There are no changes in the project description, plans have been revised per NYSDEC comments to include the following revisions: 1. No disruption to wetlands at any time. 2. All work to be by barge or by hand from the landward side of the wetlands. 3. Entire pier to have 60% thru-flow decking. Please note, the proposed layout for the dock replacement and its extension remains as originally submitted. As stated at the recent public hearing, this dock along with the neighboring dock have been in existence in the same configuration for over 50 years. This not only pre-dates the permit requirements but also provides confirmation that the neighboring property owners are aware of the current configuration and it's remaining as-is. It should be noted, the neighboring dock at 120 Fisherman's Beach Road was recently reconstructed, therefore has a recent permit from this Board to remain in the exact current configuration. Based on the attached, we ask this to be placed on the next available agenda for your consideration. The Board went out to each'site yesterday afternoon and found that the posting was not present nor was the project staked out. Per Glenn, the application is postponed. Regarding the noticing, I will talk to our legal counsel about this and get back to you on if you need to re-notice. If you have a dated/timed photograph of said posting at the time of posting that would be of help. In accordance with Town of Southold Chapter 55-1(copy always included within the hearing package send by your office)this project meets the deadline requirements which states the mailings and signs must be posted for a period of not less than seven days immediately preceding the date of the public hearing. The hearing is February 12, 2025;therefore,the date of mailings and posting are within the requirements of Town Code Chapter 55-1 and is in place for the required seven-day period. Based on this, I ask for further reasoning and clarification as to why this hearing is being postponed. It appears the Chapter 55-1Code requirements and Trustee requirements may overlap.
