the last will and testament of Nicholas A. Bacalakis, late of 2090 Bay Avenue, Mattituck, New York
11952,who died on the eighteenth day of August,Two Thousand Twenty-Three,
party of the first part, and
Brenda I. Sill,as Trustee of the Nicholas A.Bacalakis Living Trust,dated August 16, 2023,and any
amendments thereto, of 2090 Bay Avenue,Mattituck,New York 11952,
party of the second part;
WITNESSETH,that the party of the first part,to whom letters testamentary were issued by the
Surrogate's Court, Suffolk County,New York on April 1,2024,and by virtue of the power and authority
given in and by said last will and testament, and/or by Article 11 of the Estates,Powers and Trusts Law,
and in consideration of Ten Dollars and No Cents ($10.00)and other valuable consideration paid by the
party of the second part, does hereby grant and release unto the party of the second part,the distributees
or successors and assigns of the party of the second part forever;
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon
erected, situate,lying and being in the Village of Mattituck, Town of Southold, County of Suffolk and
State of New York,which according to a survey made April 17, 1924 by D.R.Young, Surveyor, of
Riverhead,L.I.,N.Y. is bounded and described as follows:
BEGINNING at a concrete monument set in the westerly side of the road known as Bay Avenue
at the junction of the lands formerly of Charlotte Monje and Florence Mahoney;
RUNNING THENCE South 74 degrees 40 minutes West 308.2 feet along the land of Florence
Mahoney to another concrete monument;
THENCE North 21 degrees 40 minutes West 75.44 feet long the land of Florence Bennett to
another concrete monument;
THENCE North 74 degrees 40 minutes East along the land of Francis St.John Gibbs 307.58 feet
to another monument set in the westerly side of Bay Avenue;
THENCE South 21 degrees 58 minutes East along the westerly side of Bay Avenue 75.51 fees to
the point of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to party of the first part by deed
dated July 23, 1999, recorded in the Suffolk County Clerk's Office on August 3, 1999, in Liber 1198 at

BEING AND INTENDED TO BE the premises commonly known as 2090 Bay Avenue,
Mattituck,New York 11952;

TOGETHER with all right, title and interest,if any,of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances,and also all the estate which the said decedent had at the
time of decedent's death in said premises,and also the estate therein,which the party of the first part has
or has power to convey or dispose of,whether individually,or by virtue of said will or otherwise;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the parry of the first part, in compliance with Section 13 of the Lien Law,covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to receive
such consideration as a trust fund to be applied first for the purpose of paying the costs of the
improvement and will apply the same first to the payment of the cost of the improvement before using
any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
