Topic: Temporary Greenhouse
This document provides guidance regarding the construction and use of a"temporary greenhouse".
Article 18 of the Executive Law, known as the New York State Uniform Fire Prevention and Building Code Act, is the
enabling legislation for the Uniform Fire Prevention and Building Code (Uniform Code), which initially became effective
January 1, 1984. Executive Law§ 372 provides the following definitions:
Building: means a combination of any materials, whether portable or fixed, having a roof, to form a structure
affording shelter for persons, animals or property. The word`building"shall be construed when used herein as
though followed by the words "or parts or parts thereof'unless the context clearly requires a different meaning.
The term `building"shall also mean "factory manufactured home"and"mobile home" The term "building"shall
not include a `temporary greenhouse".
Temporary greenhouse: means specialized agricultural equipment having a framework covered with
demountable polyurethane materials or materials of polyurethane nature and lacking a permanent and continuous
foundation which is specifically designed, constructed and used for the culture and propagation of horticultural
commodities. A "temporary greenhouse"may include, but is not limited to, the use of heating devices, water and
electrical utilities, and supporting poles embedded in non-continuous concrete. In no instance will a temporary
greenhouse be used for the retail sale of any farm or non-farm products.
In general, the Uniform Code prescribes"standards for the construction of all bcrildi s or l sses of bailor"ngs„ or the
installation of equipment therein, including standards for materials to be used in connection therewith, and standards for
safety and sanitary conditions." See Executive Law§ 378(1) (emphasis added). Executive Law§ 377 lists as one
purpose of the Uniform Code to:provide reasonably uniform standards and requirements for construction and
construction materials for public and private bui�Idincbs.; including factory manufactured homes, consonant with accepted
standards of engineering and fire prevention practices. (emphasis added). Therefore„ as a"temporary greenhouse"does
not meet the definition of a"building,"the Uniform Code does not regulate the construction of structures that meet the
definition of a"temporary greenhouse."
i The"Code Effective Date"for this Technical Bulletin is October 31,2017,which is the effective date of the current version of the New York State
Uniform Fire Prevention and Building Code(the Uniform Code).
A"temporary greenhouse"does not have to be located on a farm, nor in an agricultural district defined by the New York
State Agriculture and Markets Law.A"temporary greenhouse"may be for personal use or for commercial use; however, it
cannot be"used for the retail sale of any farm or non-farm products."The definition of a"temporary greenhouse" provides
that it is"specialized agricultural equipment having a framework covered with demountable polyurethane materials or
materials of polyurethane nature and lacking a permanent and continuous foundation, which is specifically designed,
constructed and used for the culture and propagation of horticultural commodities." However, neither the definition nor
anything else in the law, requires the"temporary greenhouse"to be dismantled either periodically or at all.

Exemptions from the Uniform Code
This edition of the Code Outreach Program focuses on some commonly asked questions related to buildings and structures that may be exempt
from the New York State Uniform Fire Prevention and Building Code(Uniform Code),or portions thereof.

Executive Law§372 defines a building as "a combination of arty materials, whether portable or fixed, hewing o roof, to form a structure

In addition to the above,there:are se>verM exernpt6ons scattered throughout the Uniform Code that exempt certain kinds of buildings and
structures Mow is a partial list of structures that are exempt„either in whole or in part,from the Uniform Code.Please note that every structure
must be carefully evaluated based on its actual rise to determine if it inects the requirements for any exemptions.
The following types of structures are specifically mentioned in either Executive Law or the Uniform Code as being exempt,either whole or in
part:

The following types of structures pLgjtgg specifically mentioned in either Executive Law or the Uniform Code as being exempt or partially
exempt;however,based on the language provided in Executive Law and the Uniform Code,these structures can be characterized as being
exempt as described below:
• SoI�F,aa al Solar farms that are not associated with a building or other structure regulated by the Uniform Code(to not meet the
def union oft"building„provided above.Only when the solar farm can be considered equipment andlor a system that is an appurtenance
to a building are they subject to the Uniform Code requirements(sce section 1204 of the 2020 FCNYS,for example).Except(Exception
42 in section 503.1.1 of the 2020 FCNYS provides that fire apparatus access roads tatty be exempted or modified foe solar farins Mohave
approved by the fire code official.
• Pond 'I"he Unifonn Code(foes not contain a defintion for"Ponds"and subsequently does not contain coristruc.tion provisions for
t1wm,31te 2020 BC'NY9 and tiro 2020 Resideiutial Codes of NYS contain a definition of a swimming pool,which does not include
"structures,ba,rins,at,chambers"°which are pyre intended for ",,vwninni'ngs,diring of mcrreational bathing"(e.g."koi ponds or drainage
and irrigation ponds).

• Retaining(walls Retaining walls are exempt from the Uniform Code when they do not directly affect a regulated building,a means of
egress or an accessible route.
Additionally.certain buildings such as structures that do not exceed 144 squares feet,and are used as tool and storage sheds,ptayhouscs or
similar uses 01 be exc mpted front the requirement t'br a building permit as allowed by lq NYCRR§I203 f(a)(l).kfaawever,an exemptiotu
fronro the permit requirement docs n2t constitute an exe^niptaun from the Uniform Code. Codes users should examine the local law of the
municipality in which Construction takes place to determine when rya building pen-nit is required.
Note:The above referenced information/exemptions are not intended to apply to any other ordinance,law,or regulation.Being exempt from
the Uniform Code does not exempt these structures from other potential provisions outside of the Uniform Code.Code users should review all
relevant ordinances,laws,or other regulations that may be applicable.
