MEALY, COUNCILMAN 20 GREG DOROSKI , COUNCILMAN 21 22 23 24 25 FEBRUARY 25, 2025 REGULAR MEETING 2 1 INDEX TO TESTIMONY 2 3 Chapter 219 & Chapter 197 Revisions 3-5 4 SFC for SMB Real Estate Services 5-15 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 FEBRUARY 25, 2025 REGULAR MEETING 3 1 CHAPTER 219 & CHAPTER 197 REVISIONS 2 COUNCILMAN GREG DOROSKI : So the 3 purpose of tonight ' s first public 4 hearing is to consider an amendment to 5 Chapter 219, Shellfish and Other Marine 6 Resources , and Chapter 197 , Peddlers , 7 solicitors , loitering and transient 8 retail merchants , to remove the fees for 9 shellfish permits , peddlers licenses , to 10 provide for the establishment of same by 11 Town Board Resolution . The full tax 12 proposed Local Law is available for 13 review in the Town Clerk ' s office and on 14 the Town ' s website . In the folder here, 15 I have an affidavit signed by our Town 16 Clerk, Denis Noncarrow, that the legal 17 notice was posted on the Town Clerk ' s 18 bulletin board in the back . I have a 19 copy of an Affidavit of Publication and 20 invoice from the Suffolk Times that the 21 legal notice was published there . I 22 have a copy of the legal notice itself . 23 I have a copy of the resolution passed 24 by this Town Board setting tonight ' s 25 public hearing . That ' s what I got . FEBRUARY 25, 2025 REGULAR MEETING 4 1 SUPERVISOR AL KRUPSKI JR . : Thank 2 you, Councilman . Are all the legal 3 notices in order, Mr . DeChance? 4 TOWN ATTORNEY PAUL DECHANCE : They 5 are, Mr . Supervisor . 6 SUPERVISOR AL KRUPSKI JR . : Thank 7 you . All right, so we ' ll open that 8 first hearing . Is there anyone who 9 would like to speak to that first public 10 hearing on that Local Law change? 11 (No Response) . 12 SUPERVISOR AL KRUPSKI JR . : I ' m 13 checking the audience . I ' m seeing none . 14 Is there anyone in the -- there ' s 15 three -- we have three people online . I 16 don ' t see any hands up . Can you read the next hearing, 8 please . 9 COUNCILMAN GREG DOROSKI : Yes . The 10 purpose of tonight ' s second public 11 hearing is the application being 12 considered to transfer 2 . 78 sanitary 13 flow credits to a parcel known by the 14 Suffolk County Tax Map Number as listed . 15 Located at 56025 Main Road, Southold, 16 New York, for the purpose of creating 17 six apartments . Three of which shall be 18 kept affordable by renting at the rate 19 established by the Town Board annually . 20 And leasing to tenants that are income 21 eligible in the Southold Hamlet Business 22 District . The Town Board classified 23 this action as a Type II under SEQRA. 24 An exempt from LWRP review . A public 25 hearing was held -- No . I guess that ' s FEBRUARY 25, 2025 REGULAR MEETING 6 1 the passing resolution . So I will move 2 on to the folder, and then we will take 3 comment . Of the 2 . 78 sanitary flow 4 credits transferred by this action, 2 . 25 5 of the credits are provided at no cost 6 to the applicant for the portion of the 7 project that is to remain affordable in 8 perpetuity . And . 53 of the credits will 9 be provided at a cost to the applicant 10 of $ 6, 360 for the portion of the project 11 that will remain market rate . And I 12 guess that -- yeah, that ' s good for now . 13 All right . Now onto the folder . In the 14 folder here, I have an Affidavit of 15 Posting of the notice and copy of the 16 green return slips that were sent to the 17 adjacent property owners . I have a 18 letter from the Southold Town Planning 19 Board Supporting this , this action . I 20 have comments submitted by the Chief 21 Building Inspector saying that all 22 buildings and uses shall comply with 23 Chapter 117 , 144 and 280 of Southold 24 Town Code . And multiple dwellings are 25 permitted in the Hamlet Business FEBRUARY 25, 2025 REGULAR MEETING 7 1 District . I have an Affidavit that the 2 legal notice was posted on the back 3 bulletin boards . Signed by our Town 4 Clerk Denis Noncarrow . Along with a 5 copy of the ad and invoice from the 6 Suffolk Times . I have a copy of the 7 legal notice itself and the resolution 8 that was adopted by this Town Board 9 setting this public hearing . 10 SUPERVISOR AL KRUPSKI JR . : Thank 11 you, Councilman . Is all the paperwork 12 in order, Mr . DeChance ? 13 TOWN ATTORNEY PAUL DECHANCE : 14 Bear with me one more, Mr . Supervisor . 15 For the record, the hearing file does 16 not contain either the LWRP 17 determination or the SEQRA 18 determination ; however, I will obtain 19 them and make them part of the file . 20 The Board is free to move with it 21 though . 22 SUPERVISOR AL KRUPSKI JR . : Oh, 23 thank you . And we will entertain 24 comments on this proposal . 25 PATRICIA MOORE : It ' s really -- FEBRUARY 25, 2025 REGULAR MEETING 8 1 thank you for hearing this application . 2 My client -- It ' s a long process . We ' re 3 getting close to the end, I hope . My 4 file is about this big and three units 5 are affordable . So it ' s remarkable that 6 property owners are willing to go 7 through the process . So the sanitary 8 credits , the additional credits are very 9 necessary . We thank you for the 10 opportunity to use them. And we hope 11 you will adopt this so that we can move 12 forward . Thank you . 13 COUNCILMAN GREG DOROSKI : Thank 14 you . 15 SUPERVISOR AL KRUPSKI JR . : Would 16 anyone else like to speak? 17 ABIGAIL FIELD : Hi , Abigail Field, 18 Cutchogue . I just wanted to say thank 19 you for moving forward with the 20 affordable units . I thank you for using 21 carefully done transfer of sanitary flow 22 credits . So that it ' s a neighboring 23 property . We ' re not just moving things 24 from one watershed to another . It ' s 25 actually really done right . So thank FEBRUARY 25, 2025 REGULAR MEETING 9 1 you for that because it ' s really 2 important . So I also urge you to pass 3 this , and yay . 4 COUNCILMAN GREG DOROSKI : Thank 5 you . 6 SUPERVISOR AL KRUPSKI JR . : Thank 7 you . Anyone else like to speak? 8 TOM MCCARTHY : Yes . Good evening . 9 I ' m Tom McCarthy, Southold . I ' m here to 10 speak in favor of the transfer of flow 11 credits . We happen to own an adjacent 12 property . I think ( inaudible) worked 13 very hard to get through our system for 14 the permits , and Pat has done a great 15 job, as well . Leading him through that 16 for the permits . One thing I ' d just 17 like to add in addition to these 18 sanitary flow credits , is that we ' d love 19 to be able to see some changes come in 20 the Zoning District, and some of the 21 permissible uses to create buildings 22 like Mark is doing here . But to amend 23 some of the definitions that are out 24 there for perhaps multiple family 25 dwelling or apartment house to allow FEBRUARY 25, 2025 REGULAR MEETING 10 1 units that are less than 850 square 2 feet . And I think Mark has been 3 constrained on that with his 4 application . He ' s made his application 5 concurrent to the present Zoning at 850 6 square feet . We have adjacent property, 7 and we may like to come in and do 8 something that is different with new 9 construction, and the code is very 10 difficult to navigate based on 11 conversion of existing buildings versus 12 creating new structures . And right now 13 I think we ' re handcuffed at a new 14 structure to be deemed to be a 15 multifamily building . It has to be 850 16 square feet or more and it has to have 17 at least three units . I think that may 18 hamper development within the Hamlet to 19 do perhaps some smaller units than 850 20 square feet and to have a mix of unit 21 sizes between affordable and market 22 rate . And I ' d encourage the Board to 23 take a look at that as you progress . 24 And I think that will give different 25 development options , and it will also FEBRUARY 25, 2025 REGULAR MEETING 11 1 give different housing options to 2 members of the community . So I commend 3 you for the transfer of credits . We 4 look forward to Mark having a successful 5 project . We may be back in front of you 6 with something next door, but I think 7 putting the density in the Hamlet where 8 it belongs , is a longstanding tradition, 9 where we ' ve been looking with USUK and 10 many things for many decades . Trying to 11 move the flow into the downtown where 12 the services are . 13 SUPERVISOR AL KRUPSKI JR . : So I 14 have a question for you . You were a 15 member of the original Southold 16 stakeholders ? 17 TOM MCCARTHY : Yes , I was . 18 SUPERVISOR AL KRUPSKI JR . : Okay . 19 Thank you for that . That set the 20 foundation for a lot of this . 21 TOM MCCARTHY : Yeah . There ' s a lot 22 of folks that volunteered for that . And 23 it ' s interesting to see some 20 years 24 later where it ' s really starting to have 25 some teeth . And when we did the work FEBRUARY 25, 2025 REGULAR MEETING 12 1 back then, it was you know kind of these 2 are the goals and the aspirations , but 3 they hadn ' t landed till now . So I think 4 that the Hamlet zones , the Halo zones 5 public water, transfer of flow credits , 6 super offsets unit sizes and all sorts 7 of tools that you ' re bringing into that 8 toolbox will really be , you know, make a 9 positive effect on the community and 10 affordability that we desperately need . 11 SUPERVISOR AL KRUPSKI JR . : Thank 12 you . Once we close the hearing, I ' ll 13 give a plug for our zoning update . 14 That ' s very appropriate for this . Thank 15 you . 16 TOM MCCARTHY : Great . This 14 morning at the work session, Councilman 15 Doroski said it ' s like we ' re building a 16 plane while we ' re flying it . So, you 17 know, we ' ll learn as we go along . We 18 appreciate these efforts to create some 19 affordable housing in the Hamlet . And 20 we certainly look forward for a lot of 21 public participation in the Zoning 22 update . We will be getting comments 23 soon within -- really within weeks that 24 the public would start to take a look 25 through and make recommendations . What FEBRUARY 25, 2025 REGULAR MEETING 14 1 we ' re going to distribute to the public, 2 we want to be clear, is a draft . So 3 we ' re looking for input . 4 COUNCILMAN GREG DOROSKI : And as 5 part of that distribution, the next 6 stage will really be rolling out what 7 the public engagement process looks 8 like . We wanted to make sure the draft 9 was out there . So everyone had access 10 to it and then we will clearly define we 11 spoke about it with the Planning 12 Director today . What we intend the 13 public engagement process to be and we 14 welcome the public ' s comment on that 15 engagement process . If they think that 16 any areas are missing, whether it ' s 17 different, you know, business or trade 18 groups that are worth speaking with, 19 people with different expertise , there ' s 20 been, you know, as you mentioned going 21 back to the Hamlet stakeholders , you 22 know, decades of work to bring us to 23 this point . We want to make sure we get 24 it right, but we do also really want to 25 get it passed by this Board . Because FEBRUARY 25, 2025 REGULAR MEETING 15 1 we ' re kind of at that that endpoint and 2 we really like to get it signed into law 3 by December 31st . So it ' s going to pick 4 up the pace and that public engagement 5 is really important . 6 COUNCILWOMAN JILL DOHERTY : And 7 then the Planning Director did specify 8 we are giving at least three months for 9 public engagement . So we ' re not rushing 10 that .
