TO THE SOUTHOLD TOWN BOARD:
EDWARD SPEECHES, sole owner of the premises described in the
above matter, by his attorney, LEFFERTS P. EDSON, makes the following
points in connection with his application for an amendment to
the $outhold Town Huilding Zone Ordinance.
The purpose of the application is to qualify the land~r a
use pez~itting the operation of a restaurant on the subject premises
by your applicant, using the existing structure for the conduct of
the business, the balance of the the 2 acre parcel to be used for
parking areas and for landscaping.
Historically, this property was used as a boarding house by
the applicant's mother as far ~ack as ~he 1920's, providing food
and lodging to people from the west end. Advertising for this
purpose was had in coopemation with the Long Island Railroad in
furtherance of its prospective business.
The rapid increase inpopulation and in "second home" residences
in Southold Town has created a need for public conveniences necessary
to satisfy the gro~h. The pressures of growth force changes in
zoning districts to meet the demands. Middle Road between Sout~nld
and Greenport is responding to this need as evidenced by the non-
residential uses now existing abng its route. Growth prompts changes.

"The ~gument may be made that the granting of this application
would intensify traffic noise and use on Middle Road and should not,
therefore, be granted. This would be contradictor~y argument. If
traffic and the noise generated by it on Middle Road are now problems,
then for these same reasons, the residential characteristics of the
area are presently diminished. The retention of this property as a
residential area w~uld not increase traffic problems but would also
not c~u~e traffic ills that now exist. The solution for the traffic
problem does not lie in placing an undue burden on the individual
owner of a parcel of land.
It cs~not be said that the granting of this application would
constitute illegal spot zoning. It is not spot zoning if an
amendment to the Zoning Ordinance bears a reasonable relation to
public welfare and is thus consistent with the general purpose of
the Ordinance.
Zoning Ordinances are not static but must respond appropriately
to the needs created by growth. Changes in zoning created to meet
these needs are in the public welfare and within the proper
legislatiwe function of the board.
Ypur application requests that the Town Board, after due
deliberation and in the interest of the welfare and economy of the
Town of $outhold, grants this application.

LEFFEHTS P. EDSON: In comming to a decision of this
matter, each member of the Board should take note of the points
made in this memo before the final decision is made. The Middle
Road, between Southold and Greenport has at least 30 uses other than
Residential existing along it. It is inevitably going to be a
business area. Bacuase of the fact that there is a good deal of
traffic and noise and congestion on it makes for more reason to
grant this application. This land is not suitable for residential
purposes. As the ~md exists now~ the portion of Mr. Speeches land~
is not suitable for residential use. It has to be suitable and
useful for somethLug and with the Village Disposal unit across
the street and other uses, it is not reasonable to assume that the
owner cares to use this for residential p~poses. We recluest
yottr consideration md careful reading of the petition.
SUPERVISOR MARTOCCHIA: Is there anyone elsa that wishes to
be heard in favor of this change of zone?
FRED GORDON: I think the North Fork area ia very forty, hate
in having a number of fine restaurant. I would like to mention
that every one is familiar with the possibility of this change
for a restaurant in this area. We are very fortunate in having
~ery fine restaurants in this area. They are a tremendous
drawing for the North Fork and I am sure that another restaur~-
in this area certainly would add to this fact and not hinder it.
We~are fortunate for having these drawing points. Thank you.

MRS. TRAUTMAN: Most planning experts are opposed to spot
zoning. The development plan discoursg~s~business development
along this road, and discotu'ages spot ~E zoning. I request the
Board delay decision on this application until you can make a
decision of the development plan now before the Board.

I appear here on behalf of the applicant. As to therthe recommendation
of the Suffolk County Planning Board, they do not want business on
Route 27 nor on Route 25. It seems the s~me individual w~ote this
recommendation that wrote the recommendation for the previous
application. If there is to be no business area on Rt. 27 and

RICHARD CRON,ESQ.(CON't): Rt. 25, I would ~k like to be
informed as to where we will allow business. This particular
application is an applicationfor a change of zone on small parcel
of land which is situated on the easterly side of Aldrich Lane,
coming out of a large tract owned by the application The Board
has a survey prepared in connection with this application. Viewing
of same will show that across the street there is a business zone.
This particular zone runs, from the dimensions on the zoning map,

approximately 1000 feet along Aldrich Lane and 750 feet along ~%N
Road. The change this application proposes on the easterly side
of Aldrich Lane is an a~ea of approximately 250 feet on
Mein
Aldrich Lane, 205 feet on ~'~ Road, and a rear line of 242 feet,
other line 206 feet. This would c~eate a unique bus~eas area at
the intersection of Aldrich Lane and M~n!Boad. I find it difficult
to sos what real objection there should be to changing this area.
I find no reason to object to the change in conju%tion with what
already exists. I don't believe this is spo$ zoning. It is not
in conflict with the zoning Ordinance, not withstanding the recom-
mendation of the Suffolk County Planning Board and the Southold
Town Planrning Board. We request the granting of this change as
requested.

they plan to put on that corner?

structure.

MRS. TRAUTMAN: Mr. Cron's proposal does not go along with
the development plan map. Part II, pg 2 of this plan atatea that
business development should be in the central part of the towns
and business development along rt. 25 should be discouraged. It
is inevitable that this will all be business unless we stop spot
~onisg.
MR. RICHARD H0~LEL: Mr. Supervisor and Members of the Town
Board. The intersection of Aldrich Lane and Main Road is about
a residential as you can get. Across the street is a house
that has been reconstructed for residential use. It was formerly
Laurel School House. That is not very business like. To the
immediate north of that building you have Laurel Cemetery and we have
with us~ Leland Farting of the Cemetery Assodation. To continue
on do~nthe street, there are some more old buildings. They are
not being used. You have two more residenSe, then Laurel School
Any commercial establishment would be detrimental to the school.
M~. Hommel (Con't) We feel that it would be bad principle to
give blank change of zone. It cuuld be a bank, or it could be
something else. This property was taken over by a syndicate.
TheF are not there to keep it residential, You know what happens
when you start with a small business area. There is no need for
business in this residential area. We do not wish to see this
property changed to business use.
MR. FRED BOUTCHER: M~. Supervisor and members of the Board.
May I ask a question. Do not the surrounding tax payers get a
notice of a proposed change of zone.
SUPERVISOR MARTOCCHIA: No. The legal notice is printed in
the official newspaper.

Re: Application of Aldrich Lane Realty for a proposed
change of zone from "A" Residence to "B" Business,
Town of Southold (SD - 69 - 27)
Dear Mr. Richmond:
Pursuant to the requirements of Sections 239-1 andm of the General Municipal
Law, the Suffolk County Plarming Commission has reviewed the above captioned
zoning action and, after due study and deliberation, disapproved this change of
zone because of the following:
1. It is not consistent with the Town Master Plan which designates this
area for Agricultural-Residential use and states that commercial
ribbon development should be discouraged along State Route 25.
Z. It constitutes the unwarranted perpetuation of commercial develop-
ment along the State road.
3. It would set a precedent for further downzonings along the State road
which would be detrimental to the safety and traffic carrying capacity
of said facility.
4. It would impair the zoning stability of the surrounding area.

This is to advise you that the following action was taken
by the Southold Town Planning Board at a regular meeting held
on December 8, 1969:
Tn the matter of the original petition of Aldrich Lane
Realty, 4910 Sunrise Highway, Sayville, New York, relative to
a change of zone from "A" Residential and Agricultural District
to "B" Business District on certain property located at the
N/E corner of Main Road and Aldrich Lane, Laurel, New York.
It was RESOLVED that the Southold Town Planning Board does
not recommend to the Southold Town Board the change of zone
from "A" Residential and Agricultural District to "B" Business
District on the above described property.
Tt iS the opinion of the Southold Town Planning Board
that this change of zone would not coincide with Southold Town's
recent development plan.

To amend the zoning restrictions of the above-described parcel
from "A" Residential and Agricultural District to "B" Business
District pursuant to the provisions of the Building Zone Ordinance
of the Town of Southold.
3. Suchrequestis made forthefollowing reasons: The described parcel for which
a zoning change is requested is situate at the comer of Aldrich Lane
and Main Road, Laurel, New York. It is proposed that the rezoning run
for a distance of 250 feet along the easterly line of Al~trich Lane and
about 205 feet along the northerly line of Main Road. At the present
time lands on the opposite side of Aldrich Lane and Main Road are zoned

use of the subject parcel is business, particularly in the light of the
fact that directly across from Aldrich Lane the area is zoned for
business use.
