GRANT OF ACCESS EASEMENT
THIS INDENTURE made as of the Ca-day of �ec e.��.�` , 2024, by and
between SHEILA STOLTZ AND MURRAY CRAIG STOLTZ, residing at 6 Lee Place,
Bronxville, NY 10708, (hereinafter referred to as "Grantor") and SHEILA STOLTZ, residing at
6 Lee Place, Bronxville, NY 10708 (hereinafter referred to as "Grantee").
WHEREAS, Grantor owns certain lands situated at 1825 Smith Road, Peconic, NY
11958, Suffolk County Tax Map number 1000-098.00-04.00-019.001, more fully described on
Schedule A annexed hereto and made a part hereof(hereinafter referred to as "Grantor's
Property"); and
WHEREAS, Grantee owns certain lands situated at 2025 Smith Road, Peconic, NY
l 1958, Suffolk County Tax Map number 1000-098.00-04.00-019.002 (hereinafter referred to as
"Grantee's Property"); and
WHEREAS, there currently exists a driveway on Grantor's Property that benefits
Grantee's Property (the "Driveway"); and
WHEREAS, Grantor, for good and valuable consideration, is desirous of conveying an
Easement to Grantee over a 459 square-foot portion of Grantor's Property to allow the Driveway
benefitting Grantee's Property to remain in perpetuity so that Grantee can have exclusive,
undisturbed access to and use of the existing Driveway on Grantor's property for ingress and
egress to Smith Road; and
WITNESSETH
1. Grantor does hereby grant, transfer, bargain, sell and convey unto Grantee, in perpetuity,
an Easement of the nature, character, and to the extent hereinafter set forth, over and upon
all that certain parcel of land constituting the southwest of Grantor's Property described in
Schedule A attached hereto("Easement Area"). The Easement Area is more fully
described in Schedule B attached hereto.
2. The nature, character and extent of the Easement hereby granted is as follows:
a. Grantee shall have the exclusive right, subject to the rights of the Grantor, its
successors and assigns as more fully set forth herein, to use, traverse, access,
improve, maintain, and drive vehicles upon said Easement Area comprised of 459
square-feet along the southwestern end of Grantor's property'to Smith Road and
Grantor, its heirs, successors and assigns hereby waive any right to use, traverse,
access or improve the Easement Area without the express permission of Grantee.
b. Said access shall be limited to pedestrian and vehicular traffic.
c. The location of the Easement Area described in Schedule B shall not be
changed without the consent of both parties and their respective
representatives.

d. Any and all costs associated with the use of said Easement shall be borne
solely by the Grantee, and furthermore, the Grantee, in conjunction with use
of the Easement by the Grantee, agree to provide the Grantor with proof of
liability insurance provided for by the Grantee, naming the Grantor, its heirs,
successors and assigns as the case may be, as an additional insured thereon as
the Grantor's interests may appear.
3. This Agreement shall inure to the benefit of, and bind, the parties, their heirs,
successors, legal representatives and/or assigns, and shall run with the land in
perpetuity.

BEGINNING at a point along the easterly side of Smith Road (private road), said point being
also 1,841.80 feet as measured along the easterly side of Smith Road (private road) from the
corner formed by the intersection of the easterly side of Smith Road (private road) with the
southerly side of Indian Neck Road;
RUNNING thence the following three (3) courses and distances through land of Murray Stoltz
and Sheila Stoltz:
(1) South 72 degrees 15 minutes 26 seconds East, 1 1.]2 feet to a point;
