PO Box 2124 Greenport, NY 11944 RE: RUSSELL McCALL i TOWN OF SOUTHOLD UNDERWATER LANDS & 11600 NEW SUFFOLK AVENUE, CUTCHOGUE SCTM# 1000-116-6-6 & 116-6-7 Dear Ms. Costello: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, March19, 2025 regarding the above matter: WHEREAS, Costello Marine Contracting Corp. on behalf of RUSSELL McCALL applied to the Southold Town Trustees for a.permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated October 21, 2024,' and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 19, 2025, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, r 2 WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the Southold -Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health', safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees APPROVE the application of RUSSELL MCCALL for a Ten (10) Year Maintenance Permit to dredge a 30' wide channel removing approximately 325 cubic yards to a depth of approximately 1' below Mean Low Water with excavated material to be placed to re-establish previously permitted dike (all within Town owned underwater lands) to close off existing creek inlet, and in an upland area owned by applicant for drainage with dewatered excavated material to be used as beach nourishment; with the condition to use turbidity controls during dredging; all as depicted on the site plan prepared by Costello Marine Contracting Corp., received on February 25, 2025, and stamped approved on February 12, i 2025. That the said Board of Trustees and the Town of Southold are released from any and all damages,or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Pennittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same., 10. No right to trespass or interfere with riparian rights. The Trustees had the opportunity to perform a field inspection with Mr.Jay Tanski of NY Sea Grant program and Mr. Robert Marsh with your office last summer. After some study of the area,and looking at aerials taken over the last few decades,Jay concluded that the natural flow of sand had been compromised to the point where the newly formed sand spit would in his opinion,continue to migrate to the east and north,until such time as the natural mouth of the inlet closes off. It was his opinion that the work as proposed would re-open the creek at or near the historical entrance, resulting in a clean flow of water and nutrients in and out of the creek. Once this entrance is re-established,the new sand spit will continue to migrate to the north until it Joins up with the natural beach. This should re-establish the barrier beach•which will protect the entrance during storms, plus establish a larger bird habitat. Given the pristine condition of the local surrounding areas,the Trustees hope to see a return of piping plovers and terns to this barrier beach. Rob agreed with Jay'' conclusions, noting that the current limited flow of water could be impacting the water quality within Downs Creek. While Downs Creek has limited human development, it is subject to heavy wild animal presence due to the surrounding natural woods of Downs Farm Preserve and North Fork Country Club. It is suspected that there is a heavy infusion of fecal coliform from animals into this body of water. This requires sufficient flushing to maintain the water quality required to support natural vegetation, benthic organisms,vertebrate and invertebrates plus support a fin fish breading ground. The Southold Town Trustees took this information and feedback into consideration with the approval of our ten year maintenance permit to Mr. McCall for environmental dredging. We strongly recommend your consideration of these critical environmental issues in your review of the pending permit application before the NY DEC. Given the current condition of this area as is demonstrated in the pictures below,we believe that it is critical that this project be completed over the next month to support improved water quality. Without this project,it is our fear that the level of oxygen depletion in the warm summer months plus the lack of opportunity for animal waste to be flushed from the water body,will result in a major detrimental environmental impact on Downs Creek.
