You are not required to respond to this collection of information unless a valid OMB control number is displayed on this form.Send comments regarding the accuracy of the burden estimate and any suggestions for reducing the burden to:Information Collections Management, Department of Homeland Security,Federal Emergency Management Agency,500 C Street SW,Washington, DC 20742,Paperwork Reduction Project(1660-0008).NOTE:Do not send your completed form to this address. PRIVACY ACT€STATEMENT Authority:Title 44 CFR§61.7 and 61.8. Principal Purpose(s):This information is being collected for the primary purpose of documenting compliance with National Flood Insurance Program(NFIP)floodplain management ordinances for new or substantially improved structures in designated Special Flood Hazard Areas. This form may also be used as an optional tool for a Letter of Map Amendment(LOMA),Conditional LOMA(CLOMA), Letter of Map Revision Based on Fill(LOMR-F),or Conditional LOMR-F(CLOMR-F),or for flood insurance rating purposes in any flood zone. Routine Use(s):The information on this form may be disclosed as generally permitted under 5 U.S.C.§552a(b)of the Privacy Act of 1974, as amended. This includes using this information as necessary and authorized by the routine uses published in DHS/FEMA-003-National Flood Insurance Program Files System of Records Notice 79 Fed.Reg.28747(May 19,2014)and upon written request, written consent,by agreement,or as required by law. Disclosure:The disclosure of information on this form is voluntary;however, failure to provide the information requested may impact the flood insurance premium through the NFIP.Information will only be released as permitted by law. 'PU.RPOSE;OF THE<ELEVATION CERTIFICATE The Elevation Certificate is an important administrative tool of the NFIP.It can be used to provide elevation information necessary to ensure compliance with community floodplain management ordinances,to inform the proper insurance premium, and to support a request for a LOMA,CLOMA,LOMR-F,or CLOMR-F. The Elevation Certificate is used to document floodplain management compliance for Post-Flood Insurance Rate Map(FIRM)buildings, which are buildings constructed after publication of the FIRM,located in flood Zones Al-A30,AE,AH,AO,A(with Base Flood Elevation (BFE)),VE,V1 V30,V(with BFE),AR,ARIA,AR/AE,AR/A1-A30,AR/AH,AR/AO,and A99.It may also be used to provide elevation information for Pre-FIRM buildings or buildings in any flood zone. As part of the agreement for making flood insurance available in a community, the NFIP requires the community to adopt floodplain management regulations that specify minimum requirements for reducing flood losses. One such requirement is for the community to obtain the elevation of the lowest floor(including basement)of all new and substantially improved buildings, and maintain a record of such information. The Elevation Certificate provides a way for a community to document compliance with the community's floodplain management ordinance. Use of this certificate does not provide a waiver of the flood insurance purchase requirement.Only a LOMA or LOMR-F from the Federal Emergency Management Agency(FEMA)can amend the FIRM and remove the federal mandate for a lending institution to require the purchase of flood insurance. However, the lending institution has the option of requiring flood insurance even if a LOMA/LOMR-F has been issued by FEMA.The Elevation Certificate may be used to support a LOMA,CLOMA,LOMR-F,or CLOMR-F request.LowestAdjaoent Grade(LAG)elevations certified by a land surveyor, engineer,or architect,as authorized by state law, will be required if the certificate is used to support a LOMA,CLOMA,LOMR-F,or CLOMR-F request.A LOMA,CLOMA,LOMR-F,or CLOMR-F request must be submitted with either a completed FEMA MT EZ or MT-1 application package, whichever is appropriate. If the certificate will only be completed to support a LOMA,CLOMA,LOMR-F,or CLOMR-F request, there is an option to document the certified LAG elevation on the Elevation Form included in the MT-EZ and MT-1 application. This certificate is used only to certify building elevations.A separate certificate is required for floodproofing.Under the NFIP,non-residential buildings can be floodproofed up to or above the BFE.A floodproofed building is a building that has been designed and constructed to be watertight(substantially impermeable to floodwaters)below the BFE.Floodprooflng of residential buildings is not permitted under the NFIP unless FEMA has granted the community an exception for residential floodproofed basements. The community must adopt standards for design and construction of floodproofed basements before FEMA will grant a basement exception. For both floodproofed non-residential buildings and residential floodproofed basements in communities that have been granted an exception by FEMA,a floodproofing certificate is required. The expiration date on the form herein does not apply to certified and completed Elevation Certificates,as a completed Elevation Certificate does not expire, unless there is a physical change to the building that invalidates information in Section A Items A8 or A9,Section C,Section E,or Section H.In addition, this form is intended for the specific building referenced in Section A and is not invalidated by the transfer of building ownership. Additional guidance can be found in FEMA Publication 467-1,Floodplain Management Bulletin:Elevation Certificate. FEMA Form FF-206-FY-22-152(formerly 086-0-33)(10/22) Page 11 of 19 SECTION C—;BUILDING ELEVATION INFORMATION(SURVEY REQUIRED)(CondqueiQ Land surveyors may not be able to gain access to some crawlspaces to shoot the elevation of the crawlspace floor. If access to the crawlspace is limited or cannot be gained, follow one of these procedures. •Use a yardstick or tape measure to measure the height from the floor of the crawlspace to the"next higher floor,"and then subtract the crawlspace height from the elevation of the"next higher floor."If there is no access to the crawlspace, use the exterior grade next to the structure to measure the height of the crawlspace to the"next higher floor." •Contact the local floodplain management official of the community in which the building is located. The community may have documentation of the elevation of the crawlspace floor as part of the permit issued for the building. •If the property owner has documentation or knows the height of the crawlspace floor to the next higher floor, try to-verify this by looking inside the crawlspace through any openings or vents. In all three cases, use the Comments area of Section D to provide the elevation and a brief description of how the elevation was obtained. Note:If any item does not apply to the building,enter"N/A"for not applicable. Item C1.Indicate whether the elevations to be entered in this section are based on construction drawings,a building under construction,or finished construction. For either of the first two choices,a post-construction Elevation Certificate will be required when construction is complete. If the building is under construction, include only those elevations that can be surveyed in Items C2.a-h.Use the Comments area of Section D to provide elevations obtained from the construction plans or drawings.Select"Finished Construction"only when all M&E such as furnaces, water heaters, heat pumps, air conditioners, and elevators and their associated equipment have been installed and the grading around the building is completed. Item C2.A field survey is required for Items C2.a-h.Most control networks will assign a unique identifier for each benchmark. For example, the National Geodetic Survey uses the Permanent Identifier(PID). For the benchmark utilized;provide the PID or other unique Identifier assigned by the maintainer of the benchmark. For GPS survey, indicate the benchmark used for the base station, the Continuously Operating Reference Stations(CORS)sites used for an Online Positioning User Service(OPUS)solution(also attach the OPUS report),or the name of the Real Time Network used. Also provide the vertical datum for the benchmark elevation. All elevations for the certificate, including the elevations for Items C2.a-h, must use the same datum on which the BFE is based.Show the conversion from the field survey datum used if it differs from, the datum used for the BFE entered in Item B9 and indicate the conversion software used.Show the datum conversion,if applicable,in the Comments area of Section D. For property experiencing ground subsidence, the most recent reference mark elevations must be used for determining building elevations. However, when subsidence is involved, the BFE should not be adjusted. Note:Enter elevations in Items C2.a-h to the nearest tenth of a foot(nearest tenth of a meter,in Puerto Rico);if data is surveyed to the nearest hundredth, round to the nearest tenth. Item C2.a.Enter the elevation measured at the top of the bottom floor(excluding the attached garage)indicated by the selected Building Diagram(Item A7).For buildings elevated on a crawlspace,Building Diagrams 8 and 9,enter the lowest elevation of the top of the crawlspace floor in Item C2.a,whether or not the crawlspace has permanent flood openings(flood vents), Item C2.b.For Building Diagrams 2A through 9 in any flood zone, including Zones B,C,X,and D,enter the elevation measured at the top of the next higher floor(excluding the attached garage)indicated by the selected Building Diagram(Item A7).For buildings requiring more than two floors or levels to be surveyed, such as those with multiple floors or multi-level enclosures, enter the additional surveyed elevations and floor descriptions in the Section D Comments, and clarify which floors are entered as Item C2.a and C2.b. Item C2.c.For floodplain management compliance, this elevation is required for all Building Diagrams 5 and 6 in V Zones in areas seaward of the LiMWA,and in other areas regulated for coastal flooding hazards.Enter the elevation measured at the bottom of the lowest horizontal structural member of the floor indicated by the selected Building Diagram(item A7)or the figure below. This elevation can be entered for Building Diagrams 5 and 6 in any flood zone, including Zones B,C.X,and D.For Building Diagrams other than 5 and 6(if applicable),enter the C2.c elevation as indicated in the figure below. If this item does not apply to the building, enter"NIA"for not applicable. Item C2.d.If there is an attached garage, enter the lowest elevation for top of attached garage slab.(Because elevation for top of attached garage slab is self-explanatory,attached garages are not illustrated in the Building Diagrams.) Item C2.e.Enter the lowest platform, floor,or ground elevation supporting the lowest electrical, heating, ventilation, plumbing, and air conditioning M&E and other utilities servicing the building, which may be located in an attached garage or enclosure or on an open utility platform.Note that elevations for the M&E items are required regardless of their location.Local floodplain management officials are required to ensure that all new M&E servicing the building are protected from flooding. Thus, local officials may require that elevation information for all M&E,including ductwork,be documented on the Elevation Certificate. If the M&E is mounted to a wall, pile, etc.,enter the platform elevation of the M&E.Indicate the lowest M&E type and its general location(e.g.,on floor inside garage,on platform affixed to exterior wall)in the Comments area of Section D or Section G,as appropriate. Note: For more guidance on floodplain management compliance for utilities, including M&E,refer to FEMA P-348,Protecting Building Utility Systems from Flood Damage. The list of M&E and the elevation requirements for documenting floodplain management compliance are different than the NFIP insurance M&E discount eligibility considerations.See Section H Instructions for additional information. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated August 24, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated November 29,2022. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject, conforming, irregular-shaped, 497,455 square feet, 11.42 acre waterfront parcel located in the R-200 zoning district measures 53.82 feet and 210.42 feet along Main Road/NYS Route 25, then runs south, around "Latham Cemetery", 80.56 feet and continues west 131.20 feet and then north 82.75 feet back to the State roadway at the head of Cedar Birch Road(private 50 feet wide right of way),then crosses the intersection 51.03 feet west and runs south along the right of way, along multiple residences, each with access, 82.5 feet, 142.56 feet, 1085 feet then follows a curve R=107.32 feet and A=200 feet, then turns south 18.28 feet (creating an appendage),west 337.55 feet, south 59.09 feet, east 339.69 feet, north 81 feet and then runs east 290.47 feet and continues 447.89 feet and continues back to the State Road, 733.63 feet, runs west 50.09 feet then south 731.65 feet, 424.33 feet and 195.44 feet (creating a second appendage), then runs north 1279.54 feet back to the roadway. The parcel is improved with a two-story residence with attached porches, a detached garage, a small wood shed, a wood platfnrn, with clertric service at the `tidal pond', remnants.of a wood bridge leading to an island at the fresh water pond, an earthen driveway (the right of way) and a gravel driveway to the residence, as shown on the survey prepared by Stanley J. Isaksen, Jr., Licensed Land Surveyor and dated August 23,2000. BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-14 and the Building Inspector's June 15,2022 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling; at; 1) located less than the code required minimum front yard setback of 60 feet; at: 39550 NYS Route 25, (Adj. to Gardiners Bay) Orient,NY. SCTM#1000-15-8-26.8. l Y Page 2,December 15,2022 / #7714,Ball SCTM No. 1000-15-8-26.8 RELIEF REQUESTED: The applicant requests a variance for alterations and additions to an existing house, consisting of a porch expansion,a mudroom entry, and a carport with second floor living space including an en-suite bedroom with full bath, a family room and second, full bath, where the improvement will establish an 11 feet front yard setback where the code requires a minimum front yard setback of 60 feet. ADDITIONAL INFORMATION: While the survey provided illustrates a lot size of 11.42 acres, the property consists of two, uncombined/unmerged parcels: SCTM#1000-15-8-26.7, 4 acres, and#1000-15-8-26.8, 7.43 acres. The improvements and residence, subject of this application is located on lot 26.8, while the 50 feet wide private right of way, known as Cedar Birch Road, is located on lot 26.7, which encircles the subject parcel and a parcel owned by the State of New York. The residence is locatedvell over 500 feet south of Main Road/NYS Route 25, the applicant's road front. However, the parcel is considered to have multiple front yards as a result of the right of way. Further encumbering the parcel are tidal wetlands and a freshwater pond, which require a minimum setback of 100 feet for any improvement. The existing house and barn/garage are built outside of the 100 feet wetland's setback and within the 60 feet front yard setback from the right of way. Existing improvements on the subject parcel (SCTM: 1000-15-8-26.8) are covered by the following Certificate of Occupancy: #Z-22787 dated December 14, 1993 covering a one family dwelling as applied for. #Z-26998 dated March 22, 2000 covering the construction of an agricultural building #Z-36816 dated March 24, 2014 covering alterations to an existing, unheated, accessory building No member of the public or an immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 1, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The surrounding neighborhood is defined by Main Road/State Route 25 which is a major east/west artery in the Town of Southold and also serves the county, connecting it and points west, via ferry to Connecticut and New England. Homes in the immediate area tend to be historic in nature and built close to the roadway, many on less than code conforming lots. Open space abounds and the adjacent parcel to the east is owned by New York State as part of the Orient Beach State Park. The subject parcel is accessed via Cedar Birch Road, a private right of way, also owned by the applicant. This unimproved road allows access to approximately seven neighboring properties, each facing east towards the applicant's residence and each with perceived compliant front yards. The applicant maintains a primary front yard setback, from Main Road, their address,of over 600 feet, where a minimum of 60 feet is required by code. As a result, when paired with the 50 wide right of way,the relief sought will not be easily discernable by immediate neighbors or those traveling on busy State Route 25. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. As a result of the tidal wetlands and freshwater pond, the 1, J Page 3, December 15,2022 #7714, Ball SCTM No. 1000-15-8-26.8 development of the subject lot is severely limited. Any expansion to the existing residence will require some form of variance relief as it is constructed within the 60 feet front yard setback from the right of way. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 82%relief from the code. However, by granting relief for a reduced front yard setback and allowing upland expansion away from sensitive wetlands, the applicant better conforms to the Town of Southold Trustees and New York State Department of Environmental Conservation requirements. 4. Town Law V67-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and additions including an expanded porch, mudroom entry, and attached car port with second floor living space while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member Weisman, and duly carried, to GRANT the variance as applied for, and shown on the survey prepared by Stanley J. Isaksen, Jr., Licensed Land Surveyor and dated August 23, 2000, and the Architectural Drawings (labeled A-10, A-20, A-30, A-40 and A-50)prepared by Frank W. Uelendahl, Registered Architect and dated August 12, 2022. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant is to provide the Board with copy of a Certificate of Occupancy or a valid Board of Trustees Wetland Permit for the wood platform measuring 14.9 feet by 16.6 feet, located at the tidal pond, prior to the issuance of a Certificate of Occupancy for the alterations an a itions granted herein. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals, failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation front the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving r Page 4,December 15,2022 #7714, Ball SCTM No. 1000-15-8-26.8 r nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. Failure to comply in a timely manner may result in the denial by the Building Department of a Certificate of Occupancy, nullify the approved variance relief, and require a new variance application with public hearing before the Board of Appeals Vote of the Board: Ayes: Members Weisman (Chairperson), Dantes, Acampora, Planamento and Lehnert.
