WITNESSETH,that the party of the first part,in consideration of One Million Nine Hundred Twenty-Five Thousand
Dollars($1,925,000)paid by the party of the second part,does hereby grant and release unto the party of th'
second part,the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected;situate,lying
and being at Fishers Island,Town of Southold,County of Suffolk and State of New York,being more particularly
bounded and described as set forth on Schedule A hereto.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated February
4,2022 and recorded in the Office of the Suffolk County Clerk on June 6,2022 in Liber 13158 at page 837.
TOGETHER with all right, title and interest, if any,of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises;TO HAVE AND TO HOLD the premises herein
granted unto the parry of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever,except as aforesaid.
AND the parry of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.The
word"parry"shall be construed as if it read"parties"whenever the sense of this indenture so requires.

and State of New York, being bounded and described as follows:
BEGINNING at a stone monument set on the southerly side of a road forty five feet wide, said monument being 2433.86
feet South of a point which is 7146.22 feet West of another monument marking the United State Coast and Geodetic
Survey Triangulation Station "Chocomount 2" (which said"Chocomount 2"monument is located on the summit of the
highest hill on Fishers Island, N.Y. and lies South 79 degrees 29 minutes 46 seconds East from North Dumpling Light in
Fishers Island Sound); and
RUNNING THENCE South 21 degrees 48 minutes 30 seconds East, 232.54 feet to an iron pipe;
THENCE South 14 degrees 00 minutes 40 seconds West, 87.17 feet to an iron pipe;
THENCE North 80 degrees 51 minutes 50 seconds West, 80.76 feet to a stake;
THENCE South 78 degrees 53 minutes 40 seconds West, 64.42 feet to an iron pipe;

THENCE eastwardly still along said road line and following the arc of said curve, 48.23 feet to a stake;
THENCE still along said road line South 89 degrees 08 minutes 30 seconds East, 109.45 feet to a stake marking a point of
curve to the left whose radius is 616.16 feet and the direction of whose radius at that point is North 51 degrees 00 minutes
30 seconds East;
THENCE eastwardly still along said road line following the arc of said curve, 155.36 feet to the stone monument at the
point or place of BEGINNING.
THE POLICY TO BE ISSUED under this commitment will insure the title to such buildings and improvements on the
premises which by law constitute real property.
