SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief,.permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, rectangular-shaped, non-conformingl2,565 square feet, .288 acre parcel located in the R40 Zoning District measures 100.44 feet along Main Street, more popularly known as New Suffolk Avenue,then runs north 125.00 feet along Fourth Street,then runs west 100.62 feet along a residentially developed lot to the north,and returns 125.00 feet along a second residentially developed lot to the west. The property is developed with a 2-story wood frame house with covered front entry porch, stone walks, stone patio, outside basement access stairs, a gravel driveway with Belgium block curbing, an inground swimming pool with stone coping, pool filter equipment and pool heater and fencing as shown on the survey prepared by Nathan Taft Corwin, III, Licensed Land Surveyor and dated June 18,2023. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124; and the Building Inspector's September 27, 2024 Notice of Disapproval based on an application for a permit to construct a porch addition attached to an existing single family dwelling; at 1) construction located less than the code required minimum primary front yard setback of 35 feet; 2) existing accessory swimming pool located in area other than the code required rear yard; located at: 16615 New Suffolk Avenue,New Suffolk,NY. SCTM No. 1000-117-8-2. RELIEF REQUESTED: The applicant requests a variance for the addition of a covered side entry porch measuring 4.83 feet by 10.66 feet, 51.48 square fret, on the west side of their residence accessible from the driveway with a front yard setback of 10.75 feet where the code requires such improvements to have a minimum front yard setback of 35 feet. Additionally, as a result of alterations to a non-conforming residential structure, and as a result of the home being burdened with two front yards, the applicant is required to obtain additional relief for a legally existing in-ground swimming pool-in a front yard location where the code requires such improvements to be in a rear yard location. r Page 2,February 20,2025 #7981,Bopp SCTM No. 1000-117-8-2 ADDITIONAL INFORMATION: This application was originally submitted by a prior owner. The property transferred on June 30, 2023 as evidenced by copy of a Bargain and Sale Deed and copy of a NYS Department of Taxation and Finance Real Property Transfer Report as provided by the current applicant. The applicant provided the following Certificates of Occupancy covering improvements on the subject parcel: #Z-30292 dated July 8,2004 covering a Pre-Existing one family dwelling with covered porches #Z-30291 dated July 8,2004 covering `as built' addition to an existing residence #Z-44225 dated June 28,2023 covering an accessory inground swimming pool fenced to code #Z-44226 dated June 28,2023 covering additions and alterations to an existing dwelling The applicant provided copy of an open building permit, #51092 dated August 21, 2024 for the installation of an accessory pool house as applied per SCHD approval. The accessory pool house is proposed to be sited in a conforming location and as such, does not require review by the Zoning Board of Appeals. Construction has not yet begun on this appurtenance. The applicant provided architectural plans labeled A-1 through A-5 prepared by Jennifer L. Shoukimas, Registered Architect, dated April 23, 2024, containing general notes, construction details, site plan and sky plane calculations, exterior elevations,,and detail section and plans along with pool and fencing plans labeled page 1-3 prepared by Joseph Fischetti,Jr, Licensed Professional Engineer, and dated November 10,2021. No member of the public or an immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 6,2025 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: L Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The hamlet of New Suffolk, like the subject property, is one of the oldest existing developed parts of the Town of Southold and contains many homes, built prior to zoning that have less than compliant front, rear, side or combined setbacks. Entry porches are consistent with the character of this neighborhood and exist to shield occupants from adverse weather conditions and to add architectural interest to homes. As proposed the addition of a covered side entry porch setback approximately 18 inches from the street fagade of the house and with a front yard setback of 10.75 will not impact the community in anyway. The house, as it presently exists, has a full front entry porch running parallel to the same roadway with a similar setback. Other homes in the immediate vicinity also have front or side entry porches. Furthermore, as a result of the addition of a side entry porch to the residence, the legally existing inground swimming pool is acknowledged to be in a non- compliant location, however, because it has a correctly obtained Certificate of Occupancy,there is no impact on the adjacent neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The Pre-Certificate of Occupancy #Z-30292 indicates that this home was built prior to the adoption of zoning and as such,almost any additions or alterations to the exterior of the residential structure will require some form of variance relief. Likewise, the inground swimming pool is acknowledged to have a certificate of occupancy and cannot be relocated without great expense and unnecessary disruption to the property owner and community at large. J Page 3,February 20,2025 #7981,Bopp SCTM No. 1000-117-8-2 3. Town Law 6267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 69.3% relief from the code relative to the proposed side entry porch and 100%relief from the code relative to the inground swimming pool located in a non-compliant location.However,the applicant proposes to setback the side entry porch approximately 18 inches from the street fagade and also,does not propose to enclose the roofed over entry. A porch is consistent with the character of the immediate neighborhood and is a useful feature to any residence within the Town of Southold and the swimming pool legally exists as evidenced by the Certificate of Occupancy covering its construction. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 6267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 6267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a covered side entry porch measuring 4.83 feet by 10.66 feet, and further acknowledging the existence of the installation of an in-ground swimming pool with a Certificate of Occupancy while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Planamento,seconded by Member Lehnert,and duly carried, to GRANT the variances as applied for, and shown on the site plan and architectural plans labeled A-1 through A-5 prepared by Jennifer L. Shoukimas,Registered Architect, dated April 23, 2024. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The proposed covered side entry porch and the pre-existing front porch may not be enclosed in anyway. 2. The proposed covered side entry porch may only contain basic electricity for ambient lighting. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appealsfailure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity, provided de minimis relief is requested within one year of the date of this decision. Any time after one year,the Board may require a new application.
