(631)765-1809 XOW�o d Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF MARCH 20,2025 ZBA FILE No.: ##7990 NAME OF APPLICANT: James Clous PROPERTY LOCATION: 3805 Bay Shore Road, Greenport,NY - SCTM#1000-53-6-18 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions,without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated December 18,2024 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. The applicant must comply with Chapter 236 of the Town of Southold's Stormwater Management Code. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated February 3, 2025: Based upon the information provided on the LWRP'Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a 13,825 sq. ft.non-conforming parcel located in the R-40 Residential District. The property has road frontage of 100.00 feet along Bay Shore Road along the westerly property line, 138.50 feet adjacent to a neighboring parcel along the northerly property line, 100.00 feet fronting Shelter Island Sound along the easterly property line, and 138.00 feet adjacent to a neighboring parcel along the southerly property line. The parcel is improved with a one-story residence with a detached two-car garage and attached concrete patio, as shown on the survey prepared by Kenneth M. Woychuk of Kenneth M. Woychuk, Land Surveying, P.L.L.C. dated September 26, 2019. BASIS OF APPLICATION: Request for a Variance from Southold Town Code §280-207 and the Building Inspector's November 6,2024 Notice of Disapproval based on an application for a permit to demolish an existing single-family dwelling and construct a new two-story single-family dwelling; at 1) gross floor area exceeding permitted maximum square footage for lot containing up to 20,000 square feet in area; located at: 3805 Bay Shore Road, Greenport,NY. SCTM No. 1000-53-6-18. Page 2,March 20,2025 #7990,Clous SCTM No. 1000-53-6-18 RELIEF REQUESTED: The applicant requests that the. Board of Appeals, pursuant to Chapter 280-146(A) Power and Duties, overturn the Building Department's Notice of Disapproval dated November 6, 2024 for a permit to demolish an existing single-family dwelling and construct a new two-story single-family dwelling at 3805 Bay Shore Road, Greenport, NY, which states that the proposed construction on this non-conforming 13,825 sq. ft. parcel in the Residential R-40 District is not permitted pursuant to §280-207, which specifies that lots containing up to 20,000 sq. ft. can have a maximum gross floor area (GFA) of 2,100 sq. ft. plus 12.5% of the lot area in excess of 10,000 sq. ft. The site plan shows a GFA of 4335.4 sq. ft., exceeding the permitted amount of 2,578.1 sq. ft. by 1,757.3 sq. ft. AMENDED APPLICATION: During the hearing, the applicant argued after §280-207 went into effect on October 18,2022,the Building Department had accepted previously submitted applications to the Suffolk County Department of Health Services as a basis for exemption from §280-207. The applicant was asked to furnish such examples. The applicant on February 14, 2025 submitted a letter to the Zoning Board of Appeals describing an application to the Building Department, by this same architect, that was granted a building permit based on a Suffolk County Department of Health Services (SCDHS) application submitted June 24, 2022. The applicant only included a copy of the Suffolk County Department of Health Services receipt, dated June 24, 2022, for an application for a residential public water onsite sanitary system at that project's address and a copy of Building Permit#48722 dated January 11, 2023, pursuant to an application dated November 7, 2022. The applicant did not include any correspondence with either the Health Department or the Building Department regarding any request for `grandfathering' a project plan, nor did the applicant provide any details about the property size and permitted vs. actual GFA for that project. There was no memorialization of any requests or comments between the architect and Building Department,thus, making it difficult to verify. The applicant's February 14,2025 submission also included copies of emails between the applicant and Matthew Smith of AMP Architecture in 2024, questioning whether this project would be exempt from §280-207; and between Matthew Smith and the Building Department Permit's Examiner, regarding the timing of applications. ADDITIONAL INFORMATION: The applicant provided a survey prepared by Kenneth M. Woychuk,Kenneth M. Woychuck Land Surveying, P.L.L.C., dated September 26, 2019. The applicant provided a Denial from the Trustees, dated September 17, 2021, for a permit to demolish an existing 1,479.5 sq. ft. dwelling and foundation, and back fill with approximately 400 cubic yards of fill; construct a proposed new foundation and 1,971.3 sq. ft. two-story dwelling with a 113.5 sq. ft. front porch, a 20 sq. ft. south landing, and a 15.7 sq. ft. north landing; install 35 sq. ft. bilco door to basement; install a OWTS; and install gutter to leaders to drywell to contain roof runoff; and as depicted on the site plan prepared by Mark Schwartz,Architect, dated April 19, 2021. The applicant provided a site plan prepared by AMP Architecture,dated September 3,2024,including a proposed site plan, a proposed first floor plan,a proposed second floor plan,west and south elevations, and east and north elevations, labelled SD-1, SD-2, SD-3, SD-4, and SD-5 respectively. The applicant provided a letter from Anthony Portillo, R.A., of AMP Architecture, dated November 26, 2024, outlining the timing of applications for the project that were submitted prior to the October 18, 2022 effective date of §280-207. These included an application to the NYS Department of Environmental Conservation (submission date March 15, 2021), to the Town of Southold Trustees for a Wetlands Permit, (submission date April 12, 2021), which was subsequently denied, and to the Suffolk County Department of Health Services (submission date April 16, 2021). The letter noted that the Trustees Wetlands permit was denied for not s Page 3,March 20,2025 #7990,Clous SCTM No. 1000-53-6-18 proposing an Innovative Advanced (I/A) septic system and that the Suffolk County Department of Health Services issued six Notices of Incomplete Application over the course of twenty months. The applicant received a letter of non jurisdiction from the New York State Department of Environmental Conservation (NYSDEC). The applicant provided a Notice of Incomplete Application,Notice#8, from the Suffolk County Department of Health Services dated July 18, 2023 indicating that a Trustees Wetland Permit would be needed prior to any further processing of the application. The Board received one letter of support for the project from the next-door neighbor at 3855 Bay Shore Road. The subject parcel is covered by Pre-Existing Certificate of Occupancy No.Z-28512 dated June 12,2002 stating that the one family dwelling built prior to April 9, 1957 conforms to all of the requirements of the applicable provisions of the law. The occupancy for which the certificate is issued is a one family dwelling with slate patio and accessory two-car garage. Improvements to the subject parcel are covered by: Certificate of Occupancy No.Z-19033 dated May 8, 1990 pursuant to Building Permit 9423-Z dated August 22, 1977 for addition to existing one family dwelling as per amended plans dated September 19, 1977. Certificate of Occupancy No. 43188 dated June 27,2022 pursuant to Building Permit 46385 dated June 8, 2021 for 300 amp underground electric service for garage. Certificate of Occupancy No. 43740 dated January 5, 2023 pursuant to Building Permit 47721 dated April 21, 2022 for windows and doors replaced in kind to existing accessory garage as applied for. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 6, 2025 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: Section 280-207 became effective October 18, 2022 and includes as 280-207 A(3) "The maximum gross floor area restrictions imposed by this §280-207 shall not be applicable to any project otherwise subject to the restrictions for which a complete construction application has been submitted for approval to Town of Southold Building Department or discretionary board, prior to the enactment date of this section. Following the issuance of a certificate of occupancy, the structure shall be deemed preexisting nonconforming." The applicant reported receiving six Notices of Incomplete Application from the Suffolk County Department of Health over the course of twenty months. Twenty months from the SCDHS submission date of April 16, 2021 would indicate that the last such notice of incomplete was received approximately December 16, 2022, subsequent to the October 18, 2022 enactment date of §280-207. Further, the applicant included in the application to the Board a copy of Notice of Incomplete Application, Notice #8, from the Suffolk County Department of Health Services, dated July 18, 2023, indicating that a Trustees Wetland Permit would be needed prior to any further processing of the application. Given these facts, the Board finds that the applicant's application to the Suffolk County Department of Health was not complete as of October 18,2022,the enactment date of§280-207. Page 4,March 20,2025 #7990,Clous SCTM No. 1000-53-6-18 The applicant's February 14, 2025 submission to the Board offering an example wherein the Building Department accepted a previously-submitted application to the Suffolk County Department of Health Services as a basis for exemption from §280-207 was insufficient as there was no written proof that this example was acceptable for meeting the application requirement, nor did it indicate if this example application was identified by the Department of Health as incomplete, as was the subject SCDHS application. As such, the Board finds that the SCDHS application example provided on February 14, 2025 is not substantially similar to the current case and is not an applicable precedent for establishing exemption from §280-207 in this case. Regarding Trustees, the applicant's application to the Trustees for a Wetland Permit differs in several respects from the application submitted to the Building Department. The Wetland Permit application consistently listed the size of the proposed dwelling as being 1971.3 sq. ft. (as indicated in the Trustee application file pages 2, 12, 31, and 34) rather than the 4335.4 sq. ft. noted in the Building Department's Notice of Disapproval. The Notice of Hearing to be posted in advance of the Trustee's public hearing on the Wetland Permit application also indicated a house size of 1971.3 sq. ft., which is an increase of 33% in area over the existing dwelling, while the application to the Building Department reflected a dwelling with nearly three times (2.93 times) the square footage of the existing dwelling. The LWRP Assessment form in the Wetland Permit application included the statement, "The new dwelling has a somewhat greater mass but not of significant area to negatively impact on visual quality,"which seems aligned with the more modest area increase rather than a nearly three-fold increase. In addition to the dwelling square footage discrepancy, several aspects of the dwelling design changed between the Wetland Permit application and the.application to the Building Department for a building permit, including reduction in the number of bedrooms from five to four, enlargement of a second-floor bathroom, and numerous changes to windows, doors, closets, stairs, pantry, kitchen, and coffee bar. Further, the Trustees had established the requirement that I/A systems be included in applications for Wetlands Permits for new residential construction. The Trustee inspection dated August 10, 2021 noted the need for an I/A system.The Board finds that the applicant knew,or should have known, of the I/A system requirement prior to submitting their application to the Trustees for a Wetland Permit on June 18, 2021. Upon confirmation of the requirement for an I/A system noted in the Trustees inspection of August 10, 2021, the applicant provided the Trustees a letter from architect Mark Schwartz of Mark Schwartz & Associates, dated as received August 24, 2021, indicating that an I/A system was not feasible. The Board finds that the applicant proceeded with a Wetlands Permit application to the Trustees they knew to be incomplete. Applicant argues the time lapse cited by the Building Department as not a valid basis for denying the exemption of the project from §280-207. However, the Board finds the Building Department's acknowledging time was part of a larger conversation about the processing of timely applications and a means to keep the applicants moving forward and to discourage long delays in progress as occurred here. Lastly, the Southold Town code §280-207 (A)(3) refers to "Town of Southold Building Department or discretionary board," which this Zoning Board finds to mean any discretionary board of the Town of Southold. Although included in this decision in response to applicants' argument,the ZBA does not find that it also pertains to SC Health Department and DEC. Even if applicant alleges it does pertain, the DEC did not act in a discretionary capacity and the Suffolk County Department of Health application was identified as incomplete by that agency multiple times. The Board finds that the condition noted in §280-207(A)(3) ("a complete construction application... submitted for approval to Town of Southold Building Department or discretionary board,prior to the enactment date of this J Page 5,March 20,2025 #7990,Clous SCTM No. 1000-53-6-18 section") that would render this application exempt from the new law is not met. The Trustees application was denied before the new code was effective. The application to the Building Department was finally submitted in 2024, almost two years after §280-207 went into effect and after alleged conversations with the Building Department regarding exemption. The Southold Building Department has sent a Notice of Disapproval letter dated 11/6/24 citing Section 280-207 of the Southold Town Code as the reason for disapproval. Sections 280-207 A(1) and A(2)would provide for an allowable GFA for this property of 2,578.1 SF. The reason for the denial in the Notice of Disapproval letter in this case should not be applicable as the application meets Section 280-207 A(3). Three applications had been submitted for approval prior to the enactment of Section 280-207 (added to Code on 10/18/22). These applications include the NYS DEC on 3/15/21,Southold Town Trustees(Wetlands Permit) on 4/12/21 and the Suffolk County Department of Health on 4/16/21. Architect Mark Schwartz had been hired by the Owners on 12/9/20 to complete the initial design and applications. Also,the Owners hired an expediter on 3/15/21, Mike Kimack to complete the above- mentioned permits. The Trustees hearings were held on 8/18/21 and 9/15/21. The Wetlands permit application was denied by the Board of Trustees for not proposing an IA septic system. Due to the denial by the Board of Trustees,the Owners hired a professional engineer,James Deerkoski, on 9/23/21 to complete an IA septic design and file an amendment with the Suffolk County Department of Health. The amended IA design was filed on 11/18/21. The NYS DEC application was satisfactorily resolved. A Letter of No Jurisdiction Tidal Wetlands Act was received on 4/20/21. Knowing that the "Big House Code" (280-207)was adopted by the Town of Southold, Mark Schwartz spoke to the Southold Building Department and confirmed to the Owners in an email dated 11/14/22 that he had "been told if a project has been submitted and the permit process is in the works,the project will be exempt from new zoning". One of the Owners also had separately spoken to the Southold Building Department detailing the applications that had been filed including that the Wetlands permit had been denied. The Building Department confirmed that the new zoning would not apply as permits had been submitted prior to the enactment of the new section. Over the course of 20 months,James Deerkoski received six Notices of Incomplete Application from the Suffolk County Department of Health. All other IA technical issues had been resolved. The Owners engaged AMP Architecture on 4/24/24 to take the initial design drafted by Mark Schwartz and to complete the detailed construction plans and to expedite the remaining applications and permitting. On 7/3/24, AMP Architecture discussed the project with the Southold Town Building Department and a response was given that the application would be denied for GFA. Mike Verity indicated in an email dated 7/3/24(from Amanda Nunemaker)that"this project will not be grandfathered under the former Town code. There was a 10-month lapse between the last Health Department correspondence and the time when AMP took over the project." The recent Notice of Disapproval from the Building Department did not mention a "time lapse" in the project. Section 280-207 A(3) does not contain any requirements for a time-period for completion of permitting or any disapproval for a time lapse or pause in activity of a project. Therefore, the timing of activity of this project should not be a consideration for grandfathering under Section 280-207 A(3). We ask the Zoning Board of Appeals to consider that the application meets Section 280-207 A(3) and that it is exempt from meeting the current GFA requirements. SCTM# 1000-53-6-18 This project has been deemed to be consistent by the Town's o LWRP program coordinator wherein the coordinator specifically suggests that the Board request clarification for the purpose of the placement of four-hundred cubic yards ofifill. The Conservation Advisory Council voted to support this application. Board of Trustees initially inspected this project August 10th, noting that the Board expressed the wish that the house be 50 feet from the bulkhead, which the current plans do indicate, and that the house should include an Innovative Alternative sanitary system to reduce nitrogen. In response to that request of the Board, the agent for the Clous', Mr. Kimack, had Mark Schwartz Architect submit a letter to the Board dated and received in the Trustees office August 24th, outlining purported needs to have a conventional sanitary system as opposed to an Innovative Alternative system. The Board again reviewed this project at our work session on September 8th, and at which time we were aware of the letter of Mr. Schwartz and decided to have additional discussion at work session, which we held on the evening on September 13th. At that time the Board entered into extensive discussion concerning this project and the fact that the Board has required at least two other IA systems on large, heavily constrained properties on Bayshore Road, and the position of the Board going forward is that we want to see IA systems on all projects within the Town, and specifically noting also that there is sanitary hookups to a garage here. So with the expanded home and its size going from the existing home of 1,479 square feet to 1,971 square feet, plus the addition of habitation in the existing garage, it becomes particularly important that the Board felt in discussion that we seek an IA system for this site. Is there anyone here wishing to speak to this application? - MR. KIMACK: Michael Kimack on behalf of the applicant. *' Board of Trustees 21 September 15, 2021 Y� At last we met on this project, primarily, the question was raised that you would like to have an IA system there and I think you also talked about trying to move it back a little bit. I expressed the concern that there was not enough space to put an IA system in with the number of disposable space that is required relative to the depth of the water table and the size of the rings. The letter that architect Mark Schwartz basically did was fairly extensive and fairly detailed, and pretty much indicated that in that area, we simply cannot fit the IA system. And it's, yes, I mean the garage, basically, is for I think it's the one-bedroom in the area. They are adding four or five bedrooms to the, basically house, and the area that we have in order to get it back as far as we could from the bulkhead, essentially, like that, the area that is left is not conducive enough to put in a system that would take care of the six bedrooms for an IA system. TRUSTEE GOLDSMITH: So, if I may, as you said, six bedrooms, is six bedrooms and five-and-a-half baths;that would be attached to this traditional septic system. Last month when you talked about it you said if it's a blank lot, no question IA. If it's a demolition, no question, IA. And the caveat if it's below five bedrooms. This one obviously is six bedrooms all together and you are incorporating the garage plus the new house. So that's by any measure above the threshold. And I'm firm that we need an IA in this. We do have applications on tonight's'agenda for other properties a couple houses down that have the same constraints as this particular property and they were able to engineer an IA stem. Like I said, at least three other properties on this road that we have done in the last two years that have IA systems as well. MR. KIMACK: The IA system is site specific in terms of,] can't speak to the other properties in terms of what reasons they may or may not have, and in terms the setbacks are they able to manipulate an IA stem on those particular properties. When I was here last time, basically, you requested I do a letter or I get a letter from the architect indicating whether or whether or not we could fit it on. I thought the letter was rather specific indicating from the architect professionally that there was really no way that the space could be allocated to be able to get an IA system on the property. TRUSTEE BREDEMEYER: Let me pose a question to you, having a little knowledge of this that might be getting lost as I get older. The fact that you have this very large, proposed a very large conventional sanitary system in the front yard, because the Board wishes to have an IA, what would preclude you and/or Mr. Schwartz on behalf of the applicant to approach the Suffolk County Health Department Board of Review to have them consider waiving a portion of the expansion pools because with the system so close to the street, the ability to maintain it and replace pools in place, in other words, we are up to five or six Board of Trustees 22 September 15, 2021 bedrooms. With an IA system where it's readily accessible in n 6W the front yard, they could have cast iron covers to grade and/or Vv provide a right-of-way to provide maintenance to put an IA in. It would seem it would not be an unreasonable request to have you approach the County Health Department Board of Review to put an IA system in there, to see if they would consider some kind of relief from the expansion pools. MR. KIMACK: The application to the Health Department as you know from the last conversation had been submitted some months ago, and you also know that it has not yet been approved subject to the approval of the Trustees. They don't usually issue the permit. And essentially I think your position is since it had not been approved there was still an opportunity look at it in a different way. I can't answer that question in terms of, I do know that their requirement is 50-foot expansion pools and I don't think asking for a variance to remove those would be something that they would grant. tfs simply it's within their code. They require 50% expansion. TRUSTEE BREDEMEYER: I'm not trying in any way to engineer or propose anything. It was just a thought. I'm expressing what I know is a very strong sentiment of the entire Board as a discussion of the work session. MR. KIMACK: Well, I think I can't give you an answer for the Health Department, obviously, in terms of what they'll define, but the system was designed according to their standards in terms of number of pools required. The house as designed is a little larger. He has a large family, large kids. The question in terms of the number of bedrooms is not really an issue, that is really what he.needs for his particular house, essentially, like that. TRUSTEE KRUPSKI: I think you and your client are focused on what you need and not as much as environmentally what you need to do. So-- MR. KIMACK: Are you suggesting,to limit down the number of bedrooms? TRUSTEE KRUPSKI: After reading through the engineer's report from Mark Schwartz, maybe you can't shoehorn an IA septic in because you are overbuilding the lot. But it's possible that with some other configuration of the house that is not even 50 feet back from the bulkhead as of now, maybe you can fit an IA in there. MR. KIMACK: Well, the last time we were here you wanted basically to move it back from basically 47 to 50. TRUSTEE GOLDSMITH: That was one concern, but our-primary concern - was an IA. MR. KIMACK: The same reason we have the IA system in terms of the space, putting it back three feet because we need the very space for this particular disposable and that in there, so. TRUSTEE GOLDSMITH: Just one other question, is the garage a permitted structure? MR. KIMACK: Yes, the gazebo, the garage, it's got its own Health Board of Trustees 23 September 15, 2021 Department permit. TRUSTEE BREDEMEYER: Any additional questions or concerns? Anyone else wish to speak this application? I MR. KIMACK: I'm not sure if my client is online. I thought he was going to listen in. Rut then again, he may or may not have been able to make the connection. TRUSTEE BREDEMEYER: Okay, so I believe we discussed this at length -- MS. CANTRELL: We have someone by the name of James A. MR. KIMACK: That's him. MS. CANTRELL: James A, if you would state and spell your name for the record, and un-mute yourself. MR. CLOUS: James A. Clous. I guess I would just echo what Mike said. As we prepared this and went to the Department of Health early on, well before the new regulations had cut in, and applied for this, to fit this system, we had a very difficult time fitting the system in the front yard because of the water table and the ten-foot pool requirements, and the ten-foot septic requirements. We finally managed to get a configuration that fit, it was over 100 feet from the water. So from an environmental consideration, it's at least minimized in that way. And we just went back to Mark and could not fit the added septic tank requirements to fit this, to fit the IA in here. Also, the way the septic tank would have to sit because of the garage and house configuration, it would Literally besight in between the front door of both of those systems with manhole covers and air venting right in between the two front doors of those systems. So it just would not fit. We could not figure out any other way to do it. That's why we applied with the regular system for the Department of Health. And they are all approved pending Trustee approval. MR. KIMACK: I may add, James, one of the issues we had was in order to bring the utility line in and that had to come in between the system-and the-- and that also limited the amount of space we had. The only place, if you.look at the drawing, is on that side. And we had to have a space ten feet from that line. So the water line also, not only the building but also the water line limiting the space that we have. Am I correct on that, Jim? TRUSTEE BREDEMEYER: Thank you. They told me as long as I had already started in the permit process,the new regulations would not apply. I asked for a meeting with the Southold Trustees at my house. I met with them today. The two unresolved issues are the IA septic approval and the Trustee request to have the house set back 50'from the bulkhead. You may have seen the latest rejection of the septic plan by the SCDHS. I have sent this to James Deerkoski to address. I have not been using Mike Kimack for the DHS(which is all I have been working on for over a year)as all I need to do is attach documents to their portal. Regarding the 50'setback from the water,the Trustees will accept the current plan showing 47' 1"from the water if our proposed house is set back behind a line drawn from the seaward corner of the adjacent north neighbor's house to the seaward corner of the adjacent south neighbor's house. I measured all the distances of both neighbor's houses today after meeting with the Trustees(copy attached on Deerkoski's latest site plan). It certainly looks pretty close but I need to have someone put the measurements and"line" on the site plan that is to scale so the line can be properly drawn.
