described on
the Suffolk County Tax Map as 1000-025.00-04.00-01 1-010; and
WHEREAS,Grantor does hereby give and grant, unto the Grantees, and its successors
and assigns for the benefit of Grantees, a perpetual non-exclusive easement, on, under and across
that part of the Grantor's property, as depicted in the description of which is attached hereto as
Schedule "A" and made a part hereof(the "Easement Area") for the purposes and on the terms
and conditions set forth herein below.
NOW,THEREFORE, for in consideration of one dollar($1.00) paid by Grantees to
Grantor, together the covenants by and between Grantees and Grantor herein contained and other
good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged,
Grantor does hereby grant, and for in consideration of perpetual non-exclusive easement rights as
follows:
1. GRANT OF EASEMENT. Grantor does hereby grant and convey unto
Grantees, its successors and assigns, a perpetual non-exclusive easement on, under and through
the easement area more particularly described in Schedule "A"(the "Easement Area"), for the
purpose of maintaining the described area without any structures or buildings of any kind, and
while agriculture may be conducted, no farm machinery or farm implements of any kind may be
stored or maintained within the easement area; Grantees shall have the right to remove any item
above referred to.
2. USE AND ENJOYMENT OF EASEMENT AREA. Grantor hereby reserves
the right to full use and enjoyment except as restricted by the Grant herein for such use as may
unreasonably interfere with the exercise by Grantees or Grantees' assigns of the rights granted

herein. Grantor shall not construct any building foundations, buildings or structures above or
below present ground level, plant any trees within easement area or impair, undermine or
obstruct the existing, improved, appurtenances located within easement area.
3. MAINTENANCE OF EASEMENT AREA. This grant of right does not
obligate nor charge the Grantees with any duties or responsibilities with regard to the ownership,
condition, repair, and/or maintenance of the easement area.
4. DAMAGE TO IMPROVEMENTS. The Grantor, Grantor's successors and
assigns shall be responsible for all costs and expenses incurred by the Grantees in connection
with the repair or damages to the improvements at Grantor's adjoining parcel when and to the
extent such damages result from or arise out of the negligence of the Grantor, and shall reimburse
the Grantees for costs and expenses including attorney's fees, incurred by the Grantees in
enforcing this provision.
5. INUREMENT. This Agreement shall run with the land and shall be binding
upon and inure to the parties, their heirs, personal representatives and assigns. It is understood
and agreed that the terms"Grantor"and "Grantees", as and when used herein, or any pronouns
used in place thereof shall mean and include the masculine and/or feminine,the singular or plural
number, individuals, firms or corporations, that the rights and obligations of the Grantor and
Grantees shall be binding upon and inure to the benefit of their respective estate, heirs, personal
representatives, successors in interest.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be duly
executed on the o4 day of February, 2025. This Grant of the Easement is non-exclusive. The
Grantor reserves the right at any time and from time-to-time grant further non-exclusive
easements within the Easement Area to such further Grantees as Grantor deems appropriate in
Grantor's sole discretion, provided such additional non-exclusive easements do not unreasonably
interfere with the intended use of the respective easement area by Grantees, Grantees' successors
or assigns.

ALL that certain plot, piece or parcel of land situate, lying and being at Orient in the Town of
Southold, County of Suffolk and State of New York, more particularly described as follows:
BEGINNING at a point on the westerly side of Old Farm Road where the southerly line of Lot 3
of the Conservation Subdivision Map "Orchard Street Farm", at Orient, Town of Southold,
Suffolk County; New York; Filed Map No. 11498, filed with the Suffolk County Clerk on
February 23, 2007, intersects the westerly line of Old Farm Road.

Beginning.

feet to a point.
