TISDALE, of 41 Fifth Avenue, New York City, New York, party of the second 4 part, WITNESSETH. that the party of the first part, in consideration of ONE DOLLAR, lawful money of the United States, paid by the party of the second part, does hereby grant and release unto the party of the second part, her heirs and assigns forever, An undivided one-half interest in and to the following premises:- FIRST:- ALL that tract or parcel of land, with the buildings and improvements thereon,.situate at Bay View, Town of Southold, County of Suffolk and State of New York, bounded and described as follows:- Northerly by the North Road; Easterly by the several lands of Howard H. Terry end Mary E. Dayton; again Northerly by land of Mary E. Dayton; Southerly by land of Mary E. Dayton and Westerly by Jacob's Lane, so called. Con- taining by estimation twenty-four (24) acres, more or less. ALSO, ALL that other tract or parcel of land situate at Bay View, aforesaid, and bounded and described as follows:- Northerly by the North Road; Easterly by Jacob's Lane, so called,, Southerly and Westerly by lands of Edwin H. Brown (formerly of Belle V. Bidwell). Containing by estimation fourteen (14) acres, more or less. BEING and intended to be the same premises conveyed by Charles E. Terry and wife to William Zukas and wife by deed dated December 31st, 1923, and recorded in Suffolk County Clerk's Office, in liber 1091 of deeds at page 10 on December 31st, 1923 at 2:01 P.M. Also, BEING and intended to be the same premises conveyed by William Zukas and wife to George Merrick Tisdale by deed dated February 6th, 1937, and recorded in the Suffolk County Clerk's Office in liber 1905 of deeds at page 498 on February 8, 1937. Together with the appurtenances and all the estate and rights of the party of the first part in and to said premises and in and to the roads, highways and ways adjoining said premises. SUBJECT, however, to all covenants and restrictions in former deeds contained. Being and intended to be the same premises conveyed by Edwin H. Brown and Adeline R. Brown, his wife, to Daniel H. Horton, by deed dated the 15th day of January, 1918, and recorded in the Suffolk County Clerk's Office, on the 22nd day of January., 1918, in liber 961 of deeds at page 463. Also, BEING and intended to be the same premises conveyed by Daniel H. THIRD:- ALL those tracts or parcels of land situate at Southold, in the Town of Southold, County of Suffolk and State of New York, described as follows:- PARCEL #1 Bounded on the north by land of Charles E. Terry and Harriet Pease; East by Cedar Lane, so called; South by Main Highway running thru Bay View; West by Meadow Land of Mary H. Dayton and Goose Creek, containing approximately 30 acres. PARCEL #2 Bounded on the North by Main Highway running thru Bay View; East by land of Godfrey Koke; South by Corey's Creek and Meadow of Alvah M. Salmon and others; West by land of William Griswold, containing approximately 13 acres, excepting therefrom a lot of land approximately 40 X 100 more particularly described in release of mortgage recorded in the Quffolk County Clerks Office July 2, 1932, in Liber 1658 of deeds at page 523. Being and intended to be the same premises conveyed by Reginald C. Smith, referee, to William Kroemer, by deed dated April 7, 1936, and recorded in Suffolk County Clerk's Office, in liber 1857 of deeds at page 1. Petty and wife by Liber 1328 of deeds at page 53; (3) Marcus W. Terry and others by Liber 1328 of deeds at page 55; (4) Herbert W. Tuthill and others by Liber 1328 of deeds at page 60; (5) Mary A. Terry and others by Liber 1328 of deeds--at page 50 and (6) Ferris L.R. Francisco and wife by liber 1163 of deeds at page 381, and ALSO, being and intended to be the same premises conveyed by Frank H. Corwith and wife to George M. Tisdale by deed dated February 10, 1938 and recorded in the Suffolk County Clerk's Office in liber 1972 of deeds at page 62 on March 14, 1938. ALL of the said parcels hereinabove described being,inteAded and are hereby conveyed subject to all liens, mortgages and encumbrances of record. Together 'with the appurtenances and all the estate and rights of the party of the first part in and to said premises. TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, her heirs and assigns forever. The party of the first part covenants that if any improvements, repairs or alterations to the premises have been commenced and have not been completed at least four months before the recording of this deed, the Grantor will receive the consideration for this conveyance as a trust fund to be applied first for the purpose of paying the cost of improvement, and that said Grantor will apply the some first to the payment of the. cost of improvement before using any part of the total of the some for any other purpose. AND said GEORGE M. TISDALE covenants as follows:- FIRST. That said GEORGE M. TISDALE is seized of the said premises in fee simple, and has good right to convey the same. SECOND. That the party of the second part shall quietly enjoy the said premises; THIRD. That the said premises are free from incumbrances, excepting as hereinbefore stated. FOURTH. That the party of the first part will execute or procure any further necessary assurance of the title to said premises; FIFTH. That said GEORGE M.
