Box 1179 Eric Sepenoski Southold,New York 11971 Liz Gillooly � Telephone(631) 765' 1892 Elizabeth Peeples � �� Fax(631) 765-6641 c®uidT`I,N BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD April 18, 2025 Twin Fork Permits 288 East Montauk Highway Hampton Bays, NY 11946 RE: STEPHANE SEGOUIN 310 THE STRAND, EAST MARION SCTM# 1000-21-5-5 Dear Ms. Poyer: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, April 16, 2025 regarding the above matter: WHEREAS, Twin Fork Permits on behalf of STEPHANE SEGOUIN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated January 8, 2025, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 16, 2025, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the Southold Town Code, 2 WHEREAS, the Board has determined that the project as proposed will not affect the health,, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with they Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees APPROVE the application of STEPHANE SEGOUIN to demolish (Per Town Code Definition), existing dwelling and construct a (1,740sq.ft. footprint), two-story dwelling with a 479sq.ft. second floor balcony, a raised 653sq.ft. seaward patio below balcony and a below grade garage; existing 26sq.ft. east porch and 326sq.ft. south covered' porch to remain; install a 15'x30' swimming pool with 890sq.ft. at-grade pool patio; 4' high pool enclosure fencing with gates installed with a top of bluff setback at 21; install a pool drywell,, pool equipment area in basement; abandon existing sanitary system and install an I/A sanitary system landward of dwelling; the two (2) existing decks located along the top of bluff will be ' permanently removed and not replaced by cutting the footings flush at grade and removing the structures by hand, no heavy machinery; and to establish and perpetually maintain a 15'.wid'e non-turf, non-fertilized vegetated buffer along the landward edge of the top crest of the bluff; all as depicted on the site plan prepared by MCH Design Services, received on April 2, 2025, and stamped approved on April 16, 2025. That the said•Board of Trustees and the Town of Southold are released from any and all damages, or claims.for damages,.of suits arising directly..or indirectly as.a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the.said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. The decks are partially over the bluff edge. The posts which are on the bluff face will be cut by hand at grade and left in place since the vegetation is stable around the posts and the bluff edge is stable. The posts which are landward of the bluff edge can be cut at grade or just below grade and left in place OR they can be cut and then hand dug to remove the posts and any footings if they exist. If the posts remain in the ground - no fill will be used in this area. If the posts are removed completely, a small amount of fill may be necessary to fill in the holes, I would estimate less than 1 cubic foot of clean sand may be necessary, however if the posts are hand dug out the area would be filled back in with the dug earth and would most likely fill the hole without the need for any fill. We can do either method of removal for the posts landward of the bluff edge. However all work will be done by hand and no machinery or heavy equipment will be located near the bluff edge. The platforms will be cut up and removed by hand from the area. Please let me know if the Board has a preference for removal or if you require additional information.
