I am enclosing a copy of the letter I wrote to the Zoning Board
of Appeals on behalf of the Cutchogue Fire District, as well as a copy
of my letter to Mr. Kito of LI Tower Partners .
When you get a chance, I would appreciate you forwarding me what
copies you have of the SEQRA process for the new firehouse and when
you receive it, the site plan for the cell tower application. I
realize that a meeting with the cell tower people cannot take place
until after they respond to the Planning Board' s most recent requests,
but when they do so, kindly inform me so that when the matter is taken
up by the Planning Board Staff with the applicant, that a representa-
tive from Fire District can be present.

Town Zoning Board of Appeals acting as Lead Agency for this SEQR
process.

RE: Proposed Cell Tower Facility at Cutchogue Fire District
Dear Mr. Kito:
The Board of Fire Commissioners at their meeting last night asked
me to invite you to come and meet with the Board to review the Cell
Tower Project and find out why it is taking so long, and also to
establish the exact location of the cell tower itself. They also
asked me to request the Southold Town Planning Board to invite the
Commissioners to the next meeting concerning the application for the
cell tower so everyone can be on the same page as to what is required.
Keep in mind, the Board would like to get this application concluded
as soon as possible as they are a little confused as to exactly where
the cell tower itself is to be located as well as the supporting
buildings .
It was a former Board that negotiated and dealt with you directly
and several of the current Board Members have, literally, no knowledge
of the application so it would be very helpful for you to come and
explain everything to them. I repeat, they are very anxious to. get it
done because they are in the process of trying to build a new
firehouse and would like to get all of this behind them as soon as
possible.
Kindly let me know when you are available to meet with the Board
of Fire Commissioners . Their next official meeting is August 9, 2022.

To Whom It May Concern,
With respect to drawings for the above referenced project previously submitted to the Town of Southold on
April 8, 2022, Nemschick Silverman Architects P.C. (NSA) has reviewed the New York State Department of
Environmental Conservation (DEC) SEAR (State Environmental Quality Review) criteria for classifying the
"Action" for the above referenced project to establish our opinion that a Negative Declaration by the Lead
Agency is warranted. The following represents our rationale.
1. According to the DEC, the first step is to determine if the Action requires no further review under SEAR
as a Type II Action.
a. The DEC instructions state to check if the project could be listed as a Type II Action. If the action
is not on the Type II list in Section 617.5(c) (of 6 CRR-NY), it is either a Type I Action or an Unlisted
Action.
b. We do not find a correlation between the items in the Type 11 Action list and the subject project.
2. The DEC instructions state that if an action is found not to be a Type II Action,then it is either a Type I
Action or an Unlisted Action.
3. A review of Section 617.4 (of 6 CRR-NY),Type 1 Actions was conducted. We do not find a correlation
between the items in the Type I Action list, contained in Section 617.4, and the subject project.
4. Given the subject project is neither a Type If Action nor a Type I Action, it falls into the Unlisted Action
category.
5. With the project falling into the Unlisted Action category, NSA then completed the Short Environmental
Assessment Form. This form will now be given to the Lead Agency who is responsible for making a
determination of significance.
6. Based upon our completion of the SEAF, it is the belief of NSA that the project would receive a
determination of significance from the Lead Agency stating the project was found to have "No
Significant Adverse Impacts" on the environment.

7. Given the foregoing,the Lead Agency would then issue a "Negative Declaration". At this point,the SEQR
review process ends, and no further environmental review efforts would be required.
We trust the foregoing provides the information necessary to explain the opinion of NSA that the subject
project should receive a "Negative Declaration". Please feel free to contact our office if you have any questions
or require any additional information. We greatly appreciate your kind attention to this matter.
