HomeMy WebLinkAboutLP-05/11/2004LAND PRESERVATION COMMITTEE MEETING Minutes of Regular Meeting held Tuesday, May 11, 2004 Members Present: Members Absent: Also present: Ray Blum, Chairman Ray Huntington John Sepenoski Fred Lee Michelle Zaloom Craig Arm Eric Keil Bill Edwards (liaison to Town Board) Melissa Spiro, Land Preservation Coordinator Melanie Doroski, Secretary to LPC Tim Caufield, Vice President of Peconic Land Trust Margot Booth Commencement: The meeting began at 7:16 p.m. (Note: Scheduled April 27, 2004 meeting had been canceled) MOTION was made by Ray Huntington, seconded by Fred Lee & John Sepenoski, to accept minutes of April 13, 2004. Motion carried 5/0. Applications: · WESNOFSKEPROPERTY SCTM #: Location: Total Acreage: PDR Acreage: Zoned: 1000-69-4-8.1 36450 CR 48, Southold (s/s CR 48, Southold) 8.3 acres +6 acres offered as PDR A-C Reviewed status with Melissa. Melissa negotiated offer with Ernie Wesnofske, who told potential purchaser, Nick Plananento, who later met with Melissa. He would like to include existing farmstand area, behind the farmstand and one of the back barns in the reserved area. The last barn would remain in the PDR area. Concern raised as property is approximately 8 acres and PDR may drop to 6 acres. Question asked as to whether or not it is acceptable for PDR to go below 7 acres. LPC approved PDR easement of less than 7 acres. No grants are involved with this purchase. John Sepenoski proposed that there would be no splitting of house and farm in the future. No further subdivision would be permitted on this parcel. MOTION made by Ray Blum, seconded by Ray Huntington, to modify resolution adopted on April 13, 2004, to amend reserved area and primary structure area to include the farmstand, homestead, shed, and first barn and agree to decrease size of PDR area. Motion carried 5/0. SEPENOSKI PROPERTY SCTM #: Location: Total Acreage: PDR Acreage: Zoned: 1000-69-1-6 37025 County Road 48 (n/s), Peconic 40.090 acres 35.090 acres offered as PRR A-C John Sepenoski recused himself from all discussions on this project. Reviewed status. Issues raised: 1) curb cut for possible future winery; (see no issue with this) 2) wetlands area; 3) LIPA easement needs to be excluded; (agreed) 4) County Rd 48 fill area (agreed to pay for it); 5) environmental summary, 3 recommendations made - owner will remove tires and some equipment, no oil in remaining things; 6) Ag structure issue relating to obtaining State grant monies or not. Plan of action: 1) have John Ehlers, surveyor, list wetlands acreage amount on survey; 2) have wetland area flagged by Chris Pickerell or Mark Terry; 3) get letter fro Gail Wickham, Esq. regarding environmental summary issues; 4) Ag & Markets Ag Structure issue - Although the remaining 4 committee members were split as to whether or not to try to obtain State grant money on this parcel, it was finally agreed upon to direct Melissa to try to get grant money on a different deal. Keep Sepenoski deed language "as is" to continue towards closing deal on development rights. PEARSON PROPERTY SCTM #: Location: Total Acreage: Zoned: SCTM #: 1000-75-7-6.1 3258 South Harbor Rd, Southold 16.98 acres A-C 1000-86-6-31 Location: 44332 Main Rd, Southold Acreage: 5.32 acres Zoned: A-C Reviewed current status. This project was first brought to the attention of the Land Preservation Committee some time ago and has remained dormant. In the meantime, Dr. Nancy Pearson had made an application to the County but was turned down. She has been in touch with Ray Huntington who asked her to bring her amended proposal before the Committee. After reviewing the amended proposal, it was found that there is a covenant & restriction for no further subdivision on the 5-acre parcel. Since Nancy Pearson wishes to retain one building area within this lot there is nothing left to preserve in the 5-acre parcel. LPC agreed to proceed with the other parcel. MOTION was made by Ray Huntington, seconded by John Sepenoski, to commission an appraisal on SCTM #1000-75-7-6.1, reserving area around existing house to the creek. The existing barn can remain in the PDR area. Motion carried 5/0. Note: Possibly move driveway right-of-way before development rights purchase. The members entered into EXECUTIVE SESSION. DRUM & SALAND PROPERTY SCTM #: Location: Total Acreage: Zoned: 1000-87-1-26 300 Minnehaha Blvd, Southold (w/s Minnehaha Blvd) 2.1587 acres open space R-40 Reviewed status of purchase price negotiation. MOTION made by Ray Huntington, seconded by Ray Blum, to amend purchase price to an counter-office by seller. Motion carried 5/0. DORSET PROPERTY SCTM #: Location: Total Acreage: PDR Acreage: Zoned: 1000-100-4-8 4100 Oregon Rd (south side), Mattituck +33 acres +31.5 acres offered as PDR A-C Reviewed status. Seller is anxious to get moving on this project. Request from Peter Caroll to reconsider purchase offer to reflect current development rights purchase price per acre. Motion made by John Sepenoski, seconded by Fred Lee, to up the purchase price per acre providing seller accepts Federal contract language. Motion carried 5/0.
