SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject,non-conforming,8,893.63 square feet, .20 acre irregular shaped lot measures 28.62 feet from the western edge of a 15 feet wide right of way at Peconic Bay Boulevard then running east at a slight angle an additional 88.93 feet along Peconic Bay Boulevard then turning south 67.40 feet along a residentially developed lot then turning west 148.95 feet along two residentially developed lots,to the south, before terminating at the southwestern edge of the same right of way off of Peconic Bay Boulevard and running 75.95 feet north to the junction of the right of way at Peconic Bay Boulevard. The site is developed with a two-story frame dwelling with enclosed porch,two slate patios,a brick patio and two blue stone driveway parking areas(one located off of Peconic Bay Boulevard and the other off of the right of way on the westside of the property) along with a six (6)feet high white vinyl fence along the road frontage to the north and a 4 feet high stockade fence on east and west property lines and a wood rail fence along the southern property line, as shown on a survey prepared by Kenneth Woychuk, Land Surveying,PLLC, and last revised August 19, 2024. BASIS OF APPLICATION: Request for a Variance from Article 111, Section 280-15; and the Building Inspector's October 8, 2024 Notice of Disapproval based on an application for a permit to construct an in-ground swimming pool; at 1)located in an area other than the code required rear yard; located at: 4830 Peconic Bay Boulevard,Laurel, NY. SCTM No. 1000-128-4-13. RELIEF REQUESTED:The applicant requests a variance to construct an accessory swimming pool located in a side yard,where a rear yard placement is required. ADDITIONAL INFORMATION: No immediate neighbors or members of the public spoke in favor of this application at the public hearing. There was one immediate neighbor who phoned in to speak against the pool. There v Page 2,February 20,2025 #7987,Cortapasso SCTM No. 1000-128-4-13 were multiple letters filed against this application in large part based upon the close proximity of dwellings to each other in the area near the subject property. A 15-foot wide right of way, allowing access to several homes south of the subject property, is maintained as part of the parcel and is screened from the residence by a 4 feet high fence. Certificate of Occupancy,#Z773, issued July 12, 1977,covers a Pre-Existing residence built prior to April 23, 1957. The existing front yard setback is 25.8 feet and the existing rear yard setback,off of a porch addition, is 7.7 feet,both non-conforming to current code requirements. When asked if the property owner could construct a code conforming accessory swimming pool,the applicant's agent submitted an alternate plan showing a proposed accessory swimming pool located in the rear yard having a distance of 3 feet from the property line, after the removal of an existing attached and enclosed porch in the rear yard. Applicant's agent stated that this was an option that would need no variance relief and the swimming pool could be built as-of-right. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 6,2025 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance relative to the accessory swimming pool as proposed, will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Peconic Bay Boulevard runs east to west hugging the coastline and is densely developed with a variety of housing styles and sizes located on non-conforming and irregular shaped lots many of which are located off of private rights of way or unimproved roads, in addition to those sited on `the Boulevard' a primary, local thoroughfare. The vast majority of housing was developed in this area between the pre-War era and the late 1960's and many of the homes built were originally summer bungalows or modest residences,many of which have been renovated and enlarged for year-round occupancy. In the immediate vicinity,the predominant style home is a Cape Cod where the second floor consists of rooms located in an attic, often referred to as a 1:5 story residence. The proposed accessory pool located in the side yard will appear out of character with other dwellings in the neighborhood,especially given the very close proximity to Peconic Bay Boulevard and adjacent residential properties. The applicant did not provide or cite any other swimming pools in the area that are located in the side yard, as all other swimming pools are code compliant. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant submitted an alternate proposal to construct a swimming pool in the required rear yard where they would have to remove the existing enclosed porch. This proposal would give the applicant a way to construct an in-ground accessory swimming pool without the need for variance relief. 3. Town Law 4267-b(3)(b)(3). The variance requested herein is mathematically substantial, representing 100 % relief from the code.Furthermore,the applicant has a conforming way to improve their property with the installation of an accessory swimming pool by removing the existing enclosed porch and building the pool in the code required rear yard. Additionally, the as of right rear yard location will also reduce the visual impact of the proposed pool in a non-conforming side yard location by maintaining the appearance of the pre-existing setbacks of the first-floor footprint of the subject dwelling on this small corner lot with two front yards. 4. Town Law 4267-b(3)(b)(4).Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.Numerous neighbors submitted letters of objection indicating that the proposed non-conforming side yard location for an in-ground pool in their neighborhood would set an undesirable precedent since other pools in the area are all conforming to code. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief as applied for is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory swimming pool while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. The applicant is seeking relief from Section 280-15 for the construction of a swimml!fjgol in a side yard at #4830 Peconic Bay Boulevard in Laurel. Swimming pools are customary residential accessory structures, and there are three properties located within 400 feet of the applicant's parcel that are improved with pools, including one located two parcels to the southeast (#4522) and two properties located to the southwest on the opposite side of Peconic Bay Boulevard(#4605 Ⴓ). Although these pools were not constructed pursuant to variance relief, several variances have been granted throughout the surrounding neighborhood for accessory structures located other than in the required rear yard, and numerous variances have been granted for lot line setback relief for both principal and accessory structures. Because like the applicant's property, the majority of the surrounding parcels are preexisting nonconforming undersized parcels for an R-40 zoning district and are constrained by lot width and/or depth, making it especially difficult to locate an accessory in a compliant rear yard location with compliant setbacks. For example, relief has been granted to locate a shed in a side yard at 5206 Peconic Bay Boulevard (Case No. 7244, 2019), and accessory garages have been permitted in the front yard at 5445 Peconic Bay Boulevard(Case #7904, 2024), 6015 Peconic Bay Boulevard (Case #7641, 2022), and 5800 Peconic Bay Boulevard (Case #3160, 1983). The proposed pool requires no setback, lot coverage, or other relief aside from its side yard location. Therefore, granting of the applicant's requested relief for the proposed pool would not create an undesirable change in the character of the neighborhood. Granting the requested relief also would not create a detriment to the nearby properties and arguably would impact them less than if the pool were located in the rear yard because the pool is located more than twice the minimum required setback from the rear lot line to the east and almost 4 times the minimum required setback from the side lot line to the northeast. For instance, as described in more detail below, if the existing enclosed rear porch were removed, a larger pool could be placed in a rear yard location in the easterly corner of the property without variance relief, but where it would be located closer to all three adjacent neighbors to the east. Moreover,the pool and associated patio area would be surrounded by solid 6' high vinyl fencing, and the existing evergreen hedge to the rear of the house would be relocated along with the southerly property line, thus creating both natural and structural barriers around the pool. The fencing would also obscure view of the pool from the northwesterly neighbor across Peconic Bay Boulevard, a relatively heavily trafficked roadway. And the pool equipment would be located adjacent to the porch and could be surrounded with a sound-deadening enclosure if required. Robert E. Due to the size and configuration of the parcel, and the location o?q' & @Wting dwelling, most particularly the rear porch, the existing conditions prohibit placement of a swtftfti%pool in the required rear yard. The only alternative means by which the pool could be located in the kar yard would be the removal of the existing rear porch. Removing the porch to create a rear yard location for the pool would be infeasible for the applicant and non-beneficial for the neighbors, however, because a larger pool could then be constructed in the easterly corner of the parcel where it would be located closer to all three adjacent neighbors to the east. For example, a 14' x 26' pool could be constructed up to 3 feet from both the rear/easterly and side/northeasterly neighbor's property lines, whereas the proposed 12' x 26' pool is located 7 feet from the rear lot line and 11 feet from the side lot line. A pool in the east corner would also be located closer to the adjacent neighbor to the southeast. Placement of the pool in the side yard also creates no potentially additional impacts on the neighbor across the street than would a rear yard location, as in both cases the pool would be potentially visible from the road without screening; and the roadside of the pool would be hidden from Peconic Bay Boulevard by 6' high vinyl fencing between the pool and existing driveway. For these reasons, the proposed pool in a nonconforming side yard is not only the most feasible and reasonable means of providing the benefit of a swimming pool, it is the least impactful,particularly relative to a potential conforming rear yard location. 3. The requested relief is mathematically substantial because placement of an accessory structure in a nonconforming side yard location is typically considered to require 100 percent relief. However, the relief is not substantial in fact because as described in detail above, the pool as proposed is located more than twice the minimum required setback from the rear/easterly neighbor; almost 4 times the minimum required setback from the side/northeasterly neighbor; and farther from the southeasterly neighbor than would be a pool located in a conforming rear yard if the rear porch were removed to create such a location. The existing site conditions thus create an opportunity for the Board to grant relief for a nonconforming pool location where a conforming location would be more impactful on the surrounding property owners. 4. Granting of the requested variance relief would not have adverse impacts on the physical and environmental conditions of the property or surrounding neighborhood for the following reasons: a. As applied for the proposed improvements will be located with a front yard setback, on the second floor, of 23.8 feet and a rear yard setback of 15.7 feet. The proposed second floor addition is two feet wider on both the front and rear facades than the existing first floor footprint of the residence which was built prior to zoning. The applicant also seeks a variance for an `as built' six feet high fence in the front yard where the code limits such improvements to a maximum height of 4 feet. ADDITIONAL INFORMATION: No immediate neighbors or members of the public spoke in favor of or against this application. A 15 feet wide right of way, allowing access to several homes south of the subject property, is maintained as part of the parcel and is screened from the residence by a 4 feet high fence. Certificate of Occupancy, #Z773, issued July 12, 1977, covers a Pre-Existing residence built prior to April 23, 1957. The existing front yard setback is 25.8 feet and the existing rear yard setback, off of a porch addition, is 7.7 feet, both non-conforming to current code requirements. An on-site waste water plan was not provided, nor was there any indication as to the definitive location and size of the existing septic system, servicing the two-bedroom house. No interior work is proposed for the first floor of the residence, although one of the bedrooms will be converted to a `office' and the applicant's agent indicates the scope of the project will not be a demolition. AMENDED APPLICATION: During the public hearing testimony was offered that the 6 feet high white vinyl fence running along Peconic Bay Boulevard, and located in the front yard, was installed without the benefit of a variance by a prior owner and that the applicant had no knowledge of any limitations relative to fencing. The applicant also shared that by maintaining the existing fence, it helped to Iimit road noise and car lights into the subject property. The applicant, upon learning of the need for a permit and a variance for the fence, promptly requested and received an amended Notice of Disapproval dated March 14, 2019 from the building department to include the non-conforming fence height as an additional variance in this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 14,2019 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance relative to the"as built" 6 feet high fence located in the front yard will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties as it has been there for many years and is partially concealed by berms and landscaping. However, grant of the variances relative to the additions and alterations, as proposed, will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Peconic Bay Boulevard runs east to west hugging the coastline and is densely developed with a variety of housing styles and sizes located on non- conforming and irregular shaped lots many of which are located off of private rights of way or unimproved roads, in addition to those sited on `the Boulevard' a primary, local thoroughfare. The vast majority of housing was developed in this area between the pre-War era and the late 1960's and many of the homes built were originally summer bungalows or modest residences, many of which have been renovated to meet modern standards and tastes and year-round occupancy. In the immediate vicinity, the predominant style home is a Cape Cod where the second floor consists of rooms located in an attic, often referred to as a 1.5 story residence. The applicant's proposed renovation is for a full second story addition on top of the existing one-story dwelling, with two-foot overhangs on both the front and rear elevations and dormers that run the length of the residence. Zoning Board of Appeals 2. Town Law U67-b(3)(b)(2). The benefit sought by the applicant for the as built fence can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant can remove the existing fence and plant evergreen screening along Peconic Bay Boulevard to deflect road noise and shield the residence from road traffic and light or install a code compliant 4 feet high fence. However, the fence is partially concealed by existing landscaping and the undulating topography of the subject property which visually reduces the appearance of the fence,which has existed without incident for many years. The benefit sought by the applicant for the proposed second story addition cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The pre-existing footprint of the one-story dwelling has non-conforming front and rear yard setbacks, so any second story addition will need variance relief. However, the degree of proposed relief can be reduced by maintaining the pre-existing non-conforming setbacks of the as built dwelling's footprint. 3. Town Law &2674(3)(b)(3). The variances granted herein are mathematically substantial, representing 100% relief from the code relative to the installation of 6 feet high fence in a front yard and 32% relief from the code relative to the front yard setback and 55% relief from the code relative to the rear yard setback. However,the 6 feet high fence has been in place many years without incident or complaint and the benefit to the applicant outweighs any detriment to the neighborhood along Peconic Bay Boulevard. Although the alternative relief for the non- conforming front and rear yard setbacks granted herein are still substantial, it will reduce the visual impact of the proposed second story addition by maintaining the pre-existing setbacks of the first-floor footprint. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law U67-b. Grant of the variance relative to the 6 feet high fence in the front yard is the minimum action necessary and adequate, to enable the applicant to enjoy the benefit of an as built fence in a front yard. There would be the potential for significant loss of privacy due to the close proximity. There would also be a significant increase in noise level from people using the pool and pool parties. This would be especially problematic during night time hours as additional lighting would be required. All this will detract from our ability to enjoy our home. Potential for Water Runoff and Drainage Problems. The Cortapasso's property and potential pool is at a higher elevation then our house and patio. Rainwater runs off onto our property near the house and has already caused problems. We are concerned that the proposed pool and and surrounding structures will exacerbate the problem as less rainwater is absorbed into the ground and more runoff toward us. Additionally, given the pools close proximity,there is a risk of spillage or leaks from the pool which could damage our house and yard. Safety Concerns. i We have 12 grandchildren, all under 8yrs. of age, who spend time with w,�ing the summer. This new structure will be an attractive nuisance. Adequate space between a pool and adjacent property is crucial to minimizing risk. All it would take is for one of the children to slip through the hedge, enter the pool area and, God forbid,the gate would be open. The space selected it too small for a pool, too close to already standing structures, and not in compliance with Zoning Rules. Due to the proximity of the pool to adjoining properties and how noise travels in the colony, my wife and I are not in favor of the pool being installed. I grew up running around the colony freely. Having kids of my own, and many nieces and nephews I am also concerned with how close the pool will be to small children enjoying their summer in the colony. As previous owners of this property, we are intimately familiar with it's size and topography and its potential impact on the surrounding neighborhood. In addition, as former pool owners at a different location for over 25 years, we have a great deal of knowledge about various issues of pool maintenance. The immediate adjacent neighborhood to the proposed project is Bay Oaks, consisting of nine residences owned by generations of the same families. Children and grandchildren roam freely through the community especially during the summer months. A swimming pool in such close proximity would be a virtual magnet to attract the attention of children, especially those too young to realize the potential danger. We have learned it is virtually impossible to prevent small children from finding a way to enter a pool area despite the required fencing. In addition, the proposed site is at a higher elevation than much of Bay Oaks. Water drainage has always been a problem after significant rainfall. The addition of a pool and decking would further reduce the remaining surface area on the property for water to naturally drain thus increasing the runoff into Bay Oaks in general and onto our property in particular as the lowest elevation in the community. As former pool owners we are also aware of several downsides. The pool motor pump which runs several hours per day produces a significant amount of noise which would only be amplified by existing structures and proposed fencing and create a neighborhood disturbance. Pool filters need to be frequently 'backwashed' to remove particles trapped in filter. This involves-reversing the flow through the filter and disposing of many gallons of chlorinated water (usually onto an unused portion of property such as a drainage ditch or sewer.) We are concerned that the proposed dry well would be insignificant for such a large volume of chemically treated water Pools are generally equipped with bright lighting for night usage i which'would diffuse u ward` i"t�'reflect quite a distance. With up1mitation on hours of p usage, disruptive noise levels could persist well into the night. Both of these would cause nighttime disturbance for neighboring homeowners. "Bay Oaks," which borders this property, is a well-established, quiet, neighborhood where the children and grandchildren of the residents play. Each neighbor is considerate of others when it comes to noise and light disruptions.. A pool in this location could not only be a danger to young curious children who might wander into it, but also it could disrupt the other homeowners. Sound carries. Particularly people screaming in a pool, over the constant hum of electrical pumps. Upon closer examination, a pool at this location doesn't comply with the town's current zoning laws and the supporting survey is missing key details. To start, the dry well calculation for the pool drainage appears to be missing, as per 275- 11(5). There will be run-off since this design doesn't allow for drainage. The water will run into the private road from Peconic Bay Boulevard, which already has drainage issues. Overall, there is no zoning chart that shows existing, proposed, and required site conditions. The average person cannot interpret the zoning ordinances from a survey. With some research, it appears the lot isn't large enough to accommodate a pool, according to the town guidelines: - The lot size is 9147 square feet (existing). The required size based on the zoning code is 40,000 square feet. - The required lot width is 150 feet. The lot at 4830 Peconic Bay Boulevard has widths of 88.93 feet and 148.95 feet. - The lot depth for a pool requirement is 175 feet.
