WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk
County,New York, on the 18th day of March, 2025, a Local Law entitled"A Local Law in
relation to an Amendment to Chapter 280, Zoning,Accessory Apartments" and
WHEREAS that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at Southold Town Hall, 53095 Main Road, Southold,New York, on the
131H day of May, 2025 at 7 p.m. at which time all interested persons will be given an
opportunity to be heard.
The proposed Local Law entitled, "A Local Law in relation to an Amendment to Chapter
280, Zoning,Accessory Apartments" which reads as follows:

BE IT ENACTED by the Town Board of the Town of Southold as follows:

I. Purpose
The Purpose of the amendment is to update the Southold Town Code with regard to Accessory
Apartments.
IL Amendment
The Southold Town Code is hereby amended by removing the struck through words and adding
the underlined words as follows:
§ 280-13(B)(13)(e)
The entirety of the living floor area of the accessory apartment must be on one floor of the
accessory structure. If established on the first floor, access to any storage area above shall be by
pull-down ladder staircase only. The stmetwe must have been eet4ifiea4ed a Minimum of thre-e

Occupancy of resident structures on the premises shall be subject to the issuance of anbi-annual
rental permit in accordance with § 280-13D and the following requirements:
[1] One of the dwelling units shall be for the sole, exclusive occupancy of the owner or
family member as defined in § 280-4. The other dwelling unit shall be leased for
year-round occupancy evidenced by a written lease for a term of off no less than one
year and no more than two years to:
[a] A family member; or
[b] A resident who is currently on the Southold Town Affordable Housing Registry
and eligible for placement.
[2] Rents charged to a resident on the Affordable Housing Registry shall not exceed the rent
established by the Town Board annually pursuant to § 280-30F of this Code.
[3] No accessory apartment shall be occupied by more than the number of persons permitted
to occupy the dwelling unit under Section 404 of the Property Maintenance Code of the
New York State Uniform Fire Prevention and Building Code.
[4] An accessory apartment shall only be occupied or otherwise utilized in accordance with
the certificate of occupancy issued for the dwelling unit.
[5] Upon approval of the special exception and prior to the issuance of a rental permit,
the applicant shall file covenants and restrictions with the Suffolk County Clerk's
office in a form approved by the Town Attorney. The covenants and restrictions
shall include terms and conditions deemed necessary by the Zoning Board of
Appeals to ensure that: 1) the accessory apartment shall only be rented to a family
member or resident who qualifies to be on the Southold Town Affordable Housing
Registry, and 2) the special exception approval and resulting rental permit are
nontransferable and any future owner must reapply for the permit.
III. Severability
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any

court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. Effective Date
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

permission to the Mattituck Lions Club to use Strawberry Fields in Mattituck,NY from
June 1 lth through June 15th, 2025 for the Annual Strawberry Festival and be it further
RESOLVED that the Town Board of the Town of Southold authorizes the Town Clerk to
issue a Special Events Permit to the Mattituck Lions to hold its Annual Strawberry
Festival at Strawberry Fields Mattituck,NY from June llth through June 15th, 2025

1. They file with the Town Clerk a Two Million Dollar Certificate of Insurance
naming the Town of Southold and the County of Suffolk as an additional insured;
2. Coordinate traffic control upon notification of the adoption of this resolution
3. No permanent markings be placed on town, county or state roads or property for
the event;
4. Any road markings or signs for the event be removed within twenty-four(24)

hours of the completion of the event;
5. No alcohol is to be served at the event as per Town Code. Alcohol is prohibited
on all Town and County Parks.
Some of the requirements for issuing a Special Permit may be waived.
Provided they adhere to all conditions on the application and permit and to the Town of Southold
Policy for Special Events and subject to the Renewal of Contract with Suffolk County land
Preservation.Subject to a renewal of the applicable lease for the parcel between the Town of
Southold and the County of Suffolk and any user fee imposed by the County of Suffolk. This
permit is subject to revocation if the applicant fails to comply with any of the conditions of the
approval or is unable to properly control traffic flow into and out of the event.

Reason for amendment: applicant heard back from SC Health Dept that they require 0.8 sanitary
flow credits, 0.04 credits more than the amended resolution.
AMENDED RESOLUTION 2024-859
WHEREAS the Town of Southold has established a Transfer of Development Rights (TDR)
Program whereby Sanitary Flow Credits can be transferred into a TDR Bank from open space
lands purchased by the Town of Southold, and
WHEREAS an application for transfer of Sanitary Flow Credits was filed by KEKJS
Headquarters LLC seeking transfer of 0.8 credits to the property known as SCTM # 1000-102.-5-
19 located at 28495 Main Road, Cutchogue, NY 11935 in the Mattituck-Cutchogue School
District, and
WHEREAS the TDR Bank currently has credits on deposit from lands purchased by the Town of
Southold that are located within the Mattituck-Cutchogue School District, and

WHEREAS, the sending parcel for these credits is 1000-101.-1-8.2, a parcel preserved in
perpetuity as open space by the Town of Southold in 2024, sending 16.4 credits to the Town
TDR Bank, all of which remain unused, and
WHEREAS the applicant seeks to utilize 0.8 credits on land in the Hamlet Business District
(HB) zoning district, a designated receiving district, to convert an existing accessory garage to
one accessory apartment at the aforementioned property, and
WHEREAS the accessory apartment to be created will remain affordable in perpetuity, shall be
leased only to eligible individuals registered with the Town of Southold Housing Registry, and
that the sale and the lease price shall be set by resolution of the Town Board, and
WHEREAS the Town Board classified this action as Type II under SEQRA on September 24,
2024, and
WHEREAS this action is exempt from Local Waterfront Revitalization Program review, and
WHEREAS the Town Board held a public hearing on September 24, 2024, at which time all
persons were given the opportunity to be heard and that hearing has been closed, and
NOW therefor be it
RESOLVED that the Town Board has evaluated the effects of the proposal transfer and finds that
the district contains adequate resources, environmental quality and public facilities, including
adequate transportation, water supply, waste disposal and fire protection, and further finds that
there will be no significant environmental damaging consequences and that such development is
compatible with the comprehensive planning efforts of the Town, and the Town Board
incorporates the report of the Planning Board dated April 5, 2024; and it is further
RESOLVED that the Town Board of the Town of Southold hereby transfers 0.8 sanitary flow
credits from the Town TDR Bank to by KEKJS Headquarters LLC for its development at 28495
Main Road, Cutchogue, NY, SCTM#1000-102.-5-19, and it is further
RESOLVED that upon issuance of the Sanitary Flow Credit Certificate, the Planning Department
shall enter the deduction of the 0.8 sanitary flow credits from the sending parcel's balance in the
Sanitary Flow Credit Log, and be it further
RESOLVED that the applicant shall receive a Sanitary Flow Credit Certificate for the 0.8 credits,
which shall not be signed by the Town Supervisor and released by the Town Clerk to the
applicant until the covenants and restrictions required by Town Code Section 117-11, and
including the requirement that the apartment shall remain affordable in perpetuity, have been
filed and such filing has been approved by the Town Attorney; and be it further
RESOLVED that the Town Clerk shall forward this resolution to the Tax Assessors Office, the
Land Preservation Department, the Government Liaison and the Planning Department for
inclusion into the Town database and GIS system.

WHEREAS, the Deputy Chief Building Inspector of the Town of Southold inspected the
property located at 1120 New Suffolk Avenue, Mattituck, SCTM #1000-114-12-17.1 and
prepared a written report of his findings in the form of a Notice dated March 7, 2025; and
WHEREAS, the Deputy Chief Building Inspector determined the structure to be unsafe and
dangerous due to inadequate maintenance, neglect, dilapidation and abandonment; and
WHEREAS, said Notice was sent via personal delivery to the interested parties, Robert Brenner,
and said notice was posted at the subject location pursuant to Town Code Section 100; and
WHEREAS, the Notice advised that the property must be made safe, and if the owner failed to
comply, that a hearing would be held before the Southold Town Board on April 15, 2025; and
Resolved, if the owner or agent fails to remediate the premises or demolish the structure prior to
said date the Southold Town Board will hold a public hearing pursuant to Chapter 100 of the
Southold Town Code on April 15, 2025 at 9:00 a.m. at Southold Town Hall 53095 Main Road,
Southold NY 11971.
