The Town of Southold Board of Trustees reviewed the pending application for Suffolk County Energy Storage II LLC,
located at 69430 Main Road, Greenport, and conducted a field inspection on March 10, 2021 as requested by the ZBA.
This Board recognizes the importance of strengthening the power grid, but we ultimately must make
recommendations based off environmental concerns specific to Town Code Chapter 275 Wetlands and Shoreline.We
will address any specific concerns once we have an application,before.us.
Based off of our initial review of the pending application before the ZBA and our field inspection,the Trustees have the
following comments:
1. Support the condition of establishing a minimum 50-foot-wide non-disturbance buffer.We would request the
most extensive buffer possible for this project.
2. Establish a project limiting fence on the landward side of the proposed non-disturbance buffer to protect against
encroachment of the buffer and wetlands.
3. Planting of native species of tree on the seaward side of the proposed fence to enhance native habitat and
protect wildlife.
4. The applicant should include plans depicting appropriate containment for the battery storage to prevent any
leakage into the wetlands in the event of facility failure.
5. The applicant should consider raising the elevation of the proposed structures to account for rising sea levels
and to mitigate against potential future storm damage.
These are the recommendations of the Board of the Trustees to the ZBA at this time.While we cannot make any official
judgement until an application has been submitted to the Trustees,we hope these comments contribute to any ZBA
determination.

Thank.you for referring the above mentioned application to me for review-and comment.
The subject property is located within an environmentally sensitive,area and'the'preservation
efforts,by many entities reflects this. Years of preservation efforts have resulted.in-over 325
acres.in the immediate area being permanently preserved for purposes.of open space .
preservation and public'access.-Numerous public and private entities, including Federal,'State,
County;Town;The Nature Conservancy and the Group for the East End; have contributed.to
this effort, spending over 12:7 million,dollars to acquire and improve these properties for open
space purposes and public access.
The subject property-shares two,boundary lines with County parkland which is part of the-160'+
acres of preserved lands known as the Pipes Cove Preserve.The subject property is across the
street from 165+ acres of preserved lands known as Arshamoma:que Preserve: Many of the.
properties within the Pipes Cove Preserve have similar zoning designations (LI and LIO) as that
of the subject property, establishing precedent for preservation of properties within all zoning
districts in this area.
The subject site,and other properties in the immediate area, are included on numerous lists for
potential preservation, including the Town's Community Preservation Plan, Suffolk County's
Open Space Master List,.the DEC's Open Space Plan and the Peconic Estuary Partnership Critical
Lands Protection Strategy. Preservation efforts in this area have been ongoing for years;and it
is expected that preservation will continue in this area.
The Land Preservation Committee reviewed the proposal for the subject site. The Committee
hopes that a less environmentally sensitive site, and one outside of an area of such significant
existing and potentially future preservation efforts, can be found for this proposed use.
Maps showing the extent of preservation in the area are included with this memo.

John Sepenoski, GIS Technician/Land Management Coordinator, has provided information
pertaining to the significant Bay to Sound Project in the immediate area. The Bay to Sound
Project encompasses lands adjacent to, and in the vicinity of;the subject parcel. New public,.
trails:were established in this area and opened to the public in 2018. One such public trail is
approximately 100 feet from the boundary Of the subject property and the subject property is
visi:ble`from multiple locations along.the trail. The incremental process of purchasing fands in
thisarea started years ago.The steps to make these lands'available for the public'to access:and
enjoy is an ongoing long-term;project. Current and past.partners involve.d.with the Bay to
:Sound'Project have included Town, County; NY State,-Greenport Village, Peconic Estuary .
Partnership, Group.for the East End, Boy�SOuts,Audu bona nd volunteers from the general
public.The Project has involved several phases of grant funding,totaling over.$410,000.

The subject'site is environmentally sensitive, adjacent to;and.interconnected with the adjacent
preserved lands.John Sepenoski has pointed out that:
Parcel Is bounded on two sides by Suffolk County parkland that includes a public trail an is part - --- -of the Bay to Sourid Trails project.
• Public trail is approximately 100 feet from the boundary of the parcel.at its closest.
• Current structures on the parcel are visible from multiple locations along the public trail over an
.approximately 550 foot section of the trail, proposed structures would be visible too, unless.
screened.
• :°Approximately one half acre of the parcel is within a NYS DOS designated Significant Fish:&
Wildlife habitat.,
• Approximately one quarter acre of the�property is mapped as freshwater wetlands.
• The entire parcel is within the NYSDEC freshwater wetland check zone, indicating that it should
be checked for additional wetlands.
• The bulk of the parcel is currently mowed as lawn. Within 800 feet of this location a similar
lawn area that was no longer mowed after the Town purchased it naturalized with wetlands
vegetation without the Town planting anything,the same would likely occur on this parcel
indicating that there are potentially additional wetland areas on this parcel.
• Based on proposed coverage of the parcel,stormwater runoff will be significantly increased
compared to current conditions.
• Based on NYS DEC wetlands delineation conducted for the Bay to Sound project,there are
additional wetland areas on the_County parkland not shown on the DEC wetland map but within
the check zone that could be impacted by run off from this parcel.
• The parcel currently drains to;two wetland areas on the adjacent County parkland. One of these
areas flows into a tidal pond connected to-Pipes Creek via a culvert under Pipes Neck Rd.
• The Town,The Nature Conservancy and the Peconic Estuary Partnership are currently
investigating changes to the culvert noted above designed to restore the tidal pond and
adjacent areas to reduce the invasive phragmites present on the County parkland.

• Began in 2007
• Work has been conducted on Town, County and Village preserves and parks in the Greenport
area
• Current and past partners include the Town,County, NY State,Greenport Village, Peconic
Estuary Partnership, Group for the East End, Boy Scouts,Audubon and volunteers from the
general public
• Funding:
o Phase 1 funded in 2008 by NYS DOT$72,000 and Suffolk County$35,000 with the Town,
Group for the East End, Boy Scouts and Audubon providing$52,000 of in-kind match
including over 530 hours of volunteer time
o Phase 2 funded in 2016 by NYS DOS LWRP grant for$245,000 matched with the Town
providing$245,000 with the acquisition of the Sill property

I. Project Introduction
Suffolk County Energy Storage II,.LLC ("Applicant") proposes to develop the Suffolk
County Energy Storage battery energy storage system (BESS), hereinafter referred
to as the "Project" in the Town of Southold (Town), Suffolk County, New York:.
The Project will interconnect to the Long .Island Power Authority's (LIPA). existing
8J Southold Electric Substation. The Project is considered a "public utility" use
in . the Light industrial (LI) District, permitted by Special Exception _granted 'by the
Town Zoning Board of Appeals:
Applicant is a wholly-owned subsidiary of Savion, LLC ('Savion"). Savion is owned by
Macquarie Group's ("Macquarie") Green Investment Group ("GIG") and. is one of.the,
Country's most experienced utility-scale solar and energy storage development teams,
with a vision for the transformation of the .Country's electricity supply to. renewable
sources. The Savion team has developed over 11 gigawatts ("GW") of solar and energy
projects across 25 States that are either operating, in construction, or 'are
contracted. Savion. is based in .Kansas.City, Missouri with 110 employees.
Macquarie_ is a global: provider of banking, .financial, advisory, investment and: funds
management services. Founded in.1'969;'Macquarie employs over 14 800'people and..
has assets under"management of more than.$307 2 billion (as of September 30, 2018)
1n the Americas-region, Macquarie has approximately 2,700 staff.
The GIG is a specialist in.green infrastructure principal investment, project delivery_and
the management of portfolio assets, and related services. Its track. record, expertise and
capabilities make:it a global: leader in green investment, dedicated to supporting the
growth of the global green economy. The business was launched initially by.the United
Kingdom Government in 2012 as the:.first institutiorrof its type in the world. It was acquired
by Macquarie in 2017, creating one of Europe's largest teams.of dedicated .green
infrastructure investors,,and now operates globally.
The proposed Project is.located at 69430 Main Road/NY25 within the. unincorporated
hamlet of West Greenport in the Town of Southold on a..2:023-acre Lot currently under
rural residential use and inclusive of one (1) occupied residential structure and two (2)
unoccupied outbuildings that will be removed prior to commencing construction activities.
The Applicant is seeking Special Exception approval from the Town's Zoning Board of
Appeals.with this Application's submission pursuant to Town Code Chapter 280 Zoning
Article XXV Special Exception Uses. The Project'. completed Special Exception.
Application form is included in Attachment A. The Project has been engineered to meet
all applicable Town Code requirements.

The .Project- is proposed an up to 79.85MW/69kV, subject to LIPA-PSEGLI
(Public Service Enterprise Group Long Island) and New York Independent System

Operator Inc. (NYISO) interconnection reviews and approvals, capable of powering
28,746 homes for up to 8 hours. The BESS' primary role will be to charge from OPA's
8J Southold Substation at night and be available to discharge to LIPA's 8J.Southold :
Substation during East End peak electric demand times (mornings and afternoons/
evenings), and will, be 'capable of providing other electric` grid services such as
frequency regulation and voltage control, as well as emergency backup power.
The Project facilities will consist of battery:enclosures, which contain: racks of lithium
ion' batteries (similar to what . are in 'our portable phones and electronics);
inverters,.which convert electricity from. AC (Alternating Current)-to-DC (Direct
Current) when charging from LIPA's. 8J Southold Substation and DC-to-AC when
discharging to LIPA's." 8J Southold. Substation; transformers, which "step up an,d
"step down" the system voltage; .Heating, Ventilation & Air Conditioning (HVAC)
cooling systems (batteries generate. heat when charging and discharging); control
instrumentation; and, electric grid interconnection switchgear for the 13/69kV .
(kilovolt) interconnection, which provide switching( and protection•to the BESS's
electrical systems; and the Project's interconnections to both LIPA's "existing

During the:.Project's planning and.siting, the -Applicant has worked closely with_ the
landownerand Town officials. Applicant had,a sketch plan meeting on August 12, 2020;.
with Town,officials: The Applicant. provided the officials with .a Project -Description
Package prior to.the meeting that presented, generally, the Project's LIRA-driven need,
including its overall design and components to help the Town inform.the Applicant of the
Town's applicable Land Use, Code and Permitting requirements prior to the Applicant's
submittal of this Application. The involved Property owner has authorized'the Applicant
to seek all Site-related permitting on its behalf (Attachment C: Agent Authorization
Form): The Agent/Representative Transactional Disclosure. Form is. included as
Attachment D.

II. Town of.Southold Code Compliance
The proposed Project, which is the subject of this Special Exception Application includes
Project Facilities compliant with applicable provisions of the Town of Southold Code Part
II, General Provisions Chapter 28G Zoning,-with the following setting forth the Special
Exception criteria pursuant to Articles XV: Light Industrial District and XXV: Special
Exception Uses. Portions of the Code are emphasized in.bold and italics to facilitate
Zoning Board of Appeals review.
Article.XV Light Industrial (LI) District'
§280-69Purpose.
The-purpose of the Light Industrial (LI). District is.to provide an opportunity for
business and industrial uses on smaller lots than would be appropriate.for.the LIO
Light Industrial Park(Planned Office Park District.
The proposed BESS Project is located on.a 2.023-acre parcel.within the Light Industrial
LI District.
280-62 Use regulations.
.Ln the.Ll District, no building or.premises shall be used and.no building or part of a.
building shall be erected or altered which is.arranged; intended or designed to be
used,in.whole or in part, for any purpose except the,folloWi

The BESS. Project will interconnect to the Long Island Power Authority's (LIPA)'existing.

§ 280-63 Bulk, area and parking regulations:

Bulk Schedule and Parking and Loading Schedules incorporated into this chapter
by reference, with the same force and effect as if such regulations were set forth

The Project is not anticipated to require any off-street parking or loading areas and -
therefore, the Bulk Schedule and Parking and Loading Schedules included in Town Code
§ 280-78 and 280-79-are not applicable.
§ 28&.64 Front yard setbacks.
A. Structures.shall be set back at least 100 feet from the right-of-way.
The Project is currently anticipating the need.for Zoning Code Setback Variances. The
Applicant.is committed to working with the Town's Planning Department, Planning
Board and.Zoning.Board of Appeals on.the Project's required Setback Variances prior
to seeking TownSite Plan approval through its Land Use Application submittal at a later
date.
B. There shall be an exception to Subsection A if the adjacent parcels are `
developed, in which case the minimum front yard setback shall be the average of
the setbacks of the adjacent parcels. .

to seeking Town Site Plan approval through its,Land Use Application submittal at a later
date..
Article.XXV: Special Exception Uses
§280-142 General standards.
No'special exception approval shall be granted unless the Zoning Board of Appeals
'specifically finds and determines the following:
A. That the use will not prevent the orderly and reasonable use of adjacent
properties or of properties in adjacent use.districts.
The Project will be subject to Town Planning Board"and Building Department review-and
approval for compliance with prevailing and.applicable State, County and Town..Codes:
In addition, the Project will not impact.any existing COMM unity,.visua1, transportation; air,
or water resources:
B. That the use will not.prevent the oralerly and reasonable use of permitted or...
legally established uses in the distract wherein the.proposed use is to'be located
or of permifted or legally established uses�n adja.cent use districts.'
The Project will.be.serving a public utility.function'to'.erhance LIPA's electric grid
reliability. The Project is compatible with.all such established uses.
C. That the safety, the health, the wdlfarel the comfort;the convenience or the
order of the Town will not be'adversely affected by proposed use and its
location.
The Project will be serving.a public-utility function to'enhance LIPA's local electric grid
reliability; and therefore; the Project enhances the Town's safety, health, welfare, .
comfort and convenience.
D. That.the use will be in harmony with and promote the general purposes and
'intent of this chapter.
The Project,is.in harmony and promotes the general purpose.of Town Zoning Code
§ 280-142. The Project is located within the Light Industrial'Ll Zoning District, where
public utilities are permitted by Special.Exception granted by the Town's Zoning Board
of Appeals.

E. That the use will be compatible with its surroundings and with the character of
the neighborhood and of the community in general, particularly with regard to
visibility, scale and overall appearance.
The Project is compatible with adjacent commercial and industrial development located
to the west, north and northeast. Undeveloped land is located east and southeast of the
Project.. A New.York State Department of Environmental Conservation (NYSDEC)
mapped wetland is located on northeast portion of the Site. As confirmed in Attachment.
B: Conceptual Site Plan, this wetland will be avoided by.the Project, and existing
vegetation along the southeast, southwest and northeast Project boundaries will be
maintained thereby minimizing.visual impact to adjacentrproperties.
F. That all proposed structures, equipment and material shall be readily
accessible for fire and police protection.
The Project will be engineered, procured and constructed subject to the Town Fire
Marshall's review and approval.
G. That the proposal complies with the requirements of Chapter 236,5tormwater
Management, or in the alternative, the Zoning Boaral.af Appeals:shall condition
such approval on compliance with the:requirements of Chapter 236; $tormwater
Managerri ent.
Prior to commencing any Project.construction.activities, a Construction 'and Operation
"Phases Stormwater Pollution Prevention Plan. (SVIIP -P) will be prepared for review and
approval by both the Town's Planning and Building.Departments, as well as NYSDEC
Region 1.. .
§280-143'Matters to be considered.
..In making .such determination; consideration shall also be given,. ,among other . .
things, to:
A. .The character of.the existing and..probable development of,uses in the district
and the peculiar suitability of such district for the location of any of such
permitted uses.
'.The. Project is compatible with the surrounding commercial and industrial properties. In
addition, the Project will maintain and enhance existing vegetation on Site to create a
visual,buffer from.adjacent properties.
B. The conservation of property values and the encouragement of the most
appropriate uses of land.
The Project significantly enhances both the Property's value and land use, including the
following direct benefits to the Town:

• Improved, more cost-effective, local LIPA electric service reliability during daily
and seasonal peak demands, as well as during and severe weather storms;
• A new Property Tax Base via a PILOT Agreement through the Suffolk County.
Industrial Development Agency (SCIDA); and
• An eight(8) month construction timeframe with up to 40 construction jobs (20'on-
Site at one during the Project's peak construction period).
The Project will support and promote New York State's movement away from
fossil fuel energy sources and toward renewable energy sources, thereby
improving, over time,,the local airshed and quality of life-for Town residents.
C..The effect that the location of the proposed use and the location that entrances
and exits may have upon the creation or.undue increase of vehicular traffic
congestion on.public streets, highways or sidewalks to assure the public safety.
A temporary, slight increase, to Main Road/NY25 traffic is:anticipated during the Project's
8-month construction period. The Facility will be unmanned and controlled and monitored
remotely during its long-term Operation,with periodic Facility Operation and Maintenance
(O&M), as.well as Site .Maintenance-crews of two (2) to three (3) people routinely
conducting on-Site visits. During Facility servicing activities (replacing or adding energy.
ilit 's eergdelvestorage.batteries required to maintain the-Fac energy guarantee to LIPA)',
which occurs once every 4-to-5 years; .10-15 people would be on-Site.daily for one week.
. Such.periodic_O&M Site visits would not be expected to have a significant impact on local;
traffic volume along Main Road/NY25.
D. The availability of adequate and proper public or private watersupply and..
facilities for the:freatment, removal or discharge.of sewage, refuse or other
effluent(whether liquid, solid, gaseous or otherwise)that may be caused or
created by or as a result of the use.
The Project will require and secure a SuffolkCounty Water Authority (SCWA) connection
and hydrant during the'Project's.Construction Phase; periodic landscaping maintenance
during the Project's Construction and Operations Phases; and with meet the Town Fire
Marshall's anticipated requirements for on-Site.Facility fire protection during the Facd.ity's
Operation Phase.
Project .generated Construction .Phase refuse removal will be the responsibility of.the
project's Construction Contractor engaging a Town-approved refuse carter.
On-Site Construction Phase portable restrooms will be'provided and serviced by the
Project's Construction Contractor.
No on-Site sanitary/septic installation and/or refuse removal are required since the Facility
will be unoccupied and monitored remotely.

E.Whether the use or the materials incidental thereto or produced thereby may
give off obnoxious gases, odors, smoke or soot.
The BESS Project will not generate any obnoxious gases, odors, smoke or soot.
F. Whether the use will cause disturbing emissions of electrical discharges;dust,
light, vibration or noise.
■ There will be no Facility electrical, dust emissions and no Facility vibrations during the
Facility's Operations Phase.
■ The Project's Construction Phase Contractor will utilize Best Practices to control Site .
earthwork dust emissions and vibrations.
Construction'Phase noise will be temporary, localized .and limited to the hours of .
construction:
The Project will provide the Town with predicted sound modeling analysis complying. .. .
with the.Town's Noise Code §1.80-6 once completed. .Predicted noise levels during
Project'Operation .(transformers/HVAC systems) are not expected to exceed the
Town's Noise:,Code:§180.=6. .
As the Facility will be classified,ai.:a federal and;New York State Homeland Security
Critical rifrasture, dark-sky:compliant security lighting fixtures will be. installed within
the Project Site. This .lighting. system will 'only activate ,during an emergency -or
Site/Facility security threat:
Q. Whether.the operation in pursuance of..the use will cause;undue interference
with the orderly.enjoyment by the public of parking or of recreational facilities,if
existing or if proposed by the Town or by other competent governmental
agencies.
Operation of the.BESS will not cause undue.interference with the orderly enjoyment by
the public of parking or of recreational facilities.
H. The necessity for bituminous-surfaced space for purposes of off-street parking
of vehicles.incidental to the use and whether such space is.reasonably adequate
and appropriate and can be furnished by the owner of the plot sought to be used
within.or adjacent to the plot wherein the use shall be located.
The BESS will be an unmanned Facility requiring only periodic maintenance activities
(vegetation management,.component repair/replacement),-which the proposed on-Site
BESS service road is more than capable of adequately servicing.

1. Whether a hazard to life, limb or property because of fire, flood, erosion or
panic may be created by reason of or as a result of the use or by the structures to
be used therefor or by the inaccessibility of the property or structures thereon for
the convenient entry and operation of fire and other emergency apparatus or by
the undue concentration or assemblage of persons.upon such plot.
The proposed BESS Facility will be engineered, procured and constructed subject to the
Town,Fire Marshall's review and approval.
J. Whether the use or the structures to be used therefor will cause an
overcrowding of land or undue concentration of population.
The BESS will not cause an.overcrowding of land or undue concentration of population
as the BESS is an.unmanned facility.
K.Whether the plot area is sufficient, appropriate and adequafe for the use and
the reasonably anticipated operation and expansion thereof.
As confirmed in Attachment,B: Conceptual Site Plan,the:plot..area is sufficient for the
purposes of the proposed BESS:
I. Whether-the:use to be operated is unreasonably near to a church, school,
theater, recreational area or other place of public assembly
No church, school; theater, recreational area or other place' assembly is

The Applicant will work with the Town to include and install appropriate.safeguards. The
Project, at present,plans to utilize on-Site catch basins and diffusion wells to manage on- .
Site.stormwater generation.
Sanitary waste, generated only during the Project's Construction Phase, will be properly
managed and disposed via portable restrooms serviced by the Project's construction
contractor.
P. Whether-the natural characteristics of the site are such that the proposed use
may be introduced there without undue disturbance or disruption of.important
natural features, systems or processes.and without risk of pollution to .
groundwater and surface waters on and off the site,
The Project is being engineered to minimize/mitigate impacts to the natural characteristics
of the.existing.Site. This includes maintaining the Site's existing natural:topography to
the greatest extent possible; supplementing the Site's existing. drainage characteristics;
working with NYSDEC and the.Town regarding the mapped NYSC EC wetland buffer;
and ensuring that the Project will-not'impactthose species and communities identified.in
the New York Natural Heritage Pro'gram's (NYNHP).Augu' .26,2020;response letter. .

Energy Storage System(BESS)to'be located at 69430 Main Road/NY25 Greanport,NY 11944 that will.interconnectto LIPNs existing 8J Southold
Substation also located on Main Road/NY25,GreenporL.The BESS will be capable.of powering approximately28,746 homes for up to 8 hours. .
The BESS will be chargedfrom`LIPA's 84 Southold Substation`during LIPA's daily,off-Peak(nighttime)electric demand and be available to LIPAfor
discharge to LIPA's.BJ:Southold Substation during LIPA's daily peak.electric demand'periods(momin' and aftefnoons/evenings),as welias providing
LIPA with other local electric grid services such as frequency and voltage regulation.
The proposed BESS consists of Batteries equipped with self-contained battery storage enclosures;HVAC Cooling;Inverters;Control instrumentation;and.

The following rare plants, rare animals, and:significant natural communities
have been documented in the vicinity of the project site.
We recommend that potential impacts of the proposed project on these species or communities be.addressed
as part of any environmental assessment or review conducted as part of the planning, permitting and approval
process, such as reviews conducted under SEAR. Field surveys of the project site may be necessary to
determine whether a species currently occurs at the.site,particularly for sites that are currently undeveloped

Moores Woods,north,northeast,and southeast of the project site:A fairly large,mature,uniquely diverse coastal oak-
hickory forest with some evidence of:past disturbance but few invasive exotic species.This forest forms the core of a
recovering,protected landscape surrounded by development:
