The proposed action has been reviewed by New York State Department of Environmental Conservation
regulation 6NYCCRR Part 617 State Environmental Quality Review, and it is my determination that
pursuant to Part 617.5(c)(16) and(33), and, therefore a Type II action not subject to review.
617.5(c)(16) "granting of individual setback and lot line variances and adjustments,`
61 7.5(c)(33) "adoption of regulations,policies,procedures and local legislative decisions in connection
with any action on this list;"

Re: Local Waterfront Revitalization Coastal Consistency Review for"A Local Law in
relation to an Amendment to Chapter 280,,Zoning, Lot Recognition".
The proposed"A Local Law in relation to an Amendment to Chapter 280, Zoning, Lot
Recognition"has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code. Based upon the information provided to this department, it is my
recommendation that the proposed action is EXEMPT from LWRP review pursuant to § 268-3
Definitions item(L) of the Southold Town Code:
(L). Routine or continuing agency administration and management, not including new
programs or major reordering of priorities that may affect the environment;
Pursuant to Chapter 268, the Town Board shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.
