SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject parcel is a conforming 43,785 sq. ft. lot in the Residential R-40 District. The parcel is roughly rectangular with two compound curves at the corner of North Drive and Bayview Avenue. The north side measures 180 feet from North Drive to the eastern property line at a neighboring residential lot. The eastern property line extends 216.13 feet south to Bayview Avenue. The southern property line measures 210.84 feet along Bayview Avenue then follows a radius of R20.95 feet,L 45.40 feet to North Drive,then follows a radius of R270.72 feet, L127.15 feet along North Drive, then runs 70.0 feet north along North Drive to the northern property boundary.The lot is improved with a one-story frame dwelling with two-attached two car garage,an above- ground swimming pool with deck, a 10.2 ft. x 16.3 ft. shed adjacent to the northern property line within a 15-foot right-of-way, and a 12.2 ft. x 12.2 ft. shed in the northeast corner, all as shown on the survey prepared by Donald J. Metzger, Peconic Surveyors, P.C., dated October, 19, 2023 and last updated June 19, 2024. An 8 ft. x 8 ft. shed, identified as"shed to be removed"on the survey, was not observed at the time of a January 8, 2025 site inspection. BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-15; and the Building Inspector's July 24, 2024 Notice of Disapproval based on an application for a permit to construct an accessory garage; at, 1) located less than the code required minimum property line setback of 15 feet; located at: 190 North Drive,Mattituck, NY. SCTM No. 1000-106-6-33. RELIEF REQUESTED: The applicant requests a variance to construct a 30 it. x 40 ft. accessory garage in the northeast corner of the parcel as depicted in the survey prepared by Donald J. Metzger, Peconic Surveyors, P.C., dated October, 19, 2023 and last updated June 19, 2024,with a rear yard setback of 2 feet where the code requires a ,minimum setback of 15 feet for a parcel between 40,000 and 59,999 sq. ft. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on January 28,2025 submitted a plan increasing the setback to 6 feet, bringing the plan into more conformity with the code. Metzger, Peconic Surveyors, P.C., dated October, 19, 2023 and last updated June 19, 2024. The applicant subsequently provided a survey by Donald J. Metzger, Peconic Surveyors, P.C., dated October, 19, 2023 and last updated January 16,2025. The 16.3 ft. x 10.2 ft. existing shed located in the Right of Way along the northern property line lacks a Certificate of Occupancy as required for sheds exceeding 144 sq. ft. The applicant provided a floor plan, elevations, sections, and details for the proposed accessory structure prepared by James A. Kopenhaver, P.E., dated June 17, 2024 and labeled respectively A.1,A.2, A.3, and A.4. The applicant provided truss details prepared by Juan Garcia, P.E.,dated November 7,2016. The subject parcel is covered by Certificate of Occupancy No.Z-1129 dated September 5, 1961 pursuant to Building Permit Z-865 for a private one family dwelling. Improvements to the subject parcel are covered by: Certificate of Occupancy No. Z-4044 dated November 20, 1970 pursuant to Building Permit 5034-Z for a private one family dwelling; Certificate of Occupancy No. Z-12248 dated February 8, 1984 pursuant to Building Permit 12862-Z for a porch enclosure; Certificate of Occupancy No.Z-30030 dated February 19,2004 pursuant to Building Permit 29955-Z for an accessory above ground swimming pool with deck and fence; Certificate of Occupancy Z-30198 dated May 14, 2004 pursuant to Building Permit 29956-Z for"enclose existing breezeway in single family dwelling." The deed for the parcel Liber 9501 page 441 recorded January 25, 1984 documents a right of way and easement 15 feet in width, along the northerly property line of the subject parcel. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 9,2025 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance as amended will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject parcel on North Drive is part of the Shores Acres neighborhood of Mattituck. North Drive is a narrow, essentially one-lane, road traversing hilly terrain. The parcels along North Drive are generally wooded. The homes are a mix of one- and two-story dwellings. Several parcels feature small frame outbuildings visible from the road that are generally architecturally similar to their associated dwellings. None of the visible outbuildings are of the scale of the proposed accessory structure nor do they present its commercial/industrial appearance. The existing 12.2 ft.x 12.2 ft.shed in the northeast corner,which will be replaced by the proposed accessory garage, is partially visible from both North Drive and Bayview Avenue; the proposed accessory garage will be significantly taller and will be substantially more visible from both North Drive and Bayview Avenue and from the neighboring dwelling to the east along Bayview Avenue. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue,other than an area variance. The stated purpose of the new construction,"To provide storage for cars and household goods,"could be achieved with a structure of reduced dimensions and more architecturally in keeping with a residential neighborhood. The variance requested herein for the amended application is mathematically substantial, representing 60% relief from the code. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law§267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additional on-site storage for cars and household goods while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
