PO Box 2124 Greenport, NY 11944 RE: MAUREEN DACIMO REVOCABLE TRUST 5240 NARROW RIVER ROAD, ORIENT SCTM# 1000-27-2-4 Dear Mr. Costello: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, April 16, 2025 regarding the above matter: WHEREAS, Costello Marine Contracting Corp. on behalf of MAUREEN DACIMO REVOCABLE TRUST applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated February 10, 2025, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 16, 2025, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the Southold Town Code, 2 WHEREAS, the Board has determined that the,project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees APPROVE the application of MAUREEN DACIMO REVOCABLE TRUST to replace bulkheading and perform modifications to the marina layout consisting of- In Area "A" remove and dispose of the existing 26'x64' over the water Structure "A" and 26 support pilings; remove`and dispose of±285' of existing bulkheading and construct new 291.2' vinyl bulkheading; install a new 4'x67'floating dock, and a 3'x10' aluminum ramp with three (3) anchor pilings, and six (6) mooring pilings in same area as previously existing mooring pilings; in Area "A" for the existing 6,511 sq.ft. gravel driveway; a 34' timber curb; existing docking consisting of 10 mooring pilings, 6'x7' platform to a 3'x10' ramp to a 4'x100' floating dock with one 2.5'x14' finger float, one 2.5'x15' finger float and three 2.5'x12' finger floats to be temporarily removed and replaced. In Area "B", remove and dispose of 93' of existing bulkhead and construct 93' of vinyl bulkhead in-place using vinyl sheathing; and for the existing structures consisting of 1,364sq.ft. asphalt driveway to boat ramp area, 62 linear feet of picket fence, a 1,896sq.ft. brick patio, a 119sq.ft. gravel area, an 823 sq.ft. wood deck and a 33sq.ft. overhang deck; and to dredge an area (approx. 13,897sq.ft.) to 4' below Mean L'ow Water.elevation 0.0' removing approx. 875 cubic yards of spoil with all dredged material to remain on site; all as depicted on the site plan prepared by Costello Marine Contracting Corp., received on April 4, 2025, and stamped approved on April 16, 2025. Permit to construct and complete project will expire three years from the date the permit'is signed. L ` TERMS AND CONDITIONS The Permittee Maureen Dacimo Revocable Trust, 5240 Narrow River Road, Orient New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 36 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. In regards to the covered slip building, the Issues are: At times of high tides the fixed dock is under water&and customers cannot safely access their boat;there is extremely low water under there and it it's a safety hazard that needs addressing. I've kept my boat there two different times during two different decades, and it has since deteriorated tremendously and is of grave concern both for safety and erosion to the environment around the parking lot and covered Boat area as well as the silting around the said docks. Birds fly in &out and defecate on my and other boats. During extreme high tides the overhead limits boats that can dock there safely(windshields and center consoles...). Regarding the bulkheads, they have deteriorated and require replacement. I see this work as very necessary to maintain the integrity of its location as well as the environmental impact that has been occurring by not doing anything over many years. The Trustees should consider granting this permit to protect the area from erosion and also to allow boaters safe access to their boats and maintain adequate water depth as well as the areas wetland management.
