Further, the Planning Board wishes to go on record as supporting this change of zone application because: The proposed change of zone is to permit better use and design of the existing Riverhead Building Supply site. The Company proposes a state of the art operation that will include a pick up and pay, drive thru lumber building. The HD designated property (3.5 acres) is less than ideal for residential housing as it is located behind the 7-11 store and next to the tracks and the LIO zone. Further, its small size and poor location prohibits adequate buffering of a dense residential use from commercial uses to the north and west. The Zoning Code currently p~ovides for a 25' landscaped buffer between the Light Industrial/Planned Office Park (LIO) District and the Hamlet Density Residential District (HD) containing the Driftwood Cove cooperative apartments. Change of Zone Petition SCTM No. 1000-46-1-2.1 Greenport, NY Dear Ms. Terry: Asper the your request, we have completed a preliminary review of the above referencedproject. Tasks and completed activities are identified as follows: Review Part 1 LEAF The parcel has been field inspected by Charles Voorhis & Associates, Inc., and the LEAF has been reviewed and amended as necessary. A copy of same is attached. Prepare Part H LEAF The Part II LEAF checklist has been completed and is also attached. Additional information concerning our findings is included below. 3. Environmental and Planning Considerations Background The parcel has been inspected and environmental references concerning the site and area have been consulted. The subject site consists of 3.5 acres located on the south side of NYS Route 25 (Main Road), approximately 170 feet west of Moore's Lane in the hamlet of Greenport. An existing and operational Riverhead Building Supply facility is located immediately to the west of the subject site. The existing facility is located within a "Light Industrial Park/Planned Office Park" (LIO) zoning district and is a pre-existing and nonconforming use in this district with regard to building setbacks. The applicant requests a change of zone on the subject site from "Hamlet Density" (HD) to LIO in order construct and operate an expanded building material storage and sale facility_ Prior SEQRA Actions In review of the file, it is noted that the Southold Planning Board reviewed the subject application on August 27, 1996. The LIO change is in keeping with the commercial 7-11 store to thc north and LIO zone to the west. Environmental Considerations Field inspection and reference review found the following with regard to site resources. The site was inspected and found to primarily contain soils conducive to leaching -- Haven loam. The entire site is generally flat, with slopes less than 2 ~ercent. The northern portion of the site is occupied by old field vegetation including ayberry, cherry, cedar, poison ivy and grape. Species on the central and southern portions of the site include oaks, locust and grape. Based on the age of the trees, it appears that the northern portion of the site was disturbed more recently than the remainder of the site. An aerial photograph of the area taken around 1970 reveals that the site was cleared and used for agricultural purposes at that time. The site is anticipated to support various species of common avian wildlife and small mammals. The elevation of groundwater beneath the site is about 1 foot above mean sea level (msl) and the average site elevation is about 15 feet msl, providing adequate depth to groundwater for leaching systems. According to the North Fork Water Supply Plan map, the subject site is located within the Water Budget Area. However, according to the Nitrate Contamination Areas map and Aldicarb Contamination Areas map, the subject site is not depicted as lying in area an area of high nitrate concentrations (over 8 rog/l) or high aldicarb concentrations (over 9 ug/l). Public water supply is available in the vicinity of the site. The parcels to the north of the subject site along NYS Route 25 are zoned "B General Business" and are established in commercial uses. Several ballfields are located on a large parcel further to the north of the site which is owned by the Village of Greenport. A 7-11 convenience store is located at the northeast corner of the subject site. The parcels to the west of the site are zoned LIO and, from east to west, are occupied by Riverhead Building Supply, Sunrise Coach Lines and Coastal Gas. The Driftwood Cove Apartments, zoned HD, are located on the parcel immediately to the east of the subject site. The southern property lines of the subject site and adjacent lots abut the Long Island Railroad right-of-way. Further to the south of the right-of-way two large undeveloped lots that are primarily occupied by tidal wetlands vegetation. It is important to note that Article 25 of the NYS Environmental Conservation Law (ECL), with implementing regulations of 6 NYCRR Part 661, gives NYSDEC jurisdiction over tidal wetlands and adjacent areas within 300 feet. However, Section 661.4(b)(ii) limits the jurisdictional adjacent area to the seaward edge of existing functional and substantial man-made structures including railroads. Therefore, NYSDEC does not have jurisdiction on the subject site with respect to tidal wetlands. The applicant should secure a letter of no jurisdiction from NYSDEC for submittal to the Town prior to site plan approval. Planning Considerations The proposed change of zone of the 3_5 acre subject site from HD to LIO is not expected to have a significant adverse effect in terms of planning considerations, noted as follows: CHARLES VOORHIS & ASSOCIATES, INC. The size and location of the subject site makes it less desirable for HD residential uses, in consideration of adjacent land uses (including the Riverhead Building Supply facility to the west, 7-11 convenience store to the north and the LIRR tracks to the south) and in view of the inability to provide adequate on-site buffers. The existing Riverhead Building Supply facility is considered to be pre-existing and non-conforming with respect to building setbacks. Approximately 330 linear feet of existing structures on the existing Riverhead Building Supply property are within 5 feet of the common proper~ line with the subject site. The current Town of Southold Zoning Code reqmres a minimum side yard setback of 30 feet in the LIO zoning district, 25feet of which must be landscaped when adjacent to parcels zoned HD. If residential development on the subject site were to occur it may be adversely impacted by the lack of adequate buffering on the adjacent site to the west. The proposed action would permit the expansion of the existing building materials storage and sales use and wouldallow for the better design of the facility, with side yard buffers from adjacent residential sites to the east, allowm!g a more appropriate transition zone. In constderation of site characteristics and surrounding land uses, LIO zoning would permit the highest and best use of the subject site. The proposed action is for a change of zone and further review under the Planning Board site plan review process will be necessary prior to development of the subject site, at which time mitigation measures noted below can be implemented. Although the action was not specifically recommended in recent master plan updates, the action appears consistent with Town comprehensive planning in consideration of site specific issues. Mi[igation Measure5 Certain mitigation measures are available to minimize environmental impact. The subject site does not lie in a Critical Environmental Area, and is not considered to be overly sensitive. However, care should be taken to ensure that adequate separation distances are maintained between sanitary and stormwater structures and the water table. Additionally, it is recommended that such structures should located on the northern and central portions of the site, if possible, to maximize the distance between such structures and the tidal wetlands. The use ofpervious pavement materials such as crushed bluestone or gravel would be preferential to impervious pavement on the southern portion of the site. The Town of Southold Zoning Code requires a minimum side yard of 30 feet and a minimum rear yard of 75 feet. The eastern side yard adjacent to the Driftwood Cove Apartments should remain naturally vegetated and supplemented with vegetation where necessary. Similarly, the rear yard setback should remain naturally vegetated. Consideration should be given to locating the more intense activities away from the Driftwood Cove Apartments. These measures can be addressed by the Plarming Board at the time of site plan review when specific design features are known. CHARLES VOORHIS & ASSOCIATES, INC. The question of whether an action may be significant Is not always easy to answer. Frequent- ly, there are aspects of a proiect that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may be technically e.xpert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the cluestion of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible to allow introduction ol information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Par! 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and .T. ?afl 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely, to be considered small to moderate or whether it is a potentially- large impact. The form also identifies whether an impact can be mitigated or reduced. Thxough inspection and consultation of environmental refi:rences it has been determined that the site does not contain sensitive environmental resources. The proposed action will not set significant precedent, as it represents a unique scenario. The size and location of the subject site makes it less desixable HD residential uses, ha consideration of adjacent land uses (including the Riverhead Building Supply facility to the west, 7-11 convenience store to the north and the LIRR tracks to the south) and in view of the inability to provide adequate on-site buffers. The existing Riverhead Building Supply facility is considered to be pre-existing and non-conforming with respect to building setbacks. The Planning Board recommends a negative declaration for this zone request for the following reasons: Surrounding properties are mostly commercial. Nature of the use will not require large volume of water nor generate large volumes of waste water. The LIO change is in keeping with the commercial 7-11 store to the north and the LIO zone to the west. Further, the Planning Board wishes to go on record as supporting this change of zone application because: 1. The proposed changes of zone is to permit better use and design of the existing Riverhead Building Supply site. The Company proposes a state of the art operation that will include a pick up and pay, drive thru lumber building. 2. The HD designated property (3.5 acres) is less than ideal for residential housing as it is located behind the 7-11 store and next to the tracks and the LIO zone. Further, its small size and poor location prohibits adequate buffering of a dense residential use from commercial uses to the north and west. The Zoning Code currently provides for a 25' landscaped buffer between the Light Industrial/Planned Office Park (LIO) District and the Hamlet Density Residential District (HD) containing the Driftwood Cove cooperative apartments. Is there anyone over here that would like to speak? ALLEN M. SMITH: Members of the Board, Madame Supervisor, my name is Allen Smith. I am General Counsel to Riverhead Building Supply Corporation. For those of you who are not familiar with Riverhead Building Supply, it is a family owned corporation. It is owned by the Goodale family, and has been for a number of years. Present this evening with me, Russell Goodale, who oversees this particular yard for the owner. Mr. Bauer, Jeff Bauer, he is the manager of the Greenport yard. Bobby Goodale is the other brother, that is present, is in charge of management out of the Riverhead office. What you have before you is a modernization or expansion of the Greenport yard. Those of you who grew up around here know it as the Fleet yard. As best we can tell it goes back to the 1930's, and what motivates Riverhead Building Supply being before you is, they feel as many people the hot breath of Home Depot and other operations of that nature, are closing in on them even out here on the east end. So it is the obvious point for the Goodales is that they have to getas efficient, as modern, as competitive, as possible, or face the inevitable arrival of competitors such as Home Depot. As a consequence, if you visit the East Hampton yard or you see the things that are occurring in Southampton yard, or for that matter, are now pending in Riverhead. You see the Riverhead Building Supply is making a great effort to make the yards competitive, and in this particular incidence, the Greenport yard competitive. They employ 1t~ to 15 people in Greenport yard, and they service any number of towns on the North Fork. What you have before you is, as I say, is a change of zone on the property immediately to the east of their existing facility, and I realize that in a change of zone hearing it is not necessary or called out, if you will, to lay out site plan issues, and things of that nature. But, in that this is an expansion of an existing use it might be appropriate hopefully for people to understand what they propose to do, if we put it up for you to see. I neglected to mention, I brought the architect along, so that when I stumble on holding the diagrams, or whatever, he can help me out. In your mind's eye, please, picture the existing yard. It is pretty much as it has been for the last several decades. It is an old wood frame structure, where you go in and wander about to find what you might need, or might not need, or can't find, and the men and women try to help you do the same- That type of an operation if not dead, is dying. What is required now on these metal buildings where both inventory service, all is controlled within the building. There is a retail area front end similar to what you might imagine in such a use. The warehouse runs out behind to the south towards the railroad tracks. It is designed in such a way, this one, and the others, that are being built, such that the person buying material comes with their vehicle and drives through the building. The orders that they have placed for material, when they are given to them, loaded, invoices are given to you, and you exit through a controlled spot, where it is checked to see if you have gotten what you have ordered, and the billing is handled with one big swoop. The, I suppose, important part for those that are concerned about such things is that by buying this parcel from Mr. Aliano, Riverhead Building Supply can modernize it's yard, keep it in Greenport area, but the site is sufficiently sized that the buffer area, that is mentioned in the pg ~ - PH Planning Board report, in the evaluation, environmental impact, can be maintained to the east against the residential property. This is twofold. It is a 25' or 30~ planted buffer with fencing on the particular side, and as you can tell from the site plan that we will present, assuming that you look at this favorable, the entire area essentially from behind, the back of the property is unoccupied by structures.
