WITNESSETH,that the party of the first part, in consideration of ten dollars($10.00) paid by the party of the
second part, does hereby grant and release unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,`
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being north of the Village of Greenport,Town of Southold, County of Suffolk and State of New York,
bounded and described as follows:
BEGINNING at a concrete monument set on the easterly line of Sunset Lane marking the southwesterly
corner of lands heretofore conveyed by Edna M.Turner to Donald A. Halliwell and another;
RUNNING THENCE North 62 degrees 21 minutes 30 seconds East along the southerly line of said land of
Halliwell, 105 feet to a point;
THENCE in a general southerly direction and on a line parallel with the easterly line of Sunset Lane, a
distance of 75 feet to a point and other land of Edna M.Turner;
THENCE South 62 degrees 21 minutes 30 seconds West, 105 feet to the easterly line of Sunset Lane;
THENCE northerly along the easterly side of Sunset Lane,75 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party to the first part by deed made by
HENRY F.VAN WYCK and NANCY VAN WYCK, his wife, dated August 4,2005, and recorded September 1,
2005 in the Suffolk County Clerk's Office in Liber 12407 page 25, and such deed reserved a life estate for
HENRY F.VAN WYCK and NANCY VAN WYCK,
Said HENRY F. VAN WYCK, life tenant,died a resident of Suffolk County on September 21,2021,and he did
not exercise his special power of appointment recited in the deed recorded in Liber 12407 Page 25 during his
lifetime.
NANCY VAN WYCK has not exercised and hereby extinguishes her special power of appointment recited in
the deed recorded in Liber 12407 Page 25.
RESERVING HOWEVER,a legal life estate in the above-described premises for NANCY VAN WYCK.
TOGETHER with all right,title and interest, if any,of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises;TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement before using any part
of the total of the same for any other purpose.
The word"party"shall be construed as if it read"parties'whenever the sense of this indenture so requires.
