Specifically, cutting a vegetated non-disturbance buffer within the -adjacent area to a regulated tidal wetland without NYSDEC permits. Construction of an approximately 30'x 22' patio within the adjacent area to a regulated tidal wetland without NYSDEC permits. These are regulated activities within the Department's Tidal Wetland jurisdiction and therefore, require a permit from the Department. Conducting regulated activities without the required NYSDEC permits is a violation of Article 25 of the State's Environmental Conservation Law. Such violations may be subject to a maximum penalty of$10,000 per day per violation. Resolution: A permanent vegetated non-disturbance buffer shall be created landward of the tidal wetland boundary as per NYSDEC permit 1-4738-02941/00003. At this time, the Department is issuing this warning letter in lieu of further enforcement action against you. We now consider this violation resolved.
