WORD TORE DONE AND CONSIDERATION THEREFOR The To-wn accepts d e bid of the Consultant for the purpose of performing groundvvater sampling, analysis and reporting, at the Solid Waste Management District Yard Waste Compost 1,'acility,for a maximum of 12 quarterly samplings over a three year period, or any lesser number of samplings as required by the.New York State Department of.EInvironinental Conservation("NYS DEC'), at the itemized costs as listed in the winning bid. The Consultant shall receive a fee for said services as per the accepted bid dated December 17, 2024 and compensation will be paid dependent oil the total number of events required by the NYS DEC. ARTICLE 2. TERM OF AGREEMENT The terms of this agreement shall run from the full execution of this Contract and the work shall be completed within thirty-six (36) months unless extended by mutual agreement of the parties. The Town agrees to cooperate with Consultant, as needed,and to provide Consultant with copies of any records, documents and other information needed for performance of this agreement on a timely basis. The Town further agrees to provide Consultant with access to all areas of the;structure where work is performed and with all appropriate officials and/or employees of the Town,as may be needed in the performance of the agreement. Moreover, both parties understand and agree that mutual accountability and responsiveness is critical to the successful completion of the project, and therefore both shall always use their best faith efforts to be accountable and promptly responsive to each other. ARTICLE 3. ACCEPTANCE ANRFINA.L PAYMENT Upon receipt of written notice that the services required by this Agreement have been fully performed and an inspection to certify that the work has been completed to the satisfaction of the Town, the Consultant:shall submit an itemized voucher to the Town Comptroller for payment. Such voucher shall be due and payable within forty-.five(45) days alter receipt of such voucher, but such sun) shall not be due and payable by the Town until the 'Town Board of the Town has received such a voucher and has audited and approved for payment the voucher to be submitted by Consultant in connection therewith. The Town Board shall process any voucher received from Contactor as expeditiously as possible. In the event that the Town disputes or objects to any portion of any voucher submitted by Consultant it shall notify Consultant in writing of such dispute or objection. Consultant acknowledges that Consultant is familiar with the requirements of section 118 of the New York Statc Town Law which, in effect, prohibit payment of any claim against the Town unless an.itemized voucher therefore shall have been presented to the Town Board or Town Comptroller and shall have been audited and allowed by the Town Board or'Town Comptroller. The acceptance by the Consultant of the final payment shall be, and shall operate as a release to the Town from all claims and all liabilities to the Consultant for all the things done or furnished in connection with this work and for every act and neglect of the Town and others relating to or arising out of, this Agreement, except Consultant's claims .for interest upon the final payment, if this payment be improperly delayed. No payment, however final or otherwise, shall operate to release the Consultant or its sureties from any obligations under this Contract. ARTICLE.4. CONSULTANT'S OBLIGATIONS (a) "IM1he Consultant shall be responsible for the full and correct performance of the Work required within the time specified herein and any errors therein shall be corrected at the Consultant's own cost and expense. In addition;the Consultant shall indemnify the Town for any costs or expenses attributable to negligent errors in the perl'orrnance of the work of the Consultant. (b) The. Consultant is retained to utilize its expertise in the performance of the work as outlined in its accepted Proposal dated December 17, 2024. (c) The Consultant shall be solely responsible for all labor and services provided for under this Contract. ARTICLE 5. CONSULTANT'S INSURANCIE The Consultant shall not commence work under this Contract until it has obtained all insurance required under this paragraph and such insurance has been approved by the Town. (a) Compensation Insurance: The Consultant shall take out and maintain during the life of this Contract, Workers' Compensation Insurance for its employees to be assigned to the work hereunder. (b) Liability Insurance: 'The Consultant shall take out and maintain. during the life of this Contract such general liability and professional liability (E&O)insurance. The amounts of such insurance are as follows: 1. General liability insurance in an amount not less than $1,000,000 for injuries, including wrongful death to any one person and subject to the same limit for each person, in an amount not less than $4,000,000 on account of any one occurrence. 2. Professional liability (E&O) insurance in an amount not less than $2,000,000.00 per occurrence or claim and $4,000,000 aggregate. The Consultant shall furnish the above insurances to the Town and shall also name the Town as an additional named insured and certificate holder in said policies with respect to liability arising out of services provided by Consultant. ARTICLE,6. DAMAGES It is hereby mutual ly covenanted and agreed that the relation of the Consultant to the work to be performed by it under this Agreement shall be that of an independent contractor. As an independent contractor, it will be responsible for all damage, loss or injury to persons or property that may arise in or be incurred dining the conduct and progress of said work, to the extent caused by the negligence of the Consultant, its agents ojenployees. The Consultant shall hold and .keep the Town free and discharged from any and all responsibility and liability of any sort or kind to the exten/caused by Consultant's negligence. ARTICLE 7. In accordance with the Town's.RFV,groundwater monitoring shall be perforrned.on a quarterly basis,four I events per year)starting in the first quarter of 2025.and through the last quarter of 2027.This equates to a _ total of 12 sample rounds. There are a total of three groundwater monitoring wells to be'sampled on a quarterly basis.As part of each.quarterly monitoring event,depth to water measurements will be collected - relative to a fixed'referenee point and recorded in the field logbook:•The monitoring wells.will'be sampled via low�flow sampling techniques.(500 mUrriin'or less). During the purging, field measurements of pH, temperature;conductivity,turbidity,dissolved oxygen.and•ORP will be recorded using a calibrated water quality meter. Pace.will provide Category B deliverables for all sample analyses. r'Padng Challenges,ProvidingSolations...Since 1965' D&B ENGINEERS AND ARCHITECTS A.Nicholas Krupski Page 2 Department of Solid Waste Coordinator Southold Town Clerk December 17, 2024 TASK.2—GROUNDWATER MONITORING REPORTING Following receipt of all analytical results, D&B will prepare a letter-report that will summarize all completed field activities,present the analytical data for all samples collected and respective conclusions/ recommendations.The report will include,but not be limited to,the following:site background information; a figure depicting all sample and groundwater monitoring well locations; analytical data summary tables and associated analytical data summary; a discussion of the analytical results as compared to applicable standards, criteria and guidelines (SCGs); and conclusions/recommendations based on analytical data results. Sample results will also be provided as a Excel file,and in an EQuIS suitable format(XML).After four sampling events,historical data plots will be included in the'report for each parameter sampled.Based on the fact that the Town currently has completed two rounds of sampling,this will start with the second quarter, 2025 report. The plots shall include each downgradient well, the upgradient mean plus three standard deviations,and the Class-GA groundwater standard. For budgetary purposes,it is assumed that D&B will review and respond to one round of comments received from the NYSDEC.A revised letter-report addressing the NYSDEC's comments will be provided for the - Town's review within 14 calendar days and subsequently finalized so that it may be subsequently resubmitted within 30 days of receipt of the NYSDEC's comments. Specifically, the monitoring programs D&B3' has completed or continues to support includes sampling, analysis, data reduction, and reporting associated with , landfill gas,groundwater,leachate, indoor air,ambient air, soil vapor and surface water. D&B's staff of experienced environmental engineers and scientists are well versed in the evaluation of a wide range of environmental data, including the statistical analysis and assessment of historical trends of specific contaminant levels and the preparation of a wide range of monitoring reports in conformance with New York State Part 360 regulations. In addition _ n to our portfolio of Part 360 assignments, we have also completed numerous environmental monitoring programs at a number of hazardous waste landfill facilities,including data validation and assessment,and report preparation, also in compliance with New York State Department of Environmental Conservation (NYSDEQ Division of Environmental Remediation DER-10 requirements.Overall, 4 D&B has or is supporting over 115 Superfund sites throughout New York State. While this is far from a complete listing of all landfill monitoring projects completed by D&B in recent years,we believe that it provides sufficient detail to clearly demonstrate D&B's competency and experience. z• Baseline and Post-Closure Groundwater Monitoring Program, Sonia Road Landfill, Islip, New York The IRRA retained D&B to prepare a Post-Closure Monitoring Program Sampling and Analysis Plan,which included provision for the preparation of a Health and Safety Plan; quarterly sampling of groundwater monitoring wells; collection of quarterly groundwater level measurements; coordination with IRRA's contract analytical laboratory and IRRA personnel; data validation and analysis, including assessment of historical trends and groundwater flow direction; and preparation of quarterly and annual monitoring reports, and well condition reports. Baseline and Post-Closure Groundwater Monitoring Program, Blydenburgh Road Landfill Complex, Islip, New York This assignment involved the preparation of a Post-Closure Groundwater Monitoring Program Sampling and Analysis Plan; quarterly sampling of groundwater monitoring wells and extraction wells(semiannually starting in 2006); collection of groundwater level measurements; coordination with the IRRA's contract analytical laboratory and their personnel; data validation and analysis, including assessment of historical trends and groundwater flow direction; and preparation of semiannual and annual monitoring reports,and well condition reports. In addition, D&B has supported the IRRA in its attempts to discuss with the NYSDEC and USEPA the possibility of temporarily ceasing the operation of the groundwater extraction and treatment system at the landfill to assess its affect on achieving the clean-up goals established in the Record of Decision. Blydenburgh Road Landfill Complex, Evaluation and Improvements to Landfill Gas Monitoring and Landfill Gas Condensate Management, Hauppauge, New York The assignment included the evaluation of the adequacy of the existing landfill gas monitoring well configuration at the landfill, along with provision for the preparation of plans and specifications, and construction oversight for the installation of 19 additional landfill gas monitoring wells. D&B was also responsible for the investigation and evaluation of existing landfill gas condensate management systems and preparation of contract documents and construction services for the upgrade of the system. Town of Southold Landfill, Landfill Gas Monitoring Program, Cutchogue, New York D&B was retained by the Town of Southold to perform gas �N�4�Z�g Y � 't_". � s u""? x _✓,.�r, { i^ , r t 4`:� 7��iS.�;,5�+��3f���1 monitoring activities at its landfill located on Middle Road (CR 48)in Cutchogue, New York. On a quarterly schedule, D&B obtains physical and chemical data at 15 landfill gas k' monitoring wells situated at the perimeter of the landfill t F,,L,w�'"`t a e«. A, a..., y. f` �.,,..b.• t�*d`y r t. �: mass utilizing a GEM 2000 Plus Landfill Gas Surveyor.The data includes combustible gas (methane) by percent of Lower Explosive Limit(LEL),as well as temperature, oxygen 4� percentage,carbon monoxide and hydrogen sulfide level. The objective of the monitoring program is twofold. r,. First, determine if the methane level in any of the gas monitoring wells exceeds the prescribed action level; and second, identify any possibility that the venting system is not functioning properly which can lead to the potential for landfill gas migration.The results are presented and discussed in a quarterly report, along with an evaluation of the potential for any combustible gas migration and any associated exposure to critical receptors. D&B also performs maintenance and repair of the well network, as needed. As part of this assignment, for example, D&B noted consistently high methane levels in one gas monitoring well. Working closely with the Town, D&B determined that the elevated methane level was not associated with gas migration or a failure of the venting system, but rather due to the improper initial placement of the well by others. D&B is currently working with the Town to address the concerns regarding this well, including the possibility of replacement. Soil Vapor Investigation, Blydenburgh Road Landfill Complex, Hauppauge, New York D&B was retained by the Islip Resource Recoveryw�, Agency(IRRA)to undertake a soil vapor investigations��-�• of the Blydenburgh Road Complex Landfill,located in Hauppauge, New York. This work is being conducted "" `n• in response to a request from the New York State -- � " Department of Health (NYSDOH) and the New York State Department of Environmental Conservation �: "�. •�" (NYSDEC) and will include the installation of eight permanent soil vapor probes to collect soil vapor samples for laboratory analysis. The NYSDOH and TYPICAL CAPPINGDETAII K.. NYSDEC requested this investigation be undertaken in order to provide sufficient data to determine if off-site migration of landfill gases from the Blydenburgh Landfill pose a potential health concern to nearby residential properties.The investigation will be conducted in accordance with the NYSDOH document entitled,"Final Guidance for Evaluating Soil Vapor Intrusion in the State of New York;' dated October 2006. The scope of work includes the drafting of an investigation work plan which is currently being reviewed by the NYSDEC and NYSDOH. Upon approval of the scope of work by these agencies, D&B will proceed with the field investigation which will include the installation of eight permanent soil vapor probes consisting of polyethylene tubing connected to a two foot length of stainless steel screen set at approximately 8 to 10 feet below grade. After installation, each probe will be sampled for volatile organic compounds(VOCs)and methane. In addition, D&B will collect grab samples from the three landfill gas collection systems for VOC and methane analysis. D&B will prepare a report summarizing our findings and recommendations for submission to the NYSDEC/NYSDOH for review and comment. T Part 360 Hydrogeologic Investigation and Operational Monitoring Program Brookhaven Landfill - Cell 5, Brookhaven, New York D&B was retained by the Town of Brookhaven - Waste Management Department to prepare a Hydrogeologic Investigation Work Plan in support of the operation of Cell. 5 at the Brookhaven Landfill. The Work Plan called fora comprehensive investigation and operation monitoring program including the following elements: • Installation of groundwater monitoring wells; • Slug testing; • Geophysical survey; ■ Quarterly and semiannual groundwater sampling; Monthly groundwater level measurements; • Explosive gas survey; • Vector survey; • Leachate seep survey; ■ Coordination with the driller, Town's contract analytical laboratory and Town personnel; • Data validation and analysis, including geochemistry, historical trends and vertical and horizontal groundwater flow direction; • Preparation of quarterly and annual monitoring reports; and • Preparation of Interim and Operational Monitoring Programs and a Contingency Plan. Part 360 Support and Landfill Expansion Brookhaven Landfill - Cell 6, Brookhaven, New York The Town of Brookhaven retained the services of D&B for the development of an Environmental Impact Statement that was successful in obtaining an operating permit for the Cell 6 Landfill Expansion. A scope of work for a Hydrogeologic Investigation was developed and implemented by D&B, involving incorporation of hydrogeologic and analytical data derived for Cell 5 and an evaluation of new groundwater, leachate and surface water analytical data.Other tasks of the project involved development and implementation of the Environmental Monitoring Plan and Operational Monitoring Program for the landfill expansion, The analytical data were validated, presented and evaluated in quarterly monitoring reports, including assessment of the integrity of the landfill liner system and leachate. Town of Oyster Bay Groundwater Monitoring of the Old Bethpage Landfill Clean Fill Area The Town of Oyster Bay retained D&B to conduct an on-going groundwater monitoring program of the Clean Fill Area at the Old Bethpage Landfill. This Town owned landfill is a 72 acre former federal and state superfund listed landfill that has been fully capped.The Clean Fill Area is the area adjacent to the Old Bethpage Landfill that was originally to be constructed as the next phase of the MSW landfill operations plan.The Old Bethpage Landfill was closed prior to beginning operations in this new area and this area was then filled with clean fill. D&B has been tasked with conducting a quarterly monitoring program of the three wells to evaluate potential groundwater impacts associated with the Clean Fill Area.The sampling activities are conducted in conformance with the"Protocols for Sampling Groundwater Under the Old Bethpage Solid Waste Disposal Complex Remedial Action Plan." McKenna Landfill, Town of Albion, New York As part of the operation and maintenance of the McKenna Landfill inactive hazardous waste disposal site, D&B was retained to design and install 12 groundwater monitoring wells and 4 piezometers with the goal of providing a long-term groundwater monitoring well network for the Site. As part of the assignment, D&B completed quarterly sampling of the groundwater monitoring well network, in addition to the collection of surface water and leachate samples on a quarterly basis.All generated data is input into data summary tables as well as graphical displays of the chemical data and groundwater contour maps.All generated data and graphics are submitted to the NYSDEC in annual operations and monitoring reports. These reports also included a summary of the well conditions and recommendations regarding the need for well rehabilitation, if required. Ludlow Sand and Gravel Landfill The NYSDEC awarded D&B with a contract in 2019 to provide Site Management services at the Ludlow Sand and Gravel Landfill in Oneida County,New York.The scope of services includes Site Inspections, Groundwater monitoring of the existing monitoring well network and Gas Monitoring from landfill vents. D&B prepares reports for each Site Inspection and sampling event summarizing the findings,analytical data and recommendations of any maintenance or changes to the sampling program. Lincoln Avenue Landfill, Sayville, NY This closed landfill in'South Holbrook in the Town of Islip occupies approximately 30 acres and was used for the disposal of incinerator ash residue, refuse, non-combustibles, rubbish and demolition materials. The landfill has been closed since the late 1980's.A portion of this site is utilized for the receiving, storage and processing of the Town's recyclables. The Lincoln Avenue (Sayville) Landfill was temporarily designed as a NYSDEC 2a (Site No. 152053) Inactive Waste Site. Following a Phase II Investigation the facility was removed from the State's inactive hazardous waste listing and delisted in October 1993. The Site is bounded on the north by Verterns Memorial Highway, on the east by Coates Avenue, on the west by Lincoln Avenue and the south by a trailer park.This landfill is owned, operated and maintained by the IRRA. The capping and closure project began January 2012 in accordance with NYSDEC requirements. Landfiiling operations at the site ceased in 1978 and the construction of a Part 360 cap was completed in 2013. The IRRA does not have an operating positive gas collection system in place. Instead, gas migration is monitored through a series of PVC,single wells at the north and east perimeter of the site.The south perimeter has a series of PVC monitoring wells along the fence and a series of wells connected by a common header.The west side adjacent to the Multi Purpose Recycling Facility has key monitoring points such as leaching pools, and retaining wall weep holes which are used for monitoring. a SUMMARY OF EXPERIENCE AND.
