As one of the matters also affects the Town Board and will require their cooperation to address it,I am hoping Town Supervisor Al Krupski can join us for part of the meeting and am thus copying this letter to his office. The issue affecting both Boards is the owner's wish to remove a beach access path encroachment on their property, which is associated with a Town beach access located at the end of Sound Beach Drive. Specifically,as shown on the enclosed survey,the pathway to,the beach begins at the road-end but most of it crosses over the applicant's property and leads to the beach fronting their property rather than the Town Beach. This is problematic because it creates an attractive nuisance and invitation for trespass;and the owner wishes to establish a private access pathway to the beach. Prior to the current owner's purchase of the property, the prior owners reached a boundary line agreement with the Town Board (copy enclosed), wherein the Town relinquished any right of claim to the encroachment and authorized removal of what was an encroaching portion of the asphalt road, which was mostly completed by the prior owners. However,the access path still needs to be relocated so that the public beach access is located on Town land rather than the owner's property. Physically, the solution would appear to be a simple one, requiring 1) the Town Board to authorize relocation of the Town beach access path to Town property with associated signage directing public foot traffic thereto; and 2) the Town Trustees to authorize the owner to revegetate at least the most landward half of the pathway and place shrubs and/or temporary fencing adjacent to the road-end to block access to the existing path while it's being revegetated. And to limit the disturbance associated with establishing a private pathway for the owner's beach access,the seaward half of the existing pathway could be incorporated into the owner's new pathway. Of course, without cooperation between the Trustees and Town Board to ensure that both scopes of work can occur simultaneously, the solution will not be so simple. Separately and of interest only to the Trustees, the owner wishes to develop the property and plans to set back all proposed structures at least 100 feet from the top of bluff. However,due to undulating topography within the 100-foot bluff setback,particularly between the 50 and 100-foot setbacks where a usable rear yard would typically be established, there will be a need to fill and grade within the 100-foot setback which we would like to discuss with the Board in the context of the proposed site development. To that end,we plan to have the 50 and 100-foot bluff setbacks,side property lines,and seaward corners of the likely proposed dwelling staked out ahead of our site meeting.
