I am writing to request that the New York State Legislative
Commission on Water Resource Needs of Long Island be included as
a party-in-interest for the forthcoming Environmental Impact
Statement (E.I.S) for the proposed zone change for Marlo
Castelli. The proposed project is located at County Route 48 in
Peconic.
Since the Commission is required by state law to make
recommendations on activities that may adversely affect the
waters of Long Island, we request that we have the opportunity to
comment on the E.I.S. for this project. Accordingly, please
provide us with a copy of the draft E.I.S. when it becomes
available. We would also suggest that a Scoping meeting be held
as soon as possible with all concerned parties to insure the
development of a proper E.I.S.

Pursuant to the requirements of Sections A14-14 to 23 of the Suffolk County
Administrative Code, the Suffolk County Planning Commission on July 6, 1988,
reviewed the aSove captioned application and after due study and deliberation
Resolved to disapprove it because of the following reasons:
It constitutes the unwarranted further perpetuation of business zoning
along Middle Road (C.R. 48);
It is inconsistent with the predominant single family residence pattern
of zoning in the surrounding area;
It would tend to establish a precedent for further such
rezonings/downzonings in the locale along C.R. 48;
It contravenes policy objectives set forth in the recent Town of
Southold Master Plan Update which calls for discontinuance of strip
business development outside hamlet centers, along the Town's major
corridors; and,
It is inconsistent with the recent Town Master Plan Update which
designates this area for single family residence purposes.

THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED BY THE
SOUTHOLO TOWN BOARO AT A REGULAR MEETING HELD ON JUNE 28, 1988:
WHEREAS, Marlo Castelli has heretofore applied to the Southold Town Board for a
change of zone from "A" Residential and Agricultural District to "B" Light Business
Oistrict on certain property located on the southerly side of County Route 48, Peconic,
New York;
NOW, THEREFORE, BE IT RESOLVEO AS FOLLOWS:
1. That pursuant to the provisions of Article 8 of the Environmental Conservation
Law; Part 617 of Title 6 of the New York State Codes, Rules and Regulations, and
Chapter 4q of the Southold Town Code, the Southold Town Board, as lead agency, does
hereby determine that the action proposed is unlisted and is likely to have a significant
effect on the environment.
2. That the Town Clerk shall file and circulate such determination as required
by the aforementioned law, rules and code.
3. That the Town Clerk immediately notify the applicant, Marlo Castelli, of this
determination, and further request said applicant to prepare a Generic Environmental
Impact Statement, all in accordance with said law, rules and code.
q. In accordance with Chapter q4, Section 20 and Part 617 NYCRR, the applicant
is required to defray the cost of reviewing the Generic Environmental Impact Statement
which includes a scoping session, therefore, the Town Board determines that a deposit
of $2,000.00 shall be paid to the Town Clerk prior to the date of the scoping session.

A change of zone for this parcel alone would result in minor
impacts on the environment. However, as the Part III statement
reveals, the Town would put itself in a position of vulnerability
with respect to the remainder of the properties along County Route
48 and with resppct to other sites improved with buildings for
similar uses.
A number of separate zone changes along Route 48 taken together could
have significant adverse impacts on the environment, cumulative in
their extent and create long term, secondary and growth inducing
impacts. Therefore in accord with Section 617.15 (a).~) of the
SEQR Regulations, if the Town wishes to further conslder this zoning
change, it should cause a generic EIS addressing these issues to
be prepared by the applicant.

Impact on Growth and Character of Community or Neiqhborhood
The proposed action will conflict with the officially adopted
Master Plan and the proposed zoning for the Town. It will also
cause a change in the possible density of the land use as well
as the permitted allowable uses. An important precedent will be
set for future projects of similar nature in the surrounding
areas. This type of precedent would require a generic
environmental impact statement for the half-mile segment of
Route 48 in Peconic. A precedent would also be set for zone
change requests on other sites throughout the Town improved with
buildings for landscaping, nursery stock, storage etc. from
existing residential zoning to business zoning [spot zoning).
It would lead to the pressure from adjacent land owners to
request the same type of zoning. Clearly this is not the intent
of the existing or proposed zoning or of the Master Plan.

The following action was taken by the Southold Town
Planning Board on Monday, June 6, 1988.
RESOLVED that the Southold Town Planning Board make a
recommendation to the Town Board of denial for this change of
zone. This property is located on the southerly side of County
Route 48, Peconic.
WHEREAS the zone change does not conform to proposed master
plan adopted by the Planning Board.
AND WHEREAS zone change would set a precedent for other
adjacent property rezonings,i.e, adjacent service businesses in
residental zone.
AND WHEREAS existing residential lot, which supports a lawn
sprinkler, landscaping, and nursery service business under an
accessory building provision of the code, in the Planning
Board's opinion, is an improper use of the residential lot,
since a residence did not exist and therefore an accessory
building should not have been permitted.
AND WHEREAS this zone change would set a precedent for
further erosion of the residential districts for service
business uses, especially along Route 48 and Main Road. For
these reasons, the Planning Board recommends the zone change,
requested, be denied by the Town Board.

Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a proiect
or action may be significant. The question of whether an action may be significant is not always easy to answer Frequent-
ly, there are aspects of a proiect that are suhiective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically e.xpert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
