POLICY: At the beginning of scheduled Town Board meetings, the attending public is
encouraged to briefly address the Town Board relating to agenda resolutions prior to their
enactment; the public will also be given time at the conclusion of the regularly scheduled
business agenda to address the Board on any given topic.
ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting.
The video of the meeting is usually available to watch live during the meeting. Minutes with
adopted resolutions are available 1-2 days after the meeting. A full copy of the minutes, agenda
and meeting video can be viewed by going to the official Town of Southold website:
www.southoldtownny.gov <http://www.southoldtownny.gov> and following either of the
following:
(1) Move pointer over "Government" on the Town website home page. You will find the title
"Town Supervisor/Town Board". Under this title you will see "Southold Town Board Meetings
and Agendas". or
(2) Go to "How Do I", in the right upper corner of the Town website home page, Choose
"Access", then "Southold Town Board Meetings and Agendas.
Go to the date of the meeting and click on "Minutes Packet" this is the full copy of the
resolutions. (Scroll to bottom of page for KEY to symbols). You can view the live video of the
meeting by clicking on the camera symbol. All of this information is available 24/7.

The meeting will be accessible in person and via Zoom and streamed live on the Town's website.

and Agendas"which takes the user to the Town of Southold Meeting Portal page. Once on the
Meeting Portal page, click on the date of the meeting you wish to view and then click on
"Video". A recording of the meeting will also air on Channel 22 and will be posted on the
Town's website

members of the public to attend via telephone.

Temporary Moratorium/Development of Resorts, Hotels and Motels
WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk
County, New York, on the 15th day of April, 2025, a Local Law entitled "A Local Law in
relation to a twelve (12) month Extension of a Temporary Moratorium on the issuance of
approvals and/or permits for new development of resorts, hotels, or motels," and
WHEREAS, the Town Board of the Town of Southold previously enacted a moratorium on
the issuance of approvals and/or permits for new development of resorts, hotels and motels
which is scheduled to expire June 18, 2025; and
WHEREAS, the Town Board finds that additional time is necessary to finalize comprehensive
zoning updates pertaining to resort, hotel, and motel developments, ensuring proper alignment
with the Southold Town Comprehensive Plan, environmental constraints, and density
regulations, and
WHEREAS, the zoning consultant, ZoneCo, continues its evaluation of zoning classifications,
cumulative impact assessments, and municipal infrastructure capacity related to resort, hotel, and
motel development, and
WHEREAS, the Town Board has determined that without an extension of the moratorium, new
large-scale development may proceed before necessary amendments to Southold's zoning
legislation are completed, potentially undermining the town's long-term planning objectives, and
WHEREAS, the extension of the temporary moratorium will allow the Town to complete its
zoning studies and finalize appropriate legislative amendments in a deliberate and structured
manner, now therefore be it
RESOLVED That the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold, New York, on the
28th day of May, 2025, at 4:30 pm, at which time all interested persons will be given an
opportunity to be heard.
BE IT FURTHER RESOLVED, that the Town Board of the Town of Southold hereby
authorizes and directs the Town Clerk to send the following proposed Local Law to the Suffolk
County Planning Department and the Southold Town Planning Board for their recommendations
and review.
LOCAL LAW NO. OF 2025
A Local Law entitled, "A Local Law in relation to a twelve(12) month Extension of a
Temporary Moratorium on the Review, Approval, and Issuance of Permits for New
Development of Resorts, Hotels, or Motels."
BE IT ENACTED by the Town Board of the Town of Southold, as follows:
L PURPOSE -Moratorium Extension
In furtherance of Local Law No. 564 of 2024, which established the moratorium, the Town
Board recognizes the increasing demand for resort, hotel, and motel development and the
necessity of ensuring that such developments align with municipal infrastructure, environmental
limitations, and community character.
A one (1)year moratorium was enacted by the Town Board of The Town of Southold as Local
Law 564-2024, on June 18, 2024. The moratorium is set to expire on June 18, 2025.
The Town Board finds that additional time is required to finalize zoning amendments and
recommendations regarding resort, hotel, and motel development, including:
A cumulative impact analysis of recent and proposed developments.
A review of environmental constraints and municipal service capacity.
A determination of appropriate zoning classifications and permissible density.
The Town's comprehensive zoning update project, led by ZoneCo, is not yet completed. Given
the complexity of zoning regulations and the need for public review and deliberation, the Town
Board finds it necessary to extend the moratorium to ensure thoughtful policymaking.
IL ENACTMENT OF A TEMPORARY MORATORIUM
Until twelve (12) months from the effective date of this Local Law, after which this Local Law
shall lapse and be without further force or effect unless further extended, no agency, board, or
official of the Town of Southold, including but not limited to the Town Board, the Zoning Board
of Appeals, the Planning Board, or the Building Department, shall issue or review applications
for any approval, special exception, variance, site plan, building permit, subdivision, or permit
for any resort, hotel, or motel development.
III. EXCLUSIONS
This Local Law shall not apply to:
Existing, permitted resorts, hotels, and motels requesting relief for modifications,
expansions, or accessory uses.
Any resort, hotel, or motel development that has received final site plan approval prior to
the enactment of this Local Law.
IV. AUTHORITY TO SUPERSEDE
To the extent that any provisions of this Local Law are inconsistent with Town Law, this Local
Law shall supersede those provisions pursuant to the Town's municipal home rule powers.
V. VARIANCE FROM THIS MORATORIUM
Any person or entity suffering unnecessary hardship as defined by Town Law Section 267-b
(2)(b) may apply to the Town Board for a variance permitting issuance of an approval under the
provisions of the Southold Town Code.
VI. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by a court
to be invalid, the judgment shall not impair or invalidate the remainder of the Local Law.
VIL EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State.

"988 Suicide and Crisis Lifeline Signage" at various Town parcels and road ends throughout the
Town, and to make efforts to educate and communicate the meaning of the message and

Enact LL to Extend BESS Moratorium
WHEREAS there has been presented to the Town Board of the Town of Southold, Suffolk
County, New York, on the 4th day of March, 2025, a Local Law entitled, "A Local Law in
relation to a twelve (12) month Extension of a Temporary Moratorium on the issuance of
approvals and/or permits for Battery Energy Storage System (BESS) facilities" and
WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid
Local Law at which time all interested persons were given an opportunity to be heard, now
therefor be it
WHEREAS, as part of that proceeding the Town Board of the Town of Southold referred the
local law to the Suffolk County Planning Commission and received their comments, and
WHEREAS, the Suffolk County Planning Commission issued its report regarding the proposed
Local Law after a public hearing, and recommended an approval of the proposed local law with a
condition that it shall be limited to an initial three (3) month period only, with the condition that
"[t]he Town shall return to the Suffolk County Planning Commission at the end of the three (3)
month period(i.e. July 2025) to report on their progress with updates to their code for BESS
facilities, and to discuss if an additional three (3)month period extension of the moratorium is
warranted", and
WHEREAS, the rationale for their decision was their anticipation that new updates to the New
York Fire Code, in conjunction with the Governors 2023 working group to examine the safety
and security of BESS systems and a new code to be adopted, and it be
WHEREAS, the Town Board, after the public hearing and in consideration of the entire record,
including the comments from the Suffolk County Planning Commission, intends to enact the
Local Law for extension of the BESS moratorium, as written; and it be
RESOLVED, in accordance with the requirements set forth in Section A14-22 of the Suffolk
County Administrative Code and Section 239-m(6) of the General Municipal Law, the Town
Board of the Town of Southold hereby sets forth the reasons the Town Board, by super majority,
voted to override the full recommendation of the Commission:
The Town Board finds that the condition requiring the Town to return to the Commission in three
(3) months will have no practical value due to the following:
1. The determination of how to best regulate BESS Facilities remains fluid, as final NYS
recommendations have not yet been determined. In this regard, Governor Hochul's Inter-
Agency Fire Safety Working Group announced draft recommendations in February and
the public comment period closed in March. Final recommendations to be incorporated
in the NYS Fire Code have not yet been determined. These final recommendations must
be known and incorporated into the Code to properly regulate such uses.
2. The BESS Code will become part of an ongoing comprehensive zoning update being
conducted by the Town. Based upon advice of the Town's consultants, the Town Board
does not find it prudent to adopt a BESS Code in a vacuum or piecemeal fashion, while
the updated State recommendations have not yet been finalized and the zoning updates
are still being formulated.
3. The zoning update is addressing appropriate zoning classifications, suitable and effective
siting of such facilities and mitigation for adjacent uses. These considerations are an
integral part of the Town's adoption of code affecting BESS facilities.
4. The twelve (12) month extension of this moratorium is a reasonable and necessary
exercise of the Town's authority to preserve the status quo while the Town reviews all of
the above issues and can craft code necessary to address them;
5. This twelve (12) month moratorium extension is specific and would restrict BESS
facilities only. It is limited in terms of its reach, and does not affect any other type of
energy use. Further, the enacted law includes a mechanism for hardship applications.
Accordingly, the length of the moratorium extension is reasonable; and it be further
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
Law entitled, "A Local Law in relation to a twelve (12) month Extension of a Temporary
Moratorium on the issuance of approvals and/or permits for Battery Energy Storage
System (BESS) facilities"reads as follows:
LOCAL LAW NO. 2025
A Local Law entitled, "A Local Law in relation to a twelve(12) month Extension of a
Temporary Moratorium on the issuance of approvals and/or permits for Battery Energy
Storage System (BESS) facilities".
BE IT ENACTED by the Town Board of the Town of Southold, as follows:
L PURPOSE -Moratorium Extension
In furtherance of Local Law 2024-309, which extended the Battery Energy Storage System
(BESS) moratorium, the Town Board acknowledges that BESS facilities are a key
component to the viability and promotion of renewable energy sources. The Town Board
acknowledges the storage systems play an important role in reducing demand and costs
associated with grid infrastructure, add capacity while lessening the burden on existing
infrastructure and deter the use of fossil fuels. However, significant public health and safety
concerns relative to the potentially volatile nature of lithium-ion batteries and battery storage
operations remain. These public health and safety concerns include location of mega-watt scale
facilities in close proximity to established residential areas.
On February 6, 2024, Governor Hochul's Inter-Agency Fire Safety Working Group released
recommendations for inclusion in the New York Fire Code. Recently, the group announced
updates to the New York Fire Code which contain draft code language. Safety at the forefront,
these updates guide the planning of energy storage projects and code.
1. The Town Board finds that the timing of all state and local findings and recommendations
will require extensive time and would not be resolved in the next months. The Town Board
acknowledges and understands the need for clear and concise recommendations and or laws
to successfully work toward a safe and effective Bess Code;
2. Due to the ongoing comprehensive zoning update project being conducted by the Town's
consultants, the Town Board does not find it prudent to adopt a BESS code where the zoning
update is still being formulated. The BESS code is an integral part of the Zoning Code for
the Town. The zoning update in conjunction with the Towns Comprehensive Plan and other
applicable Town laws that will affect the BESS facilities require input from the drafters of
the NYS fire code as well as the Towns Task Force. The timeline for the Zoning Update, due
to circumstances beyond the Towns control, will not be completed within the next few
months. Upon completion of the Zoning Draft, the Town Board must review and provide to
the citizens an extended public hearing time;
A one (1)year moratorium was enacted by the Town Board of the Town of Southold as
Local Law 8-2023, on January 31, 2023, with an effective date of April 11, 2023. The one (1)
year moratorium was further extended by the Town Board of the Town of Southold as Local
Law 2024-309 adopted on March 26, 2024. The current moratorium is set to expire on April
11, 2025.
The moratorium as originally enacted, extended, and still intended to provide sufficient time
for the Town to undertake a thorough examination of these systems to identify any possible
threats to public health, safety and welfare as well as evaluate the potential for environmental
degradation.
The Town Board finds it necessary to extend the moratorium already in effect, the terms of
which remain unchanged and are set forth below. This action is necessary in order to protect
the character, public health, safety and welfare of the residents of the Town of Southold.
IL ENACTMENT OF A TEMPORARY MORATORIUM
Until twelve (12) months from the effective date of this Local Law, after which this Local
Law shall lapse and be without further force and effect and subject to any other Local Law
adopted by the Town Board during the twelve (12) month period, no agency, board, board
officer or employee of the Town of Southold including, but not limited to, the Town Board,
the Zoning Board of Appeals, the Trustees, the Planning Board, or the Building Inspector(s),
issuing any building permit pursuant to any provision of the Southold Town Code, shall
issue, cause to be issued or allow to be issued any approval, special exception, variance, site
plan, building permit, subdivision, or permit for any use identified as a Battery Energy
Storage System (BESS) facility.
III. EXCLUSIONS
This Local Law shall not apply:
1) To any person or entity who/which has,prior to the effective date of this Local Law,
obtained all permits required for such a facility and, relying upon such permission, has
undertaken significant development of such facility.
2) To any application by a municipal corporation or special district or fire district
IV. AUTHORITY TO SUPERSEDE
To the extent and degree any provisions of this Local Law are construed as inconsistent with
the provisions of Town Law this Local Law is intended pursuant to Municipal Home Rule
Law to supersede any said inconsistent authority.
V. VARIANCE TO THIS MORATORIUM
Any person or entity suffering unnecessary hardship as that term is used and construed in
Town Law section 267-b (2)(b), by reason of the enactment and continuance of this
moratorium may apply to the Town Board for a variance excepting the proposed use from
the temporary moratorium and allowing issuance of a permit all in accordance with the
provisions of the Southold Town Code.
VI. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by
any court of competent jurisdiction to be invalid, the judgment shall not impair or invalidate
the remainder of this Local Law.
VIL EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State.
