SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 35,275 square foot non-conforming parcel located in the R-40 Zoning District. The property measures 131.04 feet along the westerly property line and fronts Victoria Drive, the northerly property line measures 200.00 feet, the easterly property line measures 196.89 feet and fronts Columbia Road, and the southerly line combined measures 215.81 and fronts Ed's Road. The property is improved with a one-story dwelling with an attached two-car garage, 8.3 feet by 6.2 feet wood shed located on the west side of the garage, an attached wood deck located at the rear of the dwelling with a gravel sitting area around the deck, all as shown on the survey map prepared by Tamara L. Stillman, LS, and dated December 23, 2024. BASIS OF APPLICATION: Request for Variance from Article III, Section 280-15 and the Building Inspector's January 21, 2025 Notice of Disapproval based on an application for a permit to construct an accessory in-ground swimming pool; at; 1)located in area other than the code required rear yard•, located at:490 Victoria Drive,Southold, NY. SCTM No. 1000-78-9-71.3. RELIEF REQUESTED: The applicant requests a variance to construct an accessory in-ground swimming pool to be located in the front yard. The proposed accessory swimming pool,<is not permitted pursuant to Article III, Section 280-15,which states accessory buildings and structures shall be located in the required rear yard. ADDITIONAL INFORMATION: The applicant's representative submitted copies of prior comparable variance relief decisions that approved in-ground swimming pool locations in other than the code required rear yard.However, only one of them is in close proximity to the subject property; ZBA File No. 6580 dated August 16, 2012, granted relief to a property located on Main Bayview, Southold, for an"as-built"swimming pool located in a side yard. d Page 2,March 20,2025 #8001, Sicuro SCTM No. 1000-78-9-71.3 According to the applicant's representative,the stone fireplace that is depicted on the survey has been removed. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 6,2025 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject neighborhood consists of single-family dwellings of varying size,many on properties with substantial slopes similar to the subject property,The proposed location for an in-ground swimming pool in the front yard facing Columbia Road already contains some evergreen plantings, and, with the required condition of approval for additional evergreen privacy screening,will not be seen from the road by passersby. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's property is extremely sloped and burdened with three front yards. The rear yard is at the lowest point on the property so all stormwater runoff drains into that area. In addition,there is a very large,beautiful and healthy tree in the rear yard, an as built attached deck on the rear of the dwelling, and a gravel sitting area. All of these would have to be demolished to place a pool in that rear yard location. Finally considerable land disturbance would be necessary to construct a pool in the rear yard because it would require a high retaining wall. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100%relief from the code. However,the problems of sloping property and more than one front yard cause a variance request. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed location will be screened from public view along the Columbia Road side of the property as a condition of approval and the he applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 1s267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in-ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Steinbugler, and duly carried, to GRANT the variance as applied for, and shown on the survey map prepared by Tamara L Stillman, and dated December 23, 2024, and pool drawings prepared by HM Engineering, PC and dated February 1,2025. Evergreen screening shall be planted and continuously maintained along Columbia Road to shield the pool from view by passersby. 2. Pool pump equipment/mechanicals must be located a minimum of 20 feet from any property line or be contained in a shed type enclosure with a lot line set back that is in conformance with the bulk schedule for accessory structures 3. Drywell for pool de-watering shall be installed. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar desion that is de minimis in nature for an alteration that does not increase the degree of nonconformity, provided de minimis relief is requested within one year of the date of this decision Any time after one year, the Board may.require a new application. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. _Town Law V67-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family homes. Swimming pools are characteristic of this neighborhood and the proposed pool will exceed the required front yard setback for a dwelling in the R-40 zoning district. The applicant will use plantings to visually screen the view of the swimming pool from both streets as depicted in a conceptual landscape plan provided by Patricia Hopkins, Landscape Designer. 2. Town Law V67-b(3)M(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The lot is triangular in shape and has road frontage on two sides. These conditions create a small rear yard on a very large.lot which then limit a code conforming rear yard location. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However,the majority of the proposed pool and related patio are behind the existing dwelling and are entirely within the code required setbacks. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions placed upon it by this board. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and to enable the applicant to enjoy the benefit of a swimming pool in a front yard while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
