Gillispie, Jr., Chairman Robert Bergen Herbert Rosenberg Charles Gregonis, Jr. Serge Doyen, .Jr. MINUTES SOUTHOLD TOWN BOARD OF APPEALS July 20, '1961 A regular meeting of the Southold Town Board of'Appeals was held 7:30 P.M., Thursday, July 20, 1961 at the Town Clerk Office, Main Road, Southold, New York. There were present:. Messrs. RobertW. Gillispie~ Jr., Chairman, Robert Bergen, and Herbert Rosenberg. Absent: Mr. Serge Doyen, Jr., and Charles Grigonis, Jro Also present: Mr. Howard M. Terry, Building Inspector. The minutes of the meeting of July 13, 1961, on' motion of Mr. RoseD3oerg, seconded by Mr. Gillispie, were approved as submitted. Vote of the Board: Ayes:-' Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg. Southold Town Board of Appeals -2- July 20, 1961 PUBLIC HEARING: Appeal No. 398 - Upon application of C. Gray Smith and Hope P. Smith, 39-14 215 Place, Bayside 61, New York, for a special exception in accordance with the Zoning Ordinance, Article III, Section 300, Subsection 3A~ for permis- sion to install marina facilities for private boats. Location of property: north side Pine Neck'Road, Southold, New York, bounded north by Creek, south by Frank Zazecki, east by Ed Worth, and west by E. A. Lademann. Fee paid $15.00. The Chairman opened the hearing by reading application for a special exception, legal notice of hearing and affidavit attesting to its publication in the officialnewspaper. THE CHAIRMAN: I have a letter from Mr. Smith which I will read. "Gentlemen: I wish to withdraw my recent application to construct a small marina on my property on Pine Neck-Road~ Southold, N.Y. I have learned that there will be protests to this project, and since I do not wish to go against the interests of my neighbors, I consider it inadvisable to continue with this enterprise. Sincerely yours, C. Gray Smith." On motion of Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that application of C. Gray Smith for a special exception be withdrawn without prejudice to the applicant. Vote of the Board: Ayes:- Mr. Gillipsie, Mr. Bergen~ and Mr. Rosenberg. On motion of Mr. Bergen, seconded by Mr. Rosenberg, the Board of Appeals set 7:30 P.M. (E.D.S.T.), Thursday, August 3~ 1961, Town Clerk Office, Main Roads Southold, New York, as time and place for hearing upon application of Edward Nidds~ Main Road,~Southold, New York, a/c~Hartvig Tjornhom, 741 50th Street, Brookt~r~ New York, for recognition of access in accordance with State of New York Town Law, Section~280A. Location of prpperty; north side Liberty Lane, Southold, New York, part of lots 61 and 62 on map of Nidds, Reydon Heights~ bounded north by C. J. Schimanski, east by Edward Niddst south by Liberty-Lane~ and west by'Edward Nidds. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg. Southold Town Board of Appeals -3- July 20, 1961 It was further RESOLVED that legal notice of hearing be published in the official newspaper on July 28, 1961. Vote of the Board:~ Ayes:- Mr. GillispJ~ ~Lr. Bergen, and Mr. Rosenberg. The Board also received an application for a variance from Mr. Lawrence A. Brewer, Mattituck. This application was returned to Mr. Brewer for further information. PUBLIC HEARIN~Appeal No. 400 - Upon application of Robert Ketcham, Jr., Bay Lake Park, East Marion, New York, a/c Crescent Beach Colony, Main Road, East Marion, New York, for a special exception in accordance with the Zoning Ordinance, Article III, Section 300~ Subsection 11, for permission to erect and maintain directional sign on the property of A. W. Fismer Estate, south side Main Road, east of Bay Home Road, Southold, New York. Fee paid $15.00. The Chairman opened the hearing by reading application for a special exception, legal notice of hearing and affidavit attesting to its publication in the official newspaper. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? MR. ROBERT KETCHAM, JR., Bay Lake Park, East Marion, New York: I do. THE CHAIRMAN: What wording have you decided on for the sign? MR. KETCHAM: I explained to Mr. Cornibertthat the Board did not permit private beach nor golf on the sign. I believe he is satisfied with the wording applied for; that is~ "In East Marion, Crescent Beach Colony, Motel, Efficiency Apartments," THE CHAIPAV~AN: The words "EfficiencyApartments" will not be permitted. That would be in the form of advertising. Most other motels in the area have efficiency apartments and they are not permitted to indicate that on their signs. Also, the new size of directional signs is 24 sq. f%. However, when you applied for this szgn we stated you would be permitted Southol. d Town Bc~rd of Appeals -4- July 20, 1961 a sign 32 sq. ft. in area. MR. KETCHAM: I am sure Mr. Cornibert will be willing to accept the 32 sq. ft. size. T~ CHAIRMAN: Is there anyone else present who wishes to speak for this application? (There was no response.) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed~ therefore On motion of Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that Robert Ketcham, Jr., a/c Crescent Beach Colony be granted permission to erect and maintain a directional sign on the property of'A. W. Fismer Estate, south side Main Road, east of Bay Home Road, Southold, New York. Exact location: at least 5 ft. and not more than 20 ft. from the easterly property line and at least 10 ft. and not more than 15 ft. from the northerly property line. Size of sign: 4 ft. by 8 ft., outside dimensions not greater than 32 sq. ft. Wording: "In east Marion, Crescent Beach Colony, Motel." The number of miles may be added to the sign. This sign is subject to the same regulations and controls which affect non-conforming signs. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, and Mr. Rosenberg.
