It has been determined that the proposed modifications will not substantially change the scope of the permitted actions or the existing permit conditions. Therefore, the permit is hereby modified to authorize the following: Reissue the permit with a new expiration date of November 5, 2028. Install a new pool, patio, fence, retaining walls, drywell, and pool equipment. All work must be done in accordpnce with the attached plans prepared by Homeport Engineering, P.C., dated July 2, 2024, and stamped approved by NYSDEC on July 11, 2024. The following Natural Resource Permit Conditions are added to the permit: 23. No Fencing in the Tidal Wetland All fencing installed under the authority of this permit must be located in the adjacent area (upland). This permit does not authorize the installation of fencing in the tidal wetland areas. 24. No Drywells in or near Wetland Dry wells for pool filter backwash shall be located a minimum of 75 feet landward of the tidal wetland boundary. 25. No Pool Discharges to Wetland There shall be no draining of swimming pool water directly or indirectly into wetland or protected buffer areas.
